III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17 -inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are
reduced to a small scale such that the final version is illegible, the applicant will be informed that
the project has been placed on hold until decipherable maps are provided.

North side of Vernon Avenue (Business Hwy 70) west of Vernon Park Mall at the corner
of Vernon Ave. and Hull Road (SR 1557). See the attached vicinity map

9. Describe the existing conditions on the site and general land use in the vicinity of the project
at the time of this application: The project is located on the east side of the Caswell

Campus and is an existing open channel. The project site is bound to the north by
grassed lawns and the to south by gricultural land. The outlet end of the channel is a 72"
culvert which drains under the parking lot of the adjacent Vernon Park Mall. The channel
Currently drains most of the eastern side of the campus through a series of pipes which
discharge into the west end of the channel. See the attached aerial map for the existing
conditions.
10. Describe the overall project in detail, including the type of equipment to be used:
The proposed project includes the piping of two sections of open channel and repairs at two
points on existing culvert piping on the campus of the Caswell Center in Kinston NC
The project is shown on drawings C1 and C2. The I" section of channel is located on the
west side of Hull Road and will include the installation of 96 LF of 60" RCP 84 LF of 30"
RCP, 34 LF of 12" CMP, 3 drop inlets and 1 junction box. The second section of channel
includes the installation of 336 LF of 60" RCP 384 LF o 66" RCP 3 drop inlets and one
junction box. Both sections of channel have been evaluated by NCDENR DWO and the 2nd
section (Drawing C2) was identified as a stream.
The construction sequence for piping the channels is as follows:
1. The channels will be cleaned out removingall ll vegetation and the top 6-8 inches of
sediment using an excavator and truck to remove the soil and dispose
2. Select fill will be placed in the channel to establish the slope and foundation for the pipe
using a front end loader.
3. The new piping and inlets will be installed using a backhoe front end loader and
compaction equipment.
4. The remaining fill will be installed to bring the area to grade using front end loader and
trucks to haul the soil.
5. The areas disturbed will be graded and seeded.
The repair areas will include excavation of the failed sections of piep removal of the pipe
and replacement with new sections of pipe backfillinggrading and seeding of areas
disturbed. This work will be accomplished using an excavator and front end loader.
11. Explain the purpose of the proposed work: The project was originally identified by the
Owner as a need to remove a safety hazard on the Caswell Campus. Several vear ago a
resident fell into the ditch and drowned and since that time the Center has been attempting to
get the needed project funding. Also identified during this time was the degradation of the
channel as it has continued to erode and widen causing the headwall at the west end of the
channel to begin to collapse. The piping of the ditch will stop the erosion and widening of
the channel and take away the safety hazard on the campus
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and

buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules.
A stream determination has been conducted by NCDENR DWQ (Project # KB -05-0062) and is
attached.
V. Future Project Plans
Are any future permit requests anticipated for this project? If so, describe the anticipated work,
and provide justification for the exclusion of this work from the current application.
No future permit requests are anticipated for this project.
VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. Each impact must be
listed separately in the tables below (e.g., culvert installation should be listed separately from
riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts,
permanent and temporary, must be listed, and must be labeled and clearly identifiable on an
accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial)
should be shown on a delineation map, whether or not impacts are proposed to these systems.
Wetland and stream evaluation and delineation forms should be included as appropriate.
Photographs may be included at the applicant's discretion. If this proposed impact is strictly for
wetland or stream mitigation, list and describe the impact in Section VIII below. If additional
space is needed for listing or description, please attach a separate sheet.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower -impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Alternatives to the proposed project include doing nothing and stabilization of the ditch The
option of doing nothing will allow the channel to continue to erode and deepen and it continues
to be a safety hazard for the campus. To stabilize the channel would provide a temporary
solution but the channel would continue to deepen and the safety hazard would remain By
piping the channel the safety hazard is removed erosion and deepening of the channel will end
and the pipe will maintain the hydraulic flow of the channel As a part of this project the area to
be filled will be graded to provide sheet flow of runoff prior to entering the proposed drop inlets
and the area will be converted to a grassed lawn area with some trees This should provide some
nutrient removal for this runoff.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE — In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of

aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmizide.html.
1. Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Proposed mitigation for this project includes the designation of a conservation easement on
the Caswell Center property along an existing stream. This stream is shown on the attached
map and is also a UT to the Neuse River. The conservation area proposed is approximately
3.5 acres and is a wooded undisturbed area adjacent to the stream
2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement
Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at
(919) 715-0476 to determine availability, and written approval from the NCEEP indicating
that they are will to accept payment for the mitigation must be attached to this form. For
additional information regarding the application process for the NCEEP, check the NCEEP
website at http://h2o.enr.state.nc.us/wrp/index.htm. If use of the NCEEP is proposed, please
check the appropriate box on page five and provide the following information:

