On behalf of TAC Buckhorn, LLC, we are requesting authorization from the USACE to use NWP 29
for 0.483 acres of permanent wetland impacts, 0.112 acres of temporary wetland impacts, 200 If of
permanent stream impacts and 42 If of temporary stream impacts for construction of the proposed
project. We are also requesting a 401 WQC from NCDWR for the above referenced impacts.
The project is ±121 acres in size and is located at 2301 Richardson Road in Apex, Wake County
(Latitude: 35.715902°N; Longitude: -78.923023°W). The project is located in the Cape Fear River
basin and onsite waters drain to Beaver Creek. The Water Quality Classification for Beaver Creek
is WS -V; NSW and the Stream Index Number is: 16-41-10-(0.5). The cataloging unit for the site is
03030002.
Proposed Project
The purpose of the proposed project is to construct a 344 lot single family residential subdivision in
order to meet the existing demand for residential housing in Apex. The proposed project consists
of the construction of 344 lots, internal roads, utilities, stormwater management and greenway
trail.
Project History
Onsite wetlands were delineated by WithersRavenel in May 2016, and the Corps of Engineers
issued a Jurisdictional Determination (SAW -2016-01065) for the project site on 07/22/16. A copy
of the JD has been provided as an Appendix.
The Town of Apex issued a Buffer Determination (Apex #16-003) on 05/16/16 for the project area.
A copy of the Buffer Determination Letter has been provided as an Appendix.
The project was submitted to NC SHPO in 2016 for review and comment. In a letter dated
05/19/16, SHPO specified that the proposed project will not impact any known historic resources,
and they had no further comment on the project. A copy of the SHPO letter has been provided as
an Appendix.

The proposed impacts consist of 0.483 acres of permanent wetland impacts, 0.112 acres of
temporary wetland impacts, 200 If of permanent stream impacts and 42 If of temporary stream
impacts.
Construction of internal roads will result in 0.375 acres of permanent wetland impacts (Impacts 1,
5, 12, & 16) and 200 If of permanent stream impacts (Impacts 6 & 7). While impact #1 appears to be
partially from lot construction, the entire 0.220 acres of permanent impacts occur as a result of
construction of roads R010 and R011. In the event that the adjacent lots were never constructed,
the fill and backslopes for construction of R010 and R011 would result in the permanent fill of the
0.220 acres of impacts identified as Impact #1. Construction of the stream crossing associated with
Milano Avenue will require 200 If of permanent stream impacts (Impacts 6 & 7). The installation of
the twin 141 -foot long, 54" RCP and plunge pool will result in 190 If of permanent stream impacts
(Impact 6). The installation of the rip -rap dissipator below the plunge pool will result in 10 If of
permanent stream impacts (Impact 7), and is a required sediment and erosion control measure to
prevent downstream erosion. The rip -rap dissipator has been designed so that the rip -rap will be
buried such that the top of the rip -rap matches the pre -construction elevation of the stream bed.
This design allows for the temporary stream impact areas to continue functioning as a natural
stream by maintaining natural water depths and allowing for passage of aquatic life.
Construction of retaining walls to stabilize lot fill and minimize wetland impacts will result in 0.013
acres of permanent wetland impacts (Impact 2) and 0.03 acres of temporary wetland impacts
(Impact 11). Impact 2 (0.013 acres - Permanent) is necessary in order to construct the retaining
wall and grade behind the wall for structural integrity, as well as to provide a maintenance area
behind the wall. Impact 11(0.03 acres - Temporary) will result from temporary disturbance of the
wetlands during construction. However, there is sufficient clearance between the wetlands and the
wall that permanent impacts are not necessary for the grading to stabilize the wall.
The construction of Lots 393, 394, 435 & 436 will result in 0.09 acres of permanent wetland impacts
(Impacts 8 & 15).
The construction of a greenway trail will result in 0.005 acres or permanent wetland impacts
(Impact 9).
The installation of the internal sewer line will result in 0.082 acres of temporary wetland impacts
(Impacts 4, 10, 13 & 14) and 42 If of temporary stream impacts (Impact 3). Please note that the
sewer lines within wetlands will be mowed/maintained in perpetuity, resulting in 0.082 acres of
permanent wetland conversion impacts.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and "waters" could be minimized. Proposed permanent impacts have
been minimized to only those impacts necessary to construct internal roads, four lots, retaining
walls and a greenway crossing. Stream impacts have been minimized to only one road crossing for

