The project does not result in permanent impacts and is not located within a state buffered basin, and therefore does not require written authorization from NCDWR. However, this is a municipal project, and as such, we would like to request for our files, an email from the NC DWR documenting that written authorization is not required for the proposed project. The proposed project is located in the City of Sanford, Lee County, North Carolina. The proposed sewer alignment crosses Gum Fork and five associated tributaries, which are located within the Cape Fear River Basin (HUC 03030004). The Water Quality Classification for Gum Fork is WS -IV, and the Stream Index Number is 18-4-7-2. Project Purpose The purpose of the proposed project is to expand the City of Sanford sewer collection system to provide sewer service to the Sanford Industrial Park, a 225 -acre commercial/industrial business park currently being developed along and near Clyde Rhyne Rd in Sanford, NC. Proposed Project The proposed project consists of the construction of three 8" DIP gravity sewer collection lines (±3,073 If total), all originating near Clyde Rhyne Rd. These three collection lines will follow topography south and tie to a proposed 12" DIP gravity sewer interceptor line (±5,426 If total) running parallel to Gum Fork. The proposed 12" interceptor line will then connect to an existing 12" DI P gravity sewer interceptor line which extends from US Hwy 1 to an existing pump station located east of Colon Road. Project History Tracts within the proposed Sanford Industrial Park were delineated by Soil & Environmental Consultants in 2016. Onsite streams and wetlands within these tracts were confirmed in the field by Andy Williams with the USACE in August 2016, and incorporated into the delineation for the proposed utility review area. Streams and wetlands within the proposed sewer construction/maintenance corridor not included in the S&EC delineation were delineated by WithersRavenel in August 2016. A Preliminary Jurisdictional Determination, including data forms in support of the delineation, were submitted to USACE August 30, 2016. At the time of this submittal, the Preliminary JD has not been received. A copy of the PJD request is included with this submittal, and approval of the delineation is requested concurrent with the approval of the NWP12. Proposed Impacts The proposed impacts consist of 442 If of temporary impacts for 9 stream crossing required for construction of the proposed utility. Three of the proposed crossings are aerial crossings with no intended impacts to the stream (Impacts #2, #6 and #7, see attached impact maps). Temporary stream impacts have been assessed for the aerial crossings to allow for potential unanticipated disturbance during construction activities. However, efforts will be made to avoid any temporary disturbance during construction through use of temporary bridges for construction equipment to cross the streams. During construction, appropriate measures will be taken to maintain normal downstream flows and minimize flooding to the maximum extent practical. Upon completion of construction of the proposed sewer utility, all temporary fills will be removed, and the affected areas returned to pre - construction elevations, and revegetated as appropriate. All construction activities will be conducted under an approved Erosion and Sedimentation Control Plan, where required. Avoidance and Minimization Prior to final design of the proposed sewer alignment, a detailed wetland and stream delineation was completed for an approximate 100' wide corridor, allowing impacts to wetlands and waters to be minimized. A preliminary review of the results of the delineation was conducted with the project engineers to identify environmental constraints (i.e. wetlands & streams) and site constraints, including topography, existing easements, and prior constructed portions of the proposed final collection system. The location of the existing sewer interceptor line dictated the eastern terminus of the proposed 12" interceptor line. The proposed stream crossings were minimized by designing the sewer alignment to cross streams at the narrowest location and at perpendicular angles, where practical, while maintaining topographic requirements for gravity function. Wetland impacts were avoided entirely throughout the proposed alignment. Permanent stream impacts were avoided by eliminating permanent stream crossings (i.e. rip -rap or filled crossings) for the maintenance corridor. Mitigation Since the proposed impacts for construction of the sewer line are temporary, no mitigation is proposed for these impacts. In addition, there are no wetlands within the proposed construction or maintenance corridors, and there will be no conversion of forested wetlands to herbaceous wetlands resultingfrom the construction of the utility. The current request is for 442 linear feet of temporary stream impacts (see attached maps and PCN for details). Thank you for your consideration of this request. It can be reasonably expected that future development will occur within the Industrial Park; however, future development will be required to meet federal, state, and local regulations, which will prevent impacts to downstream water quality. 4. Sewage Disposal (DWQ Requirement) 4a. Clearly detail the ultimate treatment methods and disposition (non -discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. Potential habitat for the northern Long-eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used for roosting during the day. The proposed project area contains forested areas with trees over 3" DBH, and therefore is considered potential northern long eared bat habitat. The USFWS Final 4(d) rule for the Northern Long -Eared bat specifies that tree removal within the White Nose Syndrome (WNS) Zone is not prohibited as long as it occurs more than 0.25 miles from known hibernacula and does not result in destroying known occupied maternity roost trees, or any other trees within a 150 ft -radius from the maternity tree, during the pup season (June 1 — July 31). The proposed project is not located within 0.25 miles of any known hibernacula, nor is there any known maternity roost trees present on the project. Additionally, clearing of mature forest between June 1St and July 31St is not anticipated for construction of the proposed project. Therefore, WR concludes that the project "may affect, but is not likely to adversely affect" the northern long- eared bat. 6. Essential Fish Habitat (Corps Requirement) 6a.
