8. PROJECT SUMMARY:
The project is being proposed as a major modification to Major Permit #51-09. The project
area is locally referred to as "The Circle" and has historically been the cornerstone of
tourism in Atlantic Beach. This area has undergone major reconstruction within the past
several years and the developer is proposing mixed use development within this area of
"The Circle". The existing major permit was originally permitted for condominium/retail
development at 115-127 Atlantic Blvd and was modified on 8/19/13 for downgrading,
material changes, and renaming the previously permitted buildings on tract 2. A second
modification was issued on 12/6/13 for the addition of spas, pools and decking for the
previously permitted 7 oceanfront lots. The applicant is proposing a similar development
along 115 Atlantic Blvd.
9. Narrative Description
The FMB at the Grove, LLC project is located at 115 Atlantic Blvd within "The Circle"
area of Atlantic Beach adjacent to the Atlantic Ocean. Tract 2 is bordered by single-family
homes and commercial buildings to the west and commercial building to the east.
The property is 72,914.95 square feet (1.7 acres) in its entirety, has a shoreline length of
420' and is an average of 7' above NHW however only 38,347.42 sf would be utilized.
Presently Tract 2 has an existing asphalt parking lot, gazebo, walkways and an old
concrete building pad. The site contains sparse patches of lawn grasses and shrubs. The
property is also void of coastal wetlands and 404 jurisdictional wetlands.
The waters of the Atlantic Ocean are classified as SB and are open to the taking of
shellfish. Atlantic Beaches' Land Use Plan classifies this area as commercial with all
AEC's classified conservation. The substrate in this area is large coarse grained sand
typical of oceans and inlets. This area has strong tidal currents and shifting sands. The
property is located within the Ocean Erodible AEC and is located in Zone VE on the
FEMA Flood Insurance Rate Map.
The long-term annual erosion rate of the property is 2.0 feet per year. The 100 -year storm
recession line for this area of Atlantic Beach is 40 feet, creating a total Ocean Erodible
Area of 160 feet. It has been determined that the existing seawall, which is located
adjacent (south) to Tract 2, is a "static vegetation line" that was determined prior to the
implementation of the current Ocean Hazard setback rules. The "static vegetation line"
was approved as part of the Brandt Island pump -out project for which the Town of
Atlantic Beach was the sand recipient and within the boundaries of a largescale beach fill
project. The existing sea-wall is the measurement line from which the total Ocean Erodible
Area (160') is measured from.
10. Project Description:
The project is located along Atlantic Blvd., adjacent to the Atlantic Ocean, in Atlantic
Beach, Carteret County. The CAMA Major Permit # 51-09 was issued on 9/28/2009, and
authorized condominium and retail development, as well as amenities along 115-127
Atlantic Blvd.

The project area can be located by turning off of Highway 70 East in Morehead City
(Arendell Street) onto the on-ramp for Atlantic Beach. Follow the Atlantic Beach
Causeway to the four-way stop light intersection and continue straight thru. The project
site is to the east of the public parking/access area. Tract 2 is bordered on the east by a
business known as "The Tackle Box"..
The applicant's proposal is a development plan along 115 Atlantic Blvd. There are 4 lots
proposed on Tract 2, a commercial building (restaurant), 2 -story retail building (workout
facility), pool, pool building, parking spaces, festival area and 4 -single family homes with
pools and decks. The total land area combined is 72,914.95 square feet (1.7 acres). The
applicant states that this is a Re -development and would be issued an exclusion for a
stormwater permit. A modification to the current stormwater permit was submitted for
review on 12/2/16 (SW8 080928).
According to the applicant, the proposal to construct the mixed-use development would
result in a density of 17.4 units per acre and the total percentage of impervious coverage
for the entire tract would be 52.93%. The proposed method of sewage disposal would be
gravity flow to the existing sewer network that leads to the waste water treatment plant for
"The Grove". The drinking water supply source would be the Town of Atlantic Beach
Public Water Supply. Due to the history of stormwater flooding in this area, the applicant
proposes to drain all roof discharges toward the south, away from the street.
The four 2 -story residential homes proposed on Tract 2 would measure 25' x 40' (1,000 sf
building footprint) with 10' x 20' decks, start from the Ocean Hazard Static Vegetation
Line (60' setback) and would be a total roof height of 40' above mean sea level. They
would also have individual spas and pools located seaward of the Ocean hazard Static
Vegetation Line 60' setback but landward of the existing seawall (OH Static Veg. Line).
The decking for the pool/spa areas would be 500 square feet or less (344sf total) and
unenclosed. Each home would also have two parking spaces located below the pile
supported foundations.
The second portion of development for Tract 2 would be the construction of a festival area.
This area would measure 60' x 99' and would be located east of lots 1 and 2 and west of
lots 3 and 4. There is no impervious surface proposed within this area. There would also
be a pool (35' x 60' area which includes decking for the pool apron) located to the north of
the festival area (Springhill amenity). There would be wooden decking that completely
surrounds the (Springhill) pool as well as the proposed restaurant to the north. There are
also two decks (cosmetically attached) proposed north of the pool. One would be 3,560 sf
(structurally independent) with the other one at.2,700 sf which would comply with the 60'
Ocean Hazard Setback for structures 5,000 sf or less. The festival area begins at
approximately 17' from the existing seawall with all portions of the pool and wood
decking beginning 60' landward of the Ocean Hazard Static Vegetation Line (existing
seawall).
The final phase for Tract 2 would be the construction of the mixed use buildings located
along the north (Atlantic Blvd) side of the property. This phase of the proposal would
consist of a one-story building (restaurant) with a building footprint of 40' x 70' and
would be 30' above MSL. The majority of the building is located outside of the total AEC

