Ives 1701 Sunset Ave. Rocky Mount, NC 27804 Subject Property: Bridgecreek Point Subdivision Smith Creek, 030407, 29-34-35-5, NSW, SC REQUEST FOR MORE INFORMATION Dear Mr. Ives: On May 30, 2008, the Division of Water Quality (DWQ) received your application dated April 28, 2008, to impact 0.047 acres of waters and 0.037 acres of coastal wetlands to construct a navigational channel to a permitted 51-slip marina. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 214.0506'ind 2B .0259(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Impacts The information provided in the application indicates that the disturbed open water area is only 2088 square feet. This impact appears to only include the 24' X 87' channel portion to be dredged in Smith Creek but does not include the 3:1 slope impacts as well as it does not include the open water impact area within the basin. Please provide the square footage of impacts to all Waters of the State that are associated with this project. 2. During that meeting the question was asked if there would be a need for dredging associated with the marina for this project. You indicated that no dredging would be required because there were adequate depths in the original channel to allow access to the marina. The impacts in this request are more than three times the original channel length and width for vessels that are eleven feet longer that the original permitted size. Please provide information indicating how the project can be altered to avoid or minimize impacts to water resources and coastal wetlands. 3. Submerged Aquatic Vegetation (SAV) Survey Through discussion with Division of Marine Fisheries (DMF) staff and DWQ staff it has been determined that SAV has been observed in and around Smith Creek. Please provide a SAV survey conducted during the growing season (April 15 - June 15) for the projected impact area of the project. Please respond in writing to the DWQ within four weeks of the date of this letter to with the requested information. If we do not hear from you within four weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
