We regret to inform you that the Director has denied your request. Therefore, your outstanding balance ($600.00) is due and payable. Two options are available to you at this stage of the remission process: 1) You may pay this balance. Please be advised that the EMC's Committee on Civil Penalty Remissions will make its remission decision based on the original assessment amount. Therefore, the EMC may choose to uphold the original penalty and offer no remission, they may agree with the DWR Director's remission recommendation detailed above, or the penalty amount may be further remitted. Permittee: Aqua North Carolina, Inc. (Aqua) acknowledged that permit renewals required electronic Discharge Monitoring Reports (e -DMR) filing. Aqua asserts that they have been working with the administrator for electronic reporting since 2015. They asserted that they provided registration forms in September 2015 and August 2016 for their North Carolina facilities. Aqua is working on eDMR registration and updating ORC information. DWR Notes: The permit condition required that Aqua apply and begin submitting eDMRs for the subject facility no later than 10/29/2014. Aqua received a Notice of Deficiency (NOD) on March 18, 2015 and a Notice of Violation (NOV) on 09/10/2015. No response was received from Aqua in response to the NOD or the NOV for this facility. Aqua indicated that they attempted to register in September 2015, but the application was incomplete because Aqua was required to register for all of their permitted facilitates under their ownership. Additionally, Aqua neither requested an extension of any of their permit condition deadlines nor did they apply for a waiver. Since receiving NOVs in July 2016 for many of their permitted facilities, Aqua submitted registration for eDMR which was received on July 27, 2016 for all permitted facilities under their ownership. In making this request, I assert that I understand all of the following statements: This request will be reviewed by the Chairman of the Environmental Management Commission and may be either granted or denied. • Making a presentation will require the presence of myself and/or my representative during a Committee meeting held in Raleigh, North Carolina. • My presentation will be limited to discussion of issues and information submitted in my original remission request, and because no factual issues are in dispute, my presentation will be limited to five (5) minutes in length. If you are a corporation, partnership or municipality and are granted an opportunity to make an oral presentation before the Committee, then your representative must consider the recent State Bar's Opinion and could be considered practicing law without a license if he or she is not a licensed attorney. Aqua North Carolina, Inc. (Aqua) recognizes that ouk permit renewals required electronic Discharge Monitoring Reports (e -DMR) filing. Since 2015 Aqua has been working with the State's administrator to register our company in the state's database. In September 2015 and August 2016 Aqua provided registration forms for our North Carolina facilities.' Aqua continues to work diligently with the State's administrator to complete the registration process for the State's database allowing us to electronically file DMRs.