Area (160' from Ocean Hazard Static Vegetation Line {the existing seawall)) with the
exception of a 5' x 70' portion (south side of the proposed restaurant).
There are a total of 8 pervious paver parking spaces proposed along the west side and east
side of the restaurant building. They would be located a distance of 140' landward from
the existing seawall. There would also be a 2- story commercial/retail building (fitness
center) located on the northeast side of the property. It would have a footprint of 29' x 32'
and have a maximum height of 45' msl and located 160' from the existing seawall. The
final building proposed is the pool building on the north west side of the property. It would
have a building footprint of 14.68' x 27' and would be accessed by a ramp (see plans). The
building would be located a distance of 160' from the existing seawall and located outside
of the 160' total AEC area.
11. Anticipated Impacts:
Grading, filling and development of the properties would result in the disturbance of
approximately 72,914.95ft2 (1.7 acres) of high ground. The development would result in
52.93 % of impervious coverage for the entire tract. This area of Atlantic Beach is subject
to local stormwater drainage flooding and any new or net increase in impervious coverage
could contribute to the cumulative effect of ponding and additional drainage discharge. The
applicant does address this through grading, innovative stormwater design and permeable
materials. This project modification would develop four swimming pools, 1,376 sf of
wooden uncovered decks waterward of the Ocean Hazard Setback line but would be
consistent with the Coastal Resource Commission rules

The Grove Oceanside is a redevelopment project located on the ocean front at the
Atlantic Beach Circle in Atlantic Beach, North Carolina. These two oceanfront parcels
have been previously developed and are being revitalized to attract visitors to the Crystal
Coast. These two tracts comprise of 1.67 acres and are owned by FMB at the Grove,
LLC.
The first line of stable vegetation was determined by the LPO of Atlantic Beach
and has been noted as the existing wall as shown on the plans. The project is permitted
for seven single family residences and six commercial buildings. This modification
request is for the development on Tract 2. It is now proposed as four single family lots
and three commercial buildings with a pool. The residential buildings will meet the
requirements to be constructed within the 60' small structure setback, while the
commercial buildings fall within the 120' large structure setback requirements. The
development will be serviced by the Town of Atlantic Beach for domestic water. Sewer
services are to be provided for all uses and gravity flow to a permitted off-site private
waste water treatment facility.
The redevelopment consists of mixed single family residential and commercial
uses, including a restaurant and pool, The single family residential structures on Tract 1
will be three -stories and these lots have been platted and several already constructed,
including the parking and drive. On Tract 2, the commercial buildings will be pile
supported with finished floor elevation meeting FEMA regulation. The buildings will be
accessed via ramp or stairs to open decking. The four single family structures will be
similar to those on Tract 1.

The two tracts were submitted to DWQ-Surface Water Protection Section for
review under the current redevelopment rules. Staff reviewed the plans and confirmed
that this redevelopment is "excluded" from State Stormwater permitting requirements. A
modification to Project Number SW8 080928 was submitted for express review
December 2, 2016. The existing development provides sheet flow as the only stormwater
measure, while the proposed plan provides an additional measure, pervious pavement, to
meet pre-existing impervious areas and improve water quality.
The proposed redevelopment impervious surfaces do not exceed the existing
impervious amount of 40,120.50 square feet. Pervious pavement is proposed within the
two parking areas on Tract 2. Please see the table below for existing and proposed
impervious allocations.
