The project Project History Wetlands were delineated by Withers & Ravenel in the Fall of 2005 and the Spring of 2oo6. Site meetings were conducted with the USACE on August 8, 2oo6 (AID#: 2oo62oloo). The NC-DWQ conducted site meetings on 10/14/05, 11/17/05, 2/1/o6, 5/4/o6, and 9/2o/o6 to confirm our riparian buffer determinations (DWQ Project #: 05-270, 05-27oB, o6-122). In November 2007, Wendell Falls received approval from the NC-DWQ and the USACE to impact 2,979 linear feet of perennial stream (2,354 linear feet permanent, 625 linear feet temporary impact), 3.24 acres of wetlands for road construction, 2.39 acres of wetland for utility line installation, 0.2 acres of wetlands for mechanized land clearing, and 9.52 acres of riparian buffers for road construction, greenways, and utility line installation. Installation of the culverts and the associated impacts for the interchange and the early phases of the subdivision began in the Spring of 2oo8. During a site review by the NCDOT and DWQ and during subsequent meetings with the USACE on May 16tH, 2008, it was determined that the impacts exceed what was permitted. Specifically, there was temporary fill placed within wetlands, sewer lines had not been returned to contour, silt fences within wetlands, and minor permanent fill outside of the permitted area. Following this meeting, staff form Withers & Ravenel conducted as- built surveys at the stream and wetland crossings to in order to quantify the impacts and determine which areas were out of compliance. On June 13th, 2oo8 we received a Notice of Violation from the USACE. The impact totals are listed below. DOT Interchange and Parkway Site 1 (NCDOT Site 11) - Due to a large rainfall event, erosion control devices were overtopped and sediment was released into the DOT Mitigation/Enhancement site and adjacent wetlands. The amount of sediment ranged from 2-12 inches and covered an area of approximately 0.33 acres. The area was marked with orange flagging and the sediment was removed by hand on 5/20/08 and 5/21/08. Work was supervised by Withers & Ravenel wetland scientists. In addition to the sediment, a temporary bridge across Mark's Creek was built for construction traffic and clearing of the riparian buffers occurred outside of the permit areas. The buffer impacts due to the construction of the temporary bridge consist of 0.04 acres (Z1:0.02 acres, Z2:0.02 acres). Approximately 0.04 acres of wetlands will also be temporarily impacted for the bridge. Following construction, the wetlands will be returned to contour and re-seeded with a wetland seed mixture. Site 2 (NCDOT Site 11) - The approved impacts at this crossing consist of 0.94 acres of riparian buffer (Z1:o.61, Z2:0.35), 249 linear feet of stream channel and 0.04 acres of wetland fill. The actual impacts for this crossing are: Zone 1: 0.60, Zone 2: 0.34, 249 linear feet of stream, and 0.04 acres of wetland. Site 3 - The approved impacts at this crossing are: Zone 1: 0.73 acres, Zone 2: 0.38 acres and 392 linear feet of perennial channel. The actual impacts are: Zone 1: 0.70 acres, Zone 2: 0.46 acres, and - 390 linear feet of perennial channel. Because the actual impacts to Zone 2 exceed the permitted impacts by o.08 acres, the applicant proposes mitigation, payable to the NC-EEP. Site 4 - On May 20, 2008, accumulated sediment was removed from approximately 300 linear feet of stream channel in loop B (Sheet 7). In addition, based on field data, it was determined that the permitted impacts were exceeded by the following amounts: Zone 1: 0.06 acres, Zone 2: 0.03 acres, 15 linear feet of intermittent stream channel. Although permitted as an impact as part of the Highway 264 project, rip-rap was placed in a jurisdictional ditch parallel to the Highway and a cross vane was removed. Once the area has been stabilized, the applicant will remove the rip-rap and replace the cross vane, as per NCDOT design standards. The applicant proposes payment to the NCEEP to satisfy the mitigation requirements