One caveat. If there are significant concerns expressed by other Merger participants, following the memo referenced above, of which require a formal return to Merger, then any buffer impacts resulting from new stream impacts may be in play. As with other permitted projects within buffered basins that are exempt from Buffer Rules due to timing issues, Buffer Rules will apply, if for example, permit modifications are submitted that include new impacts that lay outside the original footprint of the project.
