This assessment is based upon the following facts: a review has been conducted of the discharge monitoring report(DMR) submitted by Fletcher Academy Inc for the month of September 2015. This review has shown the subject facility to be in violation of the discharge limitations and/or monitoring requirements found in NPDES WW Permit No.NC0036641. The violations,which occurred in September 2015,are summarized in Attachment A to this letter. . Based upon the above facts,I conclude as a matter of law that Fletcher Academy Inc violated the terms, conditions or requirements of NPDES WW Permit No.NC0036641 and G.S. 143-215.1(a)(6) in the manner and extent shown in Attachment A. In accordance with the maximums established by G.S. 143-215.6A(a)(2),a civil penalty may be assessed against any person who violates the terms, conditions or requirements of a permit required by G.S. 143-215.1(a). Based upon the above findings of fact and conclusions of law, and in accordance with authority provided by the Secretary of the Department of Environmental Quality and the Director of the Division of Water Resources,I,G. We did experience a result that was greater than the permit discharge limits. Your permit has both a monthly maximum and a daily maximum. Your facility exceeded the permit discharge limits on the items listed below: BOD 23rd—50.6 mg/I 29.0 mg/1 monthly average This gave a daily maximum violation on one day and did not give a violation. We believe the cause of the violation was due to the lack of incoming food supply to the facility. We did have two weeks during the month that was below the 30.0 mg/1 BOD limit and the first samples of October are also below the permit limit. We believe that the facility is making a turn in the proper direction. We continue to strive for this goal. You may receive a monetary fine for this month. The NOV's are for a BOD and Fecal Coliform discharged from the lagoon during September 2015. This NOV was received by James & James on or about January 25, 2016. As you are aware,this facility is a fully functioning waste water system and is being operated in such a manner during the evaluation process of change. Operational changes are occurring on a methodical basis to ensure that whatever change does affect the system in a positive manner is obvious and understood. Since this is a 30 day lagoon, changes made to the influent do not reflect in the effluent until a month later. Therefore,changes have been slow and steady. Samples are being taken and have been for numerous months on a weekly basin to follow the progression of the wastewater throughout the facility. During the month of August, a review of the hospital was again conducted. The hospital was reminded not to allow any excessive amounts of needless water to run to the facility. A BOD sample was collected from the manhole at the hospital. The results were 369 mg/l. It was calculated that the hospital contributes 75% of the incoming flow to the lagoon. There are minimal live bacteria in the incoming water. We also collected COD samples from the lagoon at the different available discharge piping. It was determined that the best possible discharge point is Cell #3 at the pumping range of 2 foot. In the month of September and following,the BOD results were predominately lower so much that for the month of October, 2015 the facility averaged compliant. During the month of September, 2015, a repair was made to one of the manholes where both the hospital and academy join. In the month of November, 2015, Mike's Septic Tank Fletcher Academy NC0036641 Page 1 • Company was contracted to dredge Cell#3 of the sludge that had built up to attempt to reduce the BOD in the later cells. He also pumped the two settling tanks after the chlorine feed. Another sludge depth monitoring on the lagoon was conducted the beginning of December and an additional 10 loads was removed from the facility. As you can see from the above,methodical steps are being taken to continue to improve the effluent of the lagoon. Also as is evidenced by the BOD results,the process is working. The levels are lower than previous months. We continue to press to the goal of compliance. We would appreciate your consideration of fines. Thank you for your understanding.