Milano Avenue and utilizing pedestrian bridges for greenway stream crossings. Also, elevated
boardwalks for the greenway and retaining walls to stabilize lot fill have been utilized to further
minimize wetland impacts.
The proposed site design has gone through several design modifications in order to minimize
wetland and stream impacts. The original site design, dated 05/18/16 (see Appendix), proposed a
total of 350 lots. The 05/18/16 site design would have resulted in ±1.3 acres of permanent wetland
impacts, 200 If of permanent stream impacts and ±1.29 acres of jurisdictional surface water (pond)
impacts, which would have required an Individual Permit. The proposed site design proposes 344
lots and will require 0.483 acres of permanent wetland impacts, 200 If of permanent stream impacts
and no jurisdictional surface water impacts. The proposed site plan represents the minimization of
0.817 acres of permanent wetland impacts and 1.29 acres of jurisdictional surface water (pond)
impacts, which makes the project eligible for a Nationwide Permit 29. The minimization of 2.107
total acres of impacts to jurisdictional features through design revisions resulted in the loss of six
lots.
The Town of Apex is requiring offsite road improvements which include widening of Richardson
Road along the entire frontage. Additionally, the Town is requiring that Milano Avenue be
constructed as a major collector road, which results in Milano Avenue being 15' widerthan a typical
residential road. These improvements result in a significant financial burden on the project, as these
improvements do not directly benefit the proposed development. The substantial costs associated
with the improvements to Richardson Road and construction of Milano Avenue as a major collector
road must be absorbed into the overall construction costs for the development, with no financial
return.
The proposed 344 lots represents the minimum number of lots necessary to be able to offset land
purchase costs, construction costs and offsite road improvement costs, while still having a feasible
project. As previously discussed, design revisions for avoidance and minimization of impacts
resulted in a reduction from 350 lots to 344, which is a loss of 6 lots. Wetland impacts for
construction of Lots 393 & 394 (Impact 16) will occur to Wetland Y, which is a very small wetland
(±0.10 ac), which is isolated within the landscape. Approximately half of Wetland Ywill be impacted
by construction of road R006, which will further reduce the size of Wetland Y. Even if the remnant
portion of Wetland Y was not impacted, the integrity and long term viability of a ±0.057 acre
wetland pocket could not be maintained. Once surrounded by development, the drainage area
would be eliminated, and the stormwater management system would direct all runoff away from
the wetland, ultimately removing the source of hydrology, and Wetland Y would cease to be a
wetland. Since the longterm viability of Wetland Y could not be sustained in the post -development
condition, and the project requires 344 lots to be feasible, it was determined that the functional
value of Wetland Y would be better served in a regionally significant mitigation bank and should be
impacted for construction of Lots 393 & 394. The construction of Lots 435 & 436 wi II result in 0.033
acres of permanent wetland impacts (Impact 8) for lot fill and backslopes to return lot fill to natural
grade. A retaining wall was not feasible due to construction and future maintenance of the adjacent
greenway bridge over the wetlands.
Road crossings for Milano Avenue and Road R001 have been designed to cross the stream and
wetlands as close to perpendicular as possible. Additionally, the alignment of road R011 was