On -Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A
NCAC 2B.0233)
Dear Ms. Smith:
On October 19, 2005 at your request, I conducted an on-site determination to review two feature located
on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The property
is located north of Business Hwy 70 (Vernon Ave.) and east of SR 1557 (Hull Road) near the Vernon
Park Mall in Kinston, NC. The features are labeled as "A" and `B" on the attached map initialed by me
on 10/21/05.
The Division of Water Quality (DWQ) has determined that the surface water labeled as "A" on the
attached map is Exemat of the Neuse Buffer Rule. Feature "B" has a 700 linear foot portion that is
not culverted on the subject property. This section is Subiect to the Neuse Buffer Rule. These
features should be identified on any future plans for this property. The owner (or future owners) should
notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning
this property. This determination pertains to the subject property only. This on-site determination shall
expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local
Authority that a surface water exists and that it is subject to the buffer rule may request a determination
by the Director. A request for a determination by the Director shall be referred to the Director in writing
c/o Cyndi Karoly, DWQ Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. Individuals
that dispute a determination by the DWQ or Delegated Local Authority that "exempts" a surface water
from the buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. Applicants are hereby notified that the 60 -day statutory appeal time does not start
until the affected party (including downstream and adjacent landowners) is notified of this decision.
DWQ recommends that the applicant conduct this notification in order to be certain that third party
appeals are made in a timely manner.

Dear Mr. Outlaw:
On August 20, 2007, at your request 1 conducted an on-site determination to review stream feature located
on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The feature is
labeled as "07-1423(a), 07-1423(b), and 07-1423(c)" on the attached maps initialed by me on August 20,
2007.
The Division of Water Quality (DWQ) has determined that the feature labeled as "07-1423 (a), 07-
1423(b), and 07-1423(c) marked in red" on the attached map are Subject to the Neuse Buffer Rule.
Starting at point 07-1423(c) (35°, 16', 26.76" North, 77°, 32', 23.47" West), marked on the ground by
two stakes with yellow ribbons, and traveling upstream to point 07-1423(b) (35°, 16', 33.47" North, 7 7°,
37', 23.96" West), marked on the ground with wooden stake and yellow ribbon, is Subject to the Neuse
Riparian Buffer Rules. Starting at point 07-1423(b) and traveling 600 feet upstream to point 07-1423(a),
as marked on the attached map, is also Subject to the Neuse Riparian Buffer Rules.
This stream and its associated buffers should be identified on any future plans for this property. The
owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any
future correspondences concerning this property. This on-site determination shall expire five (5) year:
from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local
Authority that a surface water exists and that it is subject to the buffer rule may request a determination
by the Director. A request for a determination by the Director shall be referred to the Director in writing
c/o John Dorney, DWQ Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. Individuals
that dispute a determination by the DWQ or Delegated Local Authority that "exempts" a surface water
from the buffer rule may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. Applicants are hereby notified that the 60 -day statutory appeal time does not start
until the affected party (including downstream and adjacent landowners) is notified of this decision.
DWQ recommends that the applicant conduct this notification in order to be certain that third party
appeals are made in a timely manner. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings. 6714 Mail
Service Center, Raleigh, N.C. 27699-6714. This determination is final and binding unless you ask for a
hearing within 60 days.