for the additional buffer impacts. Site 5 - No changes from original permit. Site 6 - The riparian buffers were impacted by placement of the sediment fence just outside of the existing toe-of-slope. The fence was installed to accommodate the construction of the acceleration/deceleration lanes. The fence also resulted in mechanized land clearing of 0.002 acres of wetlands. The approved impacts at this site were: 0.03 acres of mechanized land clearing in a wetland and o.oi acres of disturbance in Zone i of the riparian buffer. The actual impacts are: 0.0032 acres of clearing in a wetland, Zone 1: o.o6 acres, and Zone 2: 0.04. The applicant proposes buffer mitigation for the parallel buffer impacts depicted on Sheet 11. Site 7 - Due to site constraints, additional buffer and stream impacts occurred at Site 7. The permitted impacts consist of. 57 linear feet of stream channel, Zone 1: o.o9 acres, Zone 2: 0.04. The actual impacts are: 127 linear feet of stream, Zone 1: 0.15 acres, and Zone 2: 0.05 acres. The applicant proposes payment to NCEEP for 70 linear feet of perennial channel to satisfy mitigation requirements. Site 8 - No changes Site 9 - The original plans called for extending culvert, but because of structural issues, the entire culvert needed to be replaced, which increased the stream and buffer impacts. The permitted impacts were: 13 linear feet of stream, Zone 1: o.ol acres, and Zone 2: o.ol acres. The actual impacts are: 21 linear feet of stream channel, Zone 1: 0.07, and Zone 2: 0.05 acres. In order to satisfy mitigation requirements, the applicant proposes payment to EEP for 18 linear feet of perennial channel. Wendell Falls - Subdivision Impacts Within the subdivision, there were two areas not in compliance with the permitted impacts. Specifically, the stream/wetland crossings for the utility line installation were not returned to grade, and approximately 0.02 acres of unauthorized wetland fill was observed near the pump station (see pump station as-built). To bring the sewer line back into compliance, the applicant removed -2.25 acres of fill material and 6o feet of pipe. After the fill and pipe were removed, the areas were graded back to the original contours. The applicant proposes payment to EEP to satisfy mitigation requirements for 0.02 acres of wetland fill. Crossing R-4 We have also included the as-built information for road crossing R-4. The actual impacts are within the amounts permitted for the stream crossing, however, the wetland impacts were 0.02 acres in excess of what was permitted at this site. As part of this modification, we would also like to re-locate one of the sewer line crossings (Impact Slo). The impacts for this sewer have not occurred. The revised drawings are included with the attachments. Impact Summary Including the additional buffer, stream, and wetland impacts, the current request is for: Stream - Perennial - 2,442 LF (permanent) (88 additional feet over original permit) Stream - Intermittent - 596 LF (Permanent) (15 additional feet) Stream - Perennial - 625 LF (Temporary) Wetlands - Permanent - 3.28 acres (0.04 acres additional) Wetlands - Temporary - 2.39 acres (utility line installation) Wetlands - Temporary - 0.242 (mechanized clearing and temp. fill) (0.042 over original) Open Water - Pond - 0.16 acres Zone 1 Buffers - 224,770 SF (Permanent) Zone 2 Buffers -140,670 SF (Permanent) Zone 1 Buffers - 42, 689 SF (Temporary) Zone 2 Buffers - 25,700 SF (Temporary) Mitigation As stated above the applicant proposes payment to EEP to satisfy mitigation requirements for 88 linear feet of stream impact. and preservation for the additional 0.04 acres of wetland impacts over what was permitted. Mitigation will also be required for approximately 0.03 acres (1,307 SO of Zone i and 0.13 acres (5,663 SO of Zone 2 of the buffer. With the required multiplier, buffer mitigation is as follows: Zone 1: 1,307 X 3 = 3,921 SF, Zone 2: 5,663 X 1.5 = 8,495 SF. A copy of our request has been sent to EEP for approval.