constrained by the designated location for the connection to Richardson Road, which must align
with the approved alignment for McCrory Way within the future McKenzie Ridge development to
the west.
Impacts from greenway trails have been minimized to only 0.005 acres of permanent wetland
impacts (Impact 9). Previous designs for the greenway proposed permanent impacts for all wetland
and stream crossings, which would have resulted in ±0.2 acres of permanent wetland impacts and
47 If of permanent stream impacts. The greenway design was revised to move the greenway out of
the wetlands where possible and utilize elevated pedestrian boardwalks/bridges to avoid impacts
at wetland and stream crossings. The only proposed permanent wetland impact for construction of
the greenway will occur at Impact 9 (0.005 acres). Due to the topography in this area, even if the
greenway crossing would have been proposed to be bridged crossing, the backslopes from the fill
for Lot 264 would have extended into the wetlands. Even if an elevated boardwalk was proposed
to cross the wetlands, there would still be permanent wetland impacts from fill for Lot 264.
The rip -rap dissipater below the culverts under Milano Avenue has been designed such that the rip -
rap will be installed so that the top of the rip -rap matches the pre -construction elevation of the
stream bed. This design allows for the section of stream to be stabilized with rip -rap to continue
functioning as a natural stream by maintaining natural water depths and allowing for passage of
aquatic life, and therefore there will not be a loss of function.
Mitigation
Stream Mitigation
The applicant proposes to mitigate for the 190 If of permanent stream impacts at 2:1 ratio by
purchasing a total of 380 If of stream mitigation credits. Please note that mitigation is not proposed
for the 10 If of permanent stream impacts from construction of the rip -rap dissipater (Impact 7), as
there will not be a loss of stream function. WR contacted mitigation banks within the Cape Fear
03030002 basin, and there were no available stream mitigation credits available. Therefore, the
applicant will provide the 380 If of stream mitigation through the purchase of ILF credits from
NCDMS. A copy of the NCDMS Letter of Acceptance has been provided as an Appendix. Please
note that in the event that stream mitigation becomes available within a mitigation bank prior to
issuance of the permits, a revision to the mitigation proposal will be submitted proposing to
purchase the credits from a private mitigation bank.
Wetland Mitigation
The applicant proposes to mitigate for the 0.483 acres of permanent wetland impacts at a 2:1
mitigation ratio by purchasing 0.97 acres of riparian wetland mitigation credits. WR contacted
mitigation banks within the Cape Fear 03030002 basin and there were no available riparian
wetland credits available. Therefore, the applicant will provide the 0.97 acres of riparian wetland
mitigation through the purchase of ILF credits from NCDMS. A copy of the NCDMS Letter of
Acceptance has been provided as an Appendix. Please note that in the event that stream mitigation
becomes available within a mitigation bank prior to issuance of the permits, a revision to the

mitigation proposal will be submitted proposing to purchase the credits from a private mitigation
bank.
Stormwater Management Plan
The stormwater management plan consists of a combination of wet ponds, bio -retention and
constructed wetlands. The Stormwater management plan and diffuse flow requirements will be
reviewed and approved by the Town of Apex as the certified local government.
The current request is for 0.483 acres of permanent wetland impacts, 0.112 acres of temporary
wetland impacts, 200 If of permanent stream impacts and 42 If of temporary stream impacts (see
the attached maps and PCN for details).