Block 18 The project includes the piping of a section of open channel on the
campus of the Caswell Center in Kinston, NC. A vicinity map is included
as Attachment 1. This permit application is for a section of channel
designated as a stream by NC DENR DWQ. The stream determination is
included as Attachment 2. The Caswell Center had previously purchased
a portion of the needed piping for the channel, however until this time,
funding had not been available for its installation and for the purchase of
all of the additional necessary materials to close a portion of the ditch.
The Caswell Center is a facility in Kinston, NC which provides services to
individuals with mental retardation. It was established in 1911 and opened
in 1914 to serve individuals and families in eastern North Carolina.
Information about the Caswell Center, its residents and its services are
included as Attachment 3.
The project is shown on drawings C2 and C3 which is included as
Attachment 4 along with construction details for the project. This section
of channel includes the installation of 336 LF of 60" RCP, 384 LF of 66"
RCP, 3 drop inlets and one junction box. The channel has been evaluated
by NCDENR DWQ and this section (Drawing C2 and C3) was identified as
a stream. Pictures of this section are included as Attachment 5.
• The construction sequence for piping the channels is as follows:
1. The channels will be cleaned out, removing all vegetation and the top
6-8 inches of sediment using an excavator and truck to remove the soil
and dispose of the excavated material.
2. Select fill will be placed in the channel to establish the slope and
foundation for the pipe using a front end loader.
3. The new piping and inlets will be installed using a backhoe, front end
loader and compaction equipment.
4. The remaining fill will be installed to bring the area to grade using front
end loader and trucks to haul the soil.
5. The area disturbed will be graded and seeded.
Block 19 - The project was originally identified by the Owner as a need to remove a
safety hazard on the Caswell Center campus. Several years ago a
resident fell into the ditch and drowned and since that time the Center has
been attempting to get the project of piping the channels funded. Also
identified during this time was the degradation of the channel as it has
continued to erode and widen, causing the headwall at the west end of the
channel to begin to collapse. The piping of the ditch will stop the erosion
• and widening of the channel and takes away the safety hazard on the
campus.

The project site was evaluated for impacts to federally listed species or
historical sites. A listing of all species for Lenoir County is included for
reference as Attachment 6. There are no historical sites within the project
area. A listing of all historical properties in the area is included for
reference as Attachment 7. There is an existing graveyard on the Caswell
Center property but there will be no impact from this project.
Maps indicating the zoning and the type of soils are included as
Attachment 8.
The project site is located in Zone X according to the Flood Insurance
Rate Map. Zone X are areas determined to be outside of the 0.2% annual
chance floodplain. This map is included as Attachment 9.
Portions of the USGS topographic maps are included and show that this
channel is an unnamed tributary to the Neuse River.
For this project the following permits will be required:
NC DENR Land Quality — Erosion and Sedimentation Control Permit
NC DENR Division of Water Quality - Riparian Buffer Impact Permit
US Army Corps of Engineers — Individual Permit
Block 20 As noted above, the reasons for the discharge include resolution of a
safety issue, channel degradation and continued erosion of the banks of
the channel. Alternatives to filling the channel were also evaluated.
Alternatives for the proposed project include doing nothing, stabilization of
the channel and piping the channel. The option of doing nothing will allow
the channel to continue to erode and deepen and it will continue to be a
safety hazard for the residents of the campus.
Stabilization of the channel would require removal of the existing
vegetation and failing headwall and rebuilding the slopes, installing riprap
or slope stabilization fabric and constructing a new headwall at the west
end of the channel. The channel would also need to be filled to the
existing elevations of the pipes. The cost of stabilization of the channel
would be approximately $85,000 and would require regular maintenance
to maintain the channel. Stabilizing the channel would provide a
temporary solution to the erosion and widening of the channel but the
channel would continue to deepen and the safety hazard would remain.
Piping the channel would remove the safety hazard, stop the erosion,
deepening and widening of the channel and would maintain the hydraulic
S flow of the channel. The cost of piping the channel is estimated to be
$180,000. While the initial cost of the project is more for piping, the cost

of continued maintenance and the removal of a safety issue for the
residents of the Caswell Center, make piping the channel the better
alternative.

On October 19, 2005 at your request, I conducted an on-site determination to review two feature located
on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The property
is located north of Business Hwy 70 (Vernon Ave.) and east of SR 1557 (Hull Road) near the Vernon
Park Mall in Kinston, NC. The features are labeled as ".A" and "B" on the attached map initialed by me
on 10/21/05.
The Division of Water Quality (DWQ) has determined that the surface water labeled as "A" on the
attached map is Exemut of the Neuse Buffer Rule. Feature "B" has a 700 linear foot portion that is
not culverted on the subject property. This section is Subiect to the Neuse Buffer Rule. These
features should be identified on any future plans for this property. The owner (or future owners) should
notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning
this property. This determination pertains to the subject property off. This on-site determination shall
expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local
Authority that a surface water exists and that it is subject to the buffer rule may request a determination
by the Director. A request for a determination by the Director shall be referred to the Director in writing
c/o Cyndi Karoly, DWQ Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. Individuals
that dispute a determination by the DWQ or Delegated Local Authority that "exempts" a surface water
from the buffer rule may ask for an adjudicatory hearing. You must act within 60 days ofthe date that
you receive this letter. Applicants are hereby notified that the 60 -day statutory appeal time does not start
until the affected party (including downstream and adjacent landowners) is notified of this decision.

