Robb,

It is my understanding from our conversation that the permit processing clock for the 401 Water Quality Certification for
Sunset Cove will end prior to the anticipated receipt of federal review agency comments. If you go forward and issue the
401 certification without having the federal agency comments, depending on those comments you might need to re-
issue the certification. In that case, we would have to submit a separate full 401 application. Placing the 401 review on
hold until the federal comments are available would prevent the review clock from expiring and avoid the potential
requirement for preparing and submitting a separate application.

Please place processing of the Robin Comer Sunset Cove 401 certification on hold until you receive the federal review
comments.

Hey Kathy,

This follows our phone conversation this p.m. As discussed, through correspondence with Liz Hair with the USACE on
the status of this project, and due to when it will be sent out through their GP 291 process, our clock will end. Hence, it
would benefit the applicant to request that the 401 Certification application to be place on hold until the USACE receives
comments back from the federal review agencies.
