Department of Transportation, P.O. Box 1587, Greenville, NC 27835 Authorizing development in Carteret County at roadside canals, US 70 between North River Corner and Stacy , as requested in the permittee's application dated 2/16/16, including the attached worknlan drawine (1) dated 2/12/16. This permit, issued on 2l23/16 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) 2) Road Shoulder Reconstruction Unless specifically altered herein, this Minor Modification authorizes 6401ineaz feet of additional road shoulder reconstruction, and an expansion of the authorized project area, as depicted on the attached workplan drawing. The placement of riprap shall be limited to the areas as depicted on the attached workplan drawing. The riprap material shall be clean and free from loose dirt or any pollutant, except in trace quantities. 3) The riprap shall not extend waterward more than 5 feet from the normal water level at any point along its alignment at the time of construction, and the riprap shall not extend waterward more than an average distance of 3 feet from the normal water level along its full alignment at the time of construction. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretaty of DEQ and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. This permit must be accessible on-site to Deparhnent personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. `�'"�.G- dH'"�� _ � Braxton C. Department of Transportation Permit #7-16 Page 2 of 2 ADDITIONAL CONDITIONS 4) The filter fabric associated with the riprap/backfill shall be in place prior to the placement of any backfill. 5) All fill material shall be obtained from a high ground source. No unconfined fill material shall be discharged into estuazine or public trust waters. 6) No fill material shall be placed at any time in wetlands or waters of the State outside of the alignment of the fill areas as indicated on the attached warkplan drawing, without permit modification. 7) No temporary impacts to wetlands or waters of the State are authorized, without additional authorization from the N.C. Division of Coastal Management (DCM). General NOTE: The activity authorized by this Minor Modification will permanently impact approximately 405 square feet of Coastal Wetlands due to fill and approximately 1,920 square feet of surface waters due to fill. NOTE: In order to prevent similar road shoulder erosion events from threatening the safety of US 70 within the project area in the future, the permittee is strongly encouraged to expedite efforts to develop and implement a proactive long-term solution that addresses transportation safety within the project area. DCM will offer any assistance possible to help achieve this long-terrrt solution. 8) If it is determined that additional impacts aze necessazy that are not shown on the attached workplan drawing or described in the authorization request, a permit modification and/or additional authorization from DCM may be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. 9) The permittee and/or his contractor shall contact the DCM Transportation Project Coordinator in Morehead City at (252) 208-2808 to request a preconstruction conference. 10) This Minor Modification does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required. 11) The permittee shall coordinate with the U.S. Army Corps of Engineers (USACE) and the N.C. Division of Water Resources (DWR) regarding the project. The permittee shall provide any permits issued by USACE and DWR to DCM prior to initiating conshuction activities. 12) This Minor Modification shall be attached to the original of Permit No. 7-16, which was issued on 1/12/16, and copies of both documents shall be readily available on site when a Division representative inspects the project for compliance. 13) All conditions and stipulations of the active permit remain in force under this Minor Modification unless altered herein. NOTE: An application processing fee of $100 was received by DCM for this project.
