To Mrs. Karoly and Mr. McMillan:
On behalf of the owner, Mrs. Rebecca Flowers of River Dell company, Inc., we hereby request
that you provide us additional time to respond to your letter dated June 16, 2008 (see attached).
Since this project is a request for an individual permit and individual certification and was put on
public notice, we feel it is important for the regulatory agencies, the applicant, the engineers
and the consultant to meet and discuss any questions or concerns that the agencies have, in
addition to any concerns that may have been brought to attention during the public comment
period. Therefore, a Post Public Notice Agency meeting has been scheduled for July 16,
2008. At this meeting, we anticipate to address and/or clarify the Division of Water Quality's
questions within the June 16th letter.
Please accept this letter as a request to the Division of Water Quality to not withdraw this
project from the 401 Certification Program and to allow an extension of our response time till
after the July 16, 2008 meeting, if this is not acceptable please let us know as soon as possible.

Dear Ms. Flowers: WETLANDS AND STORMWATER BRANCH
On May 1, 2008, the Division of Water Quality (DWQ) received your application dated April 28, 2008, to
fill or otherwise impact 0.127 acres of 404/wetland (0.122 acres permanent impact and 0.005 acres
temporary impact), 1,023 linear feet, permanent, important stream impact, 416 linear feet, permanent,
unimportant stream impact 220 linear feet, temporary stream impact, and 88,472 square feet of Zone 1
Neuse River basin protected riparian buffers and 43,718 square feet of Zone 2 Neuse River basin
protected riparian buffers to construct a mixed-use development. On May 30, 2008, the DWQ received
additional information from you, however, the DWQ has determined that your application remains
incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional
information in order to process your application to impact protected wetlands and/or streams on the
subject property. Therefore, unless we receive five copies of the additional information requested below,
we will place this project on hold as incomplete until we receive this additional information. If we do not
receive the requested information, your project will be formally returned as incomplete. Please provide
the following information so that we may continue to review your project.
Additional Information Requested:
Please provide intermittent/perennial stream determination documentation on the site (upstream
--and-downstream photos and DWQ stream identification forms).
2., Buffer mitigation is required for all road crossings that impact 150 linear feet of riparian buffer or
more. Please submit a mitigation plan detailing the amount of buffer impact at crossings 1 & 3
and how the impact will be mitigated.
3. Please provide documentation from the NCEEP indicating their willingness to accept your
request to purchase buffer mitigation credit to mitigate for the proposed crossings 1 & 3 buffer
impacts listed in your PCN application per section VIII, No. 2.

4. Please provide a more specific, detailed mechanism to assure DWQ that:
a.) All lots are buildable without additional wetland, stream or buffer impact, and
b.) That stormwater from the entire site will be treated since the site is in the Neuse basin
either through level spreaders for sites with low impervious coverage or other means for
higher impervious coverage
Please re-submit your site plans on full plan sheets at a scale of no smaller than 1"=50'.
6. Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage from this site
must meet the state's diffuse flow requirements as set forth in Chapter 8 of the North Carolina
Stormwater BMP Manual, available at: http://h2o.enr.state.ne.us/su/bmp forms.htm Please
provide one Level Spreader Supplement Form for each proposed level spreader, available at:
http•//l12o.enr,L.te.n°,.us/su/bmp forms.htm. Please include the Required Items checklist and all
items listed therein. If the filter strip is too steep for a level spreader in any location, then you
must provide a BNB P that removes a minimum of 85 percent TSS and 30 percent TN from the
stormwater generated by this project. For each proposed BMP, please provide a completed BMP
Supplement Fornt, with all the required items. The BMP Supplement Forms are also available at
the above web site.
7. Please provide a conceptual stormwater management plan for the project that includes the
following:
a.) A depiction of the drainage areas on the site.
b.) An estimation of the percentage imperviousness associated with each of the drainage
areas.
c.) A calculation of the water quality volume associated with each drainage area.
d.) A depiction of a proposed BMP (state the type of BMP you plan to use) on the site plan
that is correctly sized based on the water quality volume.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter, your project will be withdrawn
and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian McMillan at 919-733-
