Dear Ms. Scott:
Reference is made to your letter of December 12, 2016, regarding the North Carolina
Department of Transportation (NCDOT) Transportation Improvement Project (TIP) U-5878 with
a project area extending from the terminus of Commerce Drive to Piney Green Road crossing
tributaries of Northeast Creek in Onslow County. The letter requested an evaluation of potential
beneficial or adverse impacts of the proposed project related to the Corps' permit
responsibilities.
Regarding permitting, our records indicate that there has been two separate actions
upstream of the project area that required authorization and both involved a component of
mitigation. It is anticipated that the tributary features in question are perennial in nature and the
Department is reminded that if perennial impacts exceed 3001inear feet the action would be
reviewed under the Individual Permit process. If less than 3001inear feet of perennial impact and
less than 0.50 of an acre of wetland impact, a nationwide permit may be available. This perennial
determination and stream quality will be assessed once the Corps is engaged in the resource
identification process.
Once more information is provided to the Corps regarding jurisdictional resources as well
as a better understanding of the project goals, the Corps will provide more specific information
