Dear Mr. Harris: The Division of Water Resources has reviewed your submi[tal for a 401 Water Quality Certifica[ion and NEUSE BUFFER AUTHORIZATION for [he aforementioned projec[. Review of your application revealed i[ lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: The buffer lines were depicted incorzectly on the permit application plan sheets. Pursuant to SL2015-246, for the 20 coastal counties Zone I of the riparian buffer shall begin at the normal water level or normal high water Ievel, whichever is more restrictive. Zone I no longer begins at the landward limit of the coastal marsh. Please provide updated plan sheets with the correct buffer lines and the adjusted buffer impact rotals. The plan sheets show temporary surface wacer impacts in the channel undemeath the bridge alignment on Ihe east side of the crossing. Please explain the nature of these impacts. DW R prefers that bridge construction at this site be performed from the existing bridge where possible or temporary work bridge if necessary. The plan sheets show stormwater outfalls for the bridge deck runof'f on both the east and west sides. These discharge points need to be located outside Zone 2 of the adjusted buFfer. If the discharge points are not able to be located outside the riparian buffer, a variance will be required. Therefore, pursuant to ISA NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied the necessary in(ormation. You have 21 days to respond in writing with the requested informa[ion or notification to this oftice that the infonnation is forthcoming. If, at the end of the 21 days, this office has not received this infonnation in writing, we will assume you are withdrawin� your application and it will be retumed.