on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The feature is
labeled as "07-1423(a), 07-1423(b), and 07-1423(c)" on the attached maps initialed by me on August 20,
2007.
The Division of Water Quality (DWQ) has determined that the feature labeled as "07-1423 (a), 07-
1423(b), and 07-1423(c) marked in red" on the attached map are Subject to the Neuse Buffer Rule.
Starting at point 07-1423(c) (35°, 16', 26.76" North, 77°, 32', 23.47" West), marked on the ground bN-
two stakes with yellow ribbons, and traveling upstream to point 07-1423(b) (35°, 16', 33.47" North, 77°,
37', 23.96" West), marked on the ground with wooden stake and yellow ribbon, is Subject to the Neuse
Riparian Buffer Rules. Starting at point 07-1423(b) and traveling 600 feet upstream to point 07-1423(a),
as marked on the attached map, is also Subject to the Neuse Riparian Buffer Rules.
This stream and its associated buffers should be identified on any future plans for this property. The

Caswell Center has provided nearly 100 years of service to the citizens of
North Carolina. Established in 1911, and opened in 1914, the Center is.
pleased with its track record in the provision of quality services to indi-
viduals with mental retardation and to their families who reside within the
Eastern Region of the NC Division of Mental Health, Developmental Dis-
abilities and Substance Abuse Services. During fiscal year 2004-2005,
the Center will serve approximately 450 individuals in residence. in addi-
tion, it will deliver support services to individuals who are discharged to
lesser restrictive settings in the community.
The Center's 1,700 employees are dedicated to providing a support envi-
ronment in which all individuals served are afforded maximum opportuni-

The North Carolina State Historic Preservation Office examined the Neuse River near Kinston and identified
Civil War period obstructions and a riverboat landing, 1982-1985. In addition, the Historic Preservation
Office statewide inventory contains information on 250 prehistoric and historic archaeological sites in Lenoir
County.
ARCHITECTURAL SURVEY
A countywide architectural survey has been completed, and survey work within Kinston has been undertaken
in stages over a period of years. Surveys are cooperative local -state projects accomplished with grants and
staff assistance from the Historic Preservation Office.
GRANTS
State grants of $337,500 have assisted such projects as the restorations of Harmony Hall, the Archbell House,
• Adkins High School, and the former Kinston post office and fire station. Federal grants of $40,613 have
assisted architectural surveys in Kinston and Lenoir County, a historic district National Register nomination
in LaGrange, and preparation of a county survey manuscript for publication. In 1998, the Historic
Preservation Office awarded a federal grant for preparation of the LaGrange Historic District National
Register nomination.
NATIONAL REGISTER OF HISTORIC PLACES
Four National Register historic districts are in Kinston, and seventeen individual listings are located across
the county.
LOCAL PRESERVATION COMMISSIONS
Kinston is a Certified Local Government and has established a historic district commission. The
Mitchelltown Historic District has been locally designated.
PRESERVATION TAX CREDITS
Four income-producing tax credit projects have been completed in Lenoir County at a total construction
investment of $752,700 including the Hotel Kinston; two additional projects are currently undergoing
renovation, including the former Grainger High School in Kinston. The Historic Preservation Office reviews
and provides restoration technical services for all preservation tax credit projects.
• PUBLIC EDUCATION AND PUBLICATIONS
With grant and staff assistance from the Historic Preservation Office, the results of the Kinston and Lenoir
County surveys were published in 1998 as Coastal Plain and Fancy: The Historic Architecture of Lenoir
County and Kinston, North Carolina, by M. Ruth Little.

RESTORATION
The Historic Preservation Office has provided technical assistance in the renovation and restoration of
numerous properties including Harmony Hall, Grainger High School, the Pratt Building, the Archbell House,
the former First Citizens Bank Building, Adkin High School Gymnasium, and the Sumrell and McKoy
Building.