1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands
and "waters" could be minimized. Proposed permanent impacts have been minimized to only those impacts necessary to
construct internal roads, four lots, retaining walls and a greenway crossing. Stream impacts have been minimized to only one
road crossing for Milano Avenue and utilizing pedestrian bridges for greenway stream crossings. Also, elevated boardwalks
for the greenway and retaining walls to stabilize lot fill have been utilized to further minimize wetland impacts.
The proposed site design has gone through several design modifications in order to minimize wetland and stream impacts.
The original site design, dated 05/18/16 (see Appendix), proposed a total of 350 lots. The 05/18/16 site design would have
resulted in ±1.3 acres of permanent wetland impacts, 200 If of permanent stream impacts and ±1.29 acres of jurisdictional
surface water (pond) impacts, which would have required an Individual Permit. The proposed site design proposes 344 lots
and will require 0.483 acres of permanent wetland impacts, 200 If of permanent stream impacts and no jurisdictional surface
water impacts. The proposed site plan represents the minimization of 0.817 acres of permanent wetland impacts and 1.29
acres of jurisdictional surface water (pond) impacts, which makes the project eligible for a Nationwide Permit 29. The
minimization of 2.107 total acres of impacts to jurisdictional features through design revisions resulted in the loss of six lots.
The Town of Apex is requiring offsite road improvements which include widening of Richardson Road along the entire
frontage. Additionally, the Town is requiring that Milano Avenue be constructed as a major collector road, which results in
Milano Avenue being 15' wider than a typical residential road. These improvements result in a significant financial burden on
the project, as these improvements do not directly benefit the proposed development. The substantial costs associated with
the improvements to Richardson Road and construction of Milano Avenue as a major collector road must be absorbed into the
overall construction costs for the development, with no financial return.
The proposed 344 lots represents the minimum number of lots necessary to be able to offset land purchase costs,
construction costs and offsite road improvement costs, while still having a feasible project. As previously discussed, design
revisions for avoidance and minimization of impacts resulted in a reduction from 350 lots to 344, which is a loss of 6 lots.
Wetland impacts for construction of Lots 393 & 394 (Impact 16) will occur to Wetland Y, which is a very small wetland (±0.10
ac), which is isolated within the landscape. Approximately half of Wetland Y will be impacted by construction of road R006,
which will further reduce the size of Wetland Y. Even if the remnant portion of Wetland Y was not impacted, the integrity and
long term viability of a ±0.057 acre wetland pocket could not be maintained. Once surrounded by development, the drainage
area would be eliminated, and the stormwater management system would direct all runoff away from the wetland, ultimately
removing the source of hydrology, and Wetland Y would cease to be a wetland. Since the long term viability of Wetland Y

could not be sustained in the post -development condition, and the project requires 344 lots to be feasible, it was determined
that the functional value of Wetland Y would be better served in a regionally significant mitigation bank and should be
impacted for construction of Lots 393 & 394. The construction of Lots 435 & 436 will result in 0.033 acres of permanent
wetland impacts (Impact 8) for lot fill and backslopes to return lot fill to natural grade. A retaining wall was not feasible due to
construction and future maintenance of the adjacent greenway bridge over the wetlands.
Road crossings for Milano Avenue and Road R001 have been designed to cross the stream and wetlands as close to
perpendicular as possible. Additionally, the alignment of road R011 was constrained by the designated location for the
connection to Richardson Road, which must align with the approved alignment for McCrory Way within the future McKenzie
Ridge development to the west.
Impacts from greenway trails have been minimized to only 0.005 acres of permanent wetland impacts (Impact 9). Previous
designs for the greenway proposed permanent impacts for all wetland and stream crossings, which would have resulted in
±0.2 acres of permanent wetland impacts and 47 If of permanent stream impacts. The greenway design was revised to move
the greenway out of the wetlands where possible and utilize elevated pedestrian boardwalks/bridges to avoid impacts at
wetland and stream crossings. The only proposed permanent wetland impact for construction of the greenway will occur at
Impact 9 (0.005 acres). Due to the topography in this area, even if the greenway crossing would have been proposed to be
bridged crossing, the backslopes from the fill for Lot 264 would have extended into the wetlands. Even if an elevated
boardwalk was proposed to cross the wetlands, there would still be permanent wetland impacts from fill for Lot 264.
The rip -rap dissipater below the culverts under Milano Avenue has been designed such that the rip -rap will be installed so that
the top of the rip -rap matches the pre -construction elevation of the stream bed. This design allows for the section of stream to
be stabilized with rip -rap to continue functioning as a natural stream by maintaining natural water depths and allowing for
passage of aquatic life, and therefore there will not be a loss of function.

