Attention Jeff Poupart:
The final 316(b) rule for existing facilities requires facilities that must submit reports under
§122.21(r)(10), §122.21(r)(11), and §122.21(r)(12) to conduct an external peer review of these
reports. The final rule, also, requires the applicant to select peer reviewers and notify the
Permitting Director in advance of the peer review process as stated in §122.21(r)(13).
"The applicant must select peer reviewers and notify the Director in advance of the
peer review. The Director may disapprove of a peer reviewer or require additional
peer reviewers."
Duke Energy has selected a team of peer reviewers with expertise in fisheries, economics, and
entrainment reduction technologies/cooling water systems. Duke Energy plans to utilize one peer
reviewer per discipline per facility. Unless the requirements of §122.21(r)(10), §122.21(r)(11),
and §122.21(r)(12) are waived, the following North Carolina facilities will be subject to the peer
review requirements:

— Belews Creek Steam Station — Marshall Steam Station
— McGuire Nuclear Station — Roxboro Steam Station
— Sutton Steam Station

Multiple peer reviewers have been selected and submitted to ensure adequate resources are
available to complete the peer review for the applicable stations in North Carolina and within the
allotted time. Duke Energy is expecting the reports for multiple stations will be in peer review
concurrently.

list of peer reviewers contained herein. As needs for additional peer reviewers are identified,
Duke Energy will provide additional notification to the Permitting Director.

In addition to these projects Ranney has completed, or have underway, we have assisted engineers and
owners on many other projects where we were not the contractor chosen to complete the work. We have
also bid on intake projects designed by others, on which we had no design input. Many times we were
not the low bidder on these projects. Sometimes we chose not to bid at all. The projects that we did not
build have also added to our experience in the design and construction of surface water intakes.
The Ranney Company began intake construction in the 1950s. Those intake screens were punched plate,
rolled into pipe and placed parallel to the flow of the river. We believe Ranney Company was a pioneer
in this type of intake construction. Ranney recognized the importance of low intake screen entrance
velocity for three reasons: hydraulic efficiency of the screen to reduce headloss to the pump suction;
exclusion of river biota from the system; reduce plugging of the intake screen due to debris impingement.
Low screen entrance velocity is now required by 316(b).

Biographical Sketch
Dr. Lupi is a Natural Resource and Environmental Economist and serves as the economist in
the Partnership for Ecosystem Research and Management (PERM), a collaborative effort
between scientists at MSU and resource management agencies in the Great Lakes region. His
expertise includes the econometrics, development and implementation of stated choice surveys,
and recreational demand analyses as well as the economics of the provision and valuation of
ecosystem services. Dr. Lupi has designed and implemented in-person, mail, telephone,
intercept/creel, and internet surveys ranging in sizes from a few hundred to 40,000
respondents. His applied research and publications address the economics and human
dimensions of recreational fisheries, wildlife management, forests, ecosystem services, invasive
species, water quality, and wetlands. He has served on numerous advisory and grant review
panels, including the National Research Council committee on Endangered and Threatened
Species of the Platte River.
