Re: LaGrange Ph II Mitigation Bank Site —Approval of Remediation Plan
Dear Mr. Ham:
On December 12, 2016, Jeff Becker with Greene Environmental Services, LLC notified Katie Merritt
with the Division of Water Resources (DWR), of substantial encroachment within the conservation
easement area of the LaGrange Phase II mitigation site. Ms. Merritt, together with the DWR
Washington Regional Office, inspected the site on December 20, 2016. On January 11, 2017, DWR
issued a letter to you noting the issues and noncompliance observed during their inspection. The
following items were required to be submitted to DWR for review and approval:
• A supplemental planting plan for the areas that were mowed, which shall include the
following:
• A commitment to restore damaged easement markings
• A commitment to provide additional easement markings and placards
On January 25, 2017, DWR received a remediation plan from GES for the subject site. The plan is
attached with this letter. By copy of this correspondence, the remediation plan is approved.

Remediation Plan for Greene Environmental Services', LaGrange, Phase II Mitigation

In December, 2106, a violation easement was discovered at Green Environmental Services',
LaGrange, Phase lI Mitigation Bank located approximately two miles north of the town of
LaGrange, NC, Lenoir County, and HUC: 03 020202. The violation consisted of mowing, with
tractor, a portion of the Bank even though on-site signage clearly indicated that mowing and
vehicle traffic was prohibited. The tractor operator mistakenly undertook this action without the
knowledge or consent of GES.
Upon the discovery of the violation, GES contacted the NC Division of Water Resources and a
site visit was arranged with personnel from GES (David Knowles), NC DWR (Katie Merritt and
Anthony Scarbraugh). Following the site visit, a letter (dated January 11, 2017; see attached) was
sent to GES acknowledging the violation and the steps required to re-establish site compliance.
As per instructions from NC DWR, GES will undertake the following actions:
1) Bare root seedlings will be planted in the mowed areas of the riparian buffer (Zone 1) and in
the nutrient offset area. This mowed area that is in violation of the terms of the Bank's
conservation easement totals 0.58 acres; planting at a rate of 400 seedlings per acre would
require 232 seedlings. The species and counts to be planted will be:
• Platanus occidentalis (sycamore) 100 seedlings
• Prunus serotina (black cherry) 32 seedlings
• Taxodium distichum (bald cypress) 100 seedlings
• Total 232 seedlings
2) The deadline for planting will be February 28, 2017.
3) All planted seedlings will be flagged with blue, plastic flagging tape.
4) A photographic record of post -planting site conditions will be established.
5) Two new IOm x l Om monitoring plots will be established; one in the riparian buffer (Zone 1)
and one in the nutrient offset zone.
6) Seedling survival (stem counts) and growth (height) in the two new monitoring plots will be
measured annually, at the end of the growing season, and included as part of the annual reports
submitted to the NC Division of Water Resources beginning with the 2017 report.
7) Any damaged easement boundary markers will be restored.
8) Additional easement boundary markers will be established.
Upon approval of this remediation plan by NC DWR, GES will implement the plan and notify
NC DWR of its completion.
