In December, 2106, a violation easement was discovered at Green Environmental Services',
LaGrange, Phase II Mitigation Bank located approximately two miles north of the town of
LaGrange, NC, Lenoir County, and HUC: 03 020202. The violation consisted of mowing, with
tractor, a portion of the Bank even though on-site signage clearly indicated that mowing and
vehicle traffic was prohibited. The tractor operator mistakenly undertook this action without the
knowledge or consent of GES.
Upon the discovery of the violation, GES contacted the NC Division of Water Resources and a
site visit was arranged with personnel from GES (David Knowles), NC DWR (Katie Merritt and
Anthony Scarbraugh). Following the site visit, a letter (dated January 11, 2017) was sent to GES
acknowledging the violation and the steps required to re-establish site compliance. In response,
GES submitted a remediation plan to the NC-DWR on January 25, 2017
As per instructions from NC DWR, GES undertook the following actions as described in the
remediation plan:
1) Bare root seedlings were planted in the mowed areas of the riparian buffer (Zone 1) and in the
nutrient offset area. The mowed area that is in violation of the terms of the Bank's conservation
easement, totals 0.58 acres; planting at a rate of 400 seedlings per acre required 232 seedlings.
The species and counts planted were:
• Platanus occidentalis (sycamore) 100 seedlings (GES planted sycamore on the better -
drained sites)
• Prunus serotina (black cherry) 5 seedlings (GES had proposed planting 32 cherry
seedlings but only 5 of the seedlings available were viable)
• Taxodium distichum (bald cypress) 150 seedlings (GES planted 50 more than we had
proposed to make up for those fewer cherry seedling that were not planted)
• Total 255 seedlings (adjusted density 440 seedlings per
acre)
• While planting, several mowed stems of previously planted seedlings were observed. If
they re -sprout, then they will contribute to the total density and species composition of
the remediation area.
2) Planting was accomplished on February 3, 2017.
3) All planted seedlings were flagged with blue, plastic flagging tape.
4) A photographic record of post -planting site conditions was established (see attached).
5) Two new l Om x l Om monitoring plots were established; one in the riparian buffer (Zone 1)
and one in the nutrient offset zone.
6) Seedling survival (stem counts) and growth (height) in the two new monitoring plots will be
measured annually, at the end of the growing season, and included as part of the annual reports
submitted to the NC Division of Water Resources beginning with the 2017 report.
7) Any damaged easement boundary markers were restored.
8) Three additional easement boundary markers were established.
