Mr. Clarke's response discussed the sequence of events associated with the awarding of the World Equestrian Games (Games), acknowledged the steps forward to re -authorize some of the utility related development activities and your intention to submit a modification request for the additional impacts associated with the Games. These steps include eliminating impact areas El and E2 pending the modification request. The impact areas you have requested to proceed with include UC I, UC3, UC4 and UC5, each resulting in temporary impacts to 30 linear feet of stream channel for utilities installation as depicted on the plat entitled Figure 1: Modified Impact Map and dated June 6, 2016. It is our understanding from your correspondence and discussions with your authorized agents that the request to modify your permit will be submitted this week. Upon receipt of your modification request, we will review the package for completeness and then issue a 30 -day Public Notice. The Corps is aware that the Games are a major event for the state and region and remains committed to moving this project forward expeditiously through the appropriate review process. Per this letter the Corps has agreed to reinstate the previously authorized impacts UC 1, UC3, UC4 and UC5 totaling 120 linear feet of temporary impact. These impacts must be completed in accordance with all terms and conditions of the Tryon Equestrian individual permit issued on January 11, 2017. As a reminder, moving forward with these impacts does not imply adequate justification for the location or extent of future impacts. We will examine any future proposal to impact jurisdictional waters of the U.S. cumulatively to ensure that you have avoided, minimized, and/or mitigated for unavoidable impacts. -2 - We look forward to your modification submittal and working with your group collaboratively to address Tryon Equestrian's needs as it prepares for the World.
