In accordance with 15A NCAC 21-1.0500,the amount you would owe based upon the 2008-09 Fee Schedule has been calculated as follows(fees are subject to change): Habitat Type Invoiced Amount Fee Schedule Cost Riparian Wetlands 0.50 acres x $ 59,600.00 = $29,800.00 Stream 497 linear feet x $ 323.00 = $160,531.00 TOTAL AMOUNT DUE if paid within 60 days $190,331.00 In accordance with a letter issued to you on May 2,2008 and the November 4, 1998 Memorandum of Understanding between the NC Department of Environment and Natural Resources and the US Army Corps of Engineers,EEP will not take responsibility for providing the compensatory mitigation until payment is received. It is our understanding that Versant Properties, LLC is currently in Chapter I 1 bankruptcy in the WDNC,Case No.08-10930. Please be advised that this is not an attempt to collect a debt but rather clarification for your records that there is no debt owed to EEP but should Versant Properties LLC choose to purchase the previously identified mitigation,the amount which would be due EEP is$190,331.00.
