Mr. Johnson:
Per our phone conversations on January 5th, this is our response letter to NC DWR's comment on the location of the proposed irrigation pump
within the Zone 1 Riparian Buffer. Originally we thought we were exempt per Catawba's Riparian Buffer Tables of Uses for a use of a pump for
agricultural irrigation in Zone 1, but we found out that is not case. You stated if Mallard Head Country Club (MHCC) Golf Course had a hardship by
relocating the pump outside of the Zone 1 buffer, we may qualify for a variance request.
After our discussion, I reviewed the option of placing the proposed pump outside of the Zone 1 buffer with MHCC. We identified the constraints of
the project, which we believe some of these could constitute a hardship.
The location of the proposed route and suction pipeline has been chosen based on the property owner and Duke Energy. This property is
undeveloped and has been used by the Neel Family for many years as a family gathering location. Once MHCC found out they had to relocate
their existing irrigation pump, they discussed easements with the surrounding property owners. The Neel Family allowed MHCC an easement as
long as it generally paralleled the adjoining property line and did not go through the middle of any mature trees. The current easement route
does not require any trees to be removed. Duke Energy does not allow submersible pumps and requires suction pipelines to travel under existing
docks. There was also a concern of the noise from the pump effecting the adjoiner property owner if the pump was located to close to the
property line. Therefore, the proposed route is constrained to the location we have shown.
For a suction pump to operate efficiently, the pump needs to be as close to the water source as possible. At the intersection of the Zone 1 30'
buffer and easement, there is a large popular tree (approximately 60" caliper) on the edge and partially inside of the easement. The pump would
have to be placed beyond this at least 5-10' to allow the pad to not interfere with the existing tree. Moving the pump outside of the Zone 1 30'
Buffer, the elevation would increase the head approximately ten feet due to the topography of the parcel.
In the last several weeks we have looked at different options and worked with several engineers to relocate the proposed pump location out of the
buffer. MHCC's pump supplier and engineer have completed different pump calculations to determine how much bigger the pump would need to
be outside of the Zone 1 buffer. The pump engineer from Xylem, Inc. has stated the suction demand is impossible to accomplish and they cannot
recommend a pump to meet the demand with their pump product line. The engineer said for a suction pump to operate efficiently, the pump
needs to be placed near the source as much as possible, horizontally and vertically.
We feel the above constraints are unique to MHCC's situation and seek a variance request.
