EEP's letter, dated June 19, 2008, reflects an extension of the credits' validity until December 19, 2008. I understand that the permit application for this project has been formally returned to the applicant and DWQ has requested that the applicant reapply. However, due to a variety of factors including staff changes at ECS, ECS and the applicant were not able to respond with complete information to DWQ's initial request for more information, dated June 23, 2008. Now that ECS and the applicant have obtained the requested additional information from EEP, we respectfully request that the application be reopened. Please acknowledge the attached letter as EEP's acceptance of payment for mitigation credits for this project and review the complete 401 permit application for the Villages at Cross Creek Project. This acceptance is valid for six months from the date of this letter and is not transferab'.e. if we have not received a copy of the issued 404 Pcrudl/401 Certification/CAMA permit within this cline frame, this acceptance will expire. It is the applicant'> responsibility to send copies of the permits to NCEEP. If the regulatory agencic4 mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance.
