The proposed boardwalk will impact of 6o5 SF of riparian buffer (Z1: 390 SF & Z2: 215 SF) and is located in a partially completed Townhome community. During construction of the boardwalk, vegetation will be cleared by hand and logging mats will be utilized to avoid impacts to the wetlands and stream channel. No grading, clearing, grubbing, or soil disturbance will occur within the wetland boundaries, therefore, 404/401 Authorization is not required. Much of the site has already been developed and only a few Townhomes remain to be built. The subject property is approximately 12 acres in size and is located west of Stewart Road (SR 1401), approximately 1500 feet south of the intersection of Stewart Road (SR 1401) and Ballentine Dairy Road (SR 1400). Latitude: 35.61071o8°N and Longitude: 78.790o815°W in Fuquay-Varina, Wake County, North Carolina. The site contains unnamed tributaries to Terrible Creek and is located in the Neuse River Basin. The Water Quality Classification for these features is: B;NSW, the Cataloging Unit for this site is: 030202o1, and the Stream Index number is: 27-43-15-8-(1). Project History This 12 acre parcel was originally part of the Wood Chase Subdivision which was developed by First Capitol Investments, LLC as a single family home development. However, this parcel was never developed as part of Wood Chase Subdivision and was sold at a later time to Bill Clark Homes (current owner). The Townes at Buckhaven does not share any amenities with Wood Chase and is a separate and complete project The wetlands were originally delineated by Nelson G. Paul & Associates and were approved by Todd Tugwell as outlined in the Notification of Jurisdictional Determination (AID: 200020715) dated March 20, 2000. 404/401 authorization (AID'S: 200020715/200021152 & NC-DWQ Project #:000719) was obtained for the Wood Chase Subdivision on April 2, 2oo1. Robert J. Following the re-verification, Goldstein & Associates submitted a PCN requesting authorization for impacts associated with the development of the 12 acre site. This request included authorization to impact 97 LF of stream and 0.25 acres of wetlands for the installation of roads to access high ground on-site. Authorization from the USACE and NC-DWQ was not obtained. The site has since been re-designed eliminating the road crossing, replacing it with a board walk which will provide access to open space/amenities area. Avoidance and Minimization Prior to site plan development the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and waters could be minimized. The original plans called for a road crossing in this location rather than a boardwalk. Since then, the site has been re-designed to eliminate wetland and stream impacts. For example, to eliminate wetland impacts, logging mats will be utilized for site access and the stream will be crossed on a raised boardwalk, rather than culverted. Following the completion of construction, the logging mats will be removed. Stormwater Management Plan The proposed impervious for this project is greater than 24% impervious, however, because 401 Certification is not required, we do not believe that a pre-approved stormwater management plan is needed. A copy of the DWQ level spreader worksheets and details are included with the attachments. Please note that one of the level spreaders was approved as part of an earlier submittal, and therefore, does not meet the current design requirements. Mitigation Because there are no stream or wetland impacts, and because greenway trails are considered allowable; we do not believe mitigation should be required. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. No additional impacts are proposed. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads). Be sure to indicate if an impact is temporary. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 5 of 8 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http:,I/h2o.enr.state.nc.us/ncwetlands/strm?,,,ide.htm]. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Because there are no stream or wetland impacts, and because eenway trails are considered allowable; we do not believe mitigation should be required. 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. They do have what appears to be approved construction plans for Phase 2 from Fuquay (Phase 1 did not impact any wetlands) On 04/17/07, Gerald Pottern with Robert J Goldstein & Associates submitted a revised wetland permit for Hunter that reduced the overall impacts for this last portion of the site from what was originally approved for First Capital Investments for the entirety of Woodchase (0.060 AC less wetlands & 13' less stream).....this appears to be because the original permit had expired (I believe that was in 08/02) and all of the mitigation requirements by FCI were completed based on the higher impact numbers (two mitigation areas & $6k to EEP).... the thought here was to avoid any further mitigation requirements....... The first request for additional information on 04/30/07 (from their submittal on 04/17/07) was merely to identify the specific nationwide permit they were seeking...... that was identified (NW-29) and resubmitted (not sure when)........ The latest request for additional information on 10/25/07 requests a couple of things ...... a set of 50 scale plans with various information, which should be easy to obtain from McKim & Creed, as this work appears to have already been completed with the construction drawings and there is no need for us to recreate it........ the second request is quite problematic, as they are now identifying the site to contain "a pocket of high density that requires stormwater treatment per the requirements of GC 3631".......I can only assume this is due to the fact that the original permit was done solely as a single family development and now the plans show townhomes........ therefore, it appears as though they want BMP's in Phase 2, where obviously there is no place for them currently ....... either we (Todd Preuninger) can get involved with DWQ to sort this out or Hunter can go back to Goldstein & Associates to work this out...... either way, it will likely require a meeting and hopefully someone with a relationship with the DWQ folks.......
