On June 15, 2016, the Division received photographs of 8 trees planted within the retained
portions of the protected buffer. A copy of the Declaration of Compliance with the Neuse River
Buffer Protection Rules Major Variance recorded in the Wake County Register of Deeds on
October 7, 2016 was provided to the Division on October 28, 2016. On November 1, 2016, the
Division received a Certificate of Completion indicating all work approved by the major variance
was complete. Upon review of the declaration, the Division determined that the buffer
conservation area was not depicted on the exhibit attached to the declaration. The attached
exhibit was annotated to depict the buffer conservation area as a 27 -foot strip along the back of
the lot.
These items satisfy condition number 1, 6 and 7 of the major variance approval issued on