Pedestrian bridges and elevated boardwalks will be utilized to minimize impacts to streams and wetlands for the greenway
trail. Retaining walls have been utilize to stabilize lot fill to minimize wetland impacts from lot construction. Silt fencing will be
installed around all disturbed areas to prevent sediment from escaping into adjacent wetlands and waters during construction.
Access during construction will be from high ground.

WR reviewed the NC Natural Heritage Program database, located at http://www.ncnhp.org/web/nhp/home to identify if
there were any known occurrences of endangered species on or near the proposed project. The review of the NHP data
did not identify any occurrences of federally listed threatened or endangered species or critical habitat on the subject
property or within 1.0 miles of the project, see attached NCNHP project review letter. Additionally, pedestrian surveys
were conducted for potential habitat for federally listed threatened and endangered species known to occur within Wake
County. The pedestrian surveys did not identify the presence of any federally listed threatened or endangered species
within the project boundaries. However, there is potential habitat for the Northern Long Eared Bat, and the absence of
bats could not be confirmed.
Potential habitat for the northern Long-eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used
for roosting during the day. The proposed project area contains forested areas with trees over 3" DBH, and therefore is
considered potential northern long eared bat habitat. The USFWS Final 4(d) rule for the Northern Long -Eared bat
specifies that tree removal within the White Nose Syndrome (WNS) Zone is not prohibited as long as it occurs more than
0.25 miles from known hibernacula and does not result in destroying known occupied maternity roost trees, or any other
trees within a 150 ft -radius from the maternity tree, during the pup season (June 1 — July 31). The proposed project is not
located within 0.25 miles of any known hibernacula, nor is there any known maternity roost trees present on the project.
Additionally, clearing of mature forest between June 1St and July 31St is not anticipated for construction of the proposed
project. Therefore, WR concludes that the project "may affect, but is not likely to adversely affect' the northern long-
eared bat.

1. The Corps of Engineers believes that there may be jurisdictional waters of the United States on the subject site, and the permit
applicant or other affected party who requested this preliminary JD is hereby advised of his or her option to request and obtain an
approved jurisdictional determination (JD) for that site. Nevertheless. the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or a Nationwide General Permit (NWP) or other
general permit verification requiring "pre -construction notification' (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an approved JD for the activity. the permit applicant is hereby

This on-site determination shall expire five (5) years from the date of this letter. Landowners or
affected parties that dispute a determination made by the Division of Water Quality (DWQ) or
Delegated Local Authority in the Jordan Lake watershed may request a determination by the
DWQ Director.
An appeal request must be made within sixty (60) days of date of this letter or from the date
the affected party (including downstream and/or adjacent owners) is notified of this letter. A
request for a determination by the Director shall be referred to the Director in writing c/o Ian
McMillan, DWQ Wetlands/401 Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650.
Otherwise the appeal procedure will be in accordance with LIDO Section 6.1.11.
If you dispute the Director's determination, you may file a petition for an administrative
hearing. You must file the petition with the Office of Administrative Hearings within sixty (60)
days of receipt of this notice of decision. A petition is considered filed when it is received in the
Office of Administrative Hearings during normal office hours. The Office of Administrative
Hearings accepts filings Monday through Friday between the hours of 8:OOam and S:OOpm,
except for official State holidays. To request a hearing, send the original and one (1) copy of the
petition to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-
6714. A copy of the petition must also be served to the Department of Natural Resources, c/o
Mary Penny Thompson, General Counsel, 1601 Mail Service Center, Raleigh, NC 27699-1601.
This determination is final and binding unless, as detailed above, you ask for a hearing or appeal

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the
table below. Please note that this decision does not assure that participation in the DMS in -lieu fee mitigation
program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility
of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must
also comply with all other state, federal or local government permits, regulations or authorizations associated with
the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit 401 Certification CAMA permit within this time frame, this
acceptance will expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS
receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and
payment must be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an
applicant is calculated based upon the Fee Schedule and policies listed at http://portal.ncdenr.org/web/eep.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
