Dear Mr. Terry:
This letter is in response to your request for an initial determination on a proposed discharge of 3.22 MGD of
domestic and industrial wastewater, divided into 0.75 MGD discharging to Robeson Creek, classified as WS-
IV, NSW in the Cape Fear River Basin, and 2.47 MGD discharging to Haw River at the US 64 bridge, classified
WS-IV, NSW also in the Cape Fear River Basin.
The speculative limits presented here are based on our understanding of the proposal and of present
environmental conditions. In providing this information, the Division of Water Quality (DWQ) does not mean
to imply its approval of the proposed discharge. The Division can neither guarantee that it will actually issue
an NPDES permit for the discharge nor that the effluent limitations and other conditions of any permit will be
just as presented here. The Division will make any final decisions on these matters only after it receives and
evaluates a formal permit application for the proposed discharge and considers public comment on the
proposed permit conditions. The Town must also obtain other approvals prior to submitting its permit
application to the Division (see below).
Environmental Assessments of New and Expanding Treatment Facilities
Please note that the Town must evaluate and address the potential environmental impacts of this project
before receiving approval for an increased discharge through a modified permit.
Anyone proposing to construct new or expanded waste treatment facilities using public funds or public (state)
lands must first prepare an environmental assessment (EA) when wastewater flows (1) equal or exceed 0.5
mgd or (2) exceed one-third of the 7Q 10 flow of the receiving stream. The Division will not accept a permit
application for a project requiring an environmental assessment until it has approved the EA and sent a
Finding of No Significant Impact (FONSI) to the State Clearinghouse for review and comment. Further, we
cannot modify or issue the permit until the Clearinghouse has approved the FONSI. If the EA demonstrates
that the project may result in a.significant adverse effect on the quality of the environment, you must then
prepare an Environmental Impact Statement.-Please contact Ms. Hannah Stallings of DWQ's Planning Section

Engineering Alternatives Analysis MAN
The Town's EA or EIS must include an approvable engineering alternatives analysis (EAA).
The Division must approve an EAA before issuing or modifying any permit to authorize the discharge of new
or expanding flows. The purpose of the EAA is to justify the proposed wastewater flow rate and provide a
detailed analysis of treatment and disposal alternatives, including a thorough evaluation of non-discharge
and other alternatives such as spray irrigation, water conservation, and inflow and infiltration reduction. In
accordance with the North Carolina General Statutes, the preferred alternative must be the practicable waste
treatment and disposal alternative with the least adverse impact on the environment. Non-discharge and
other alternatives to discharge are considered to be environmentally preferable to a surface water discharge. A
copy of the Division's EAA requirements is attached to this letter. You can find this and other permit-related

Water (duality Considerations
Robeson Creek is a Class WS-IV, NSW water and was rated as Partially Supporting of freshwater standards in
2000 with chlorophyll a violations and impaired biological communities. The section of Robeson Creek
downstream of the Pittsboro WWTP discharge is listed as impaired on the 2008 Draft 303(d) list for Biological
Criteria. There is a TMDL for Robeson Creek based on chlorophyll a, with a Waste Load Allocation of 146 Kg
(322 lb) Total Phosphorus to the Pittsboro WWTP from April through October.
The Haw River is also a Class WS-IV, NSW water. The Haw River from downstream of Brooks Branch to
downstream of US 64 (4.3 miles) was Fully Supporting in the 2000 basinwide plan and is currently
Supporting aquatic life because of a Good benthic community rating at site BB443. This section of Haw River
is immediately above the Haw River Branch of the B. Everett Jordan Lake, which is impaired for chlorophyll a.
A.nutrient TMDL has been developed for the lake. Pittsboro has been given a Waste Load Allocation of 27,514
pounds per year TN and 3,731 pounds per year TP delivered at the lake. Transport Factors for TN are 76% at
Robeson Creek, and 99% for the Haw River US 64 bridge; and for TP are 82% for Robeson Creek and 99% for
the Haw River US 64 site.
The October 2005 Cape Fear River Basinwide Water Quality Plan contains more information and is available
for review or download at http://www.ncwaterqualitij.org/balsinwide/ . Chapters 4 and 5 describe conditions
in Robeson Creek, Haw River, and Jordan reservoir; Chapter 30 includes the localized permitting strategies
for dischargers to waters of concern.
The 2005 Basinwide Plan recommends the following restrictions on oxygen consuming waste from new and
expanding municipal discharges >_1 MGD: BODS = 5mg/L, NH3-N = lmg/L.
Nutrients
The nutrient (TN and TP) limits for the facility will be more complex than other limits, because the two
discharges suggested by the Town are subject to both individual and collective requirements. In addition, the
nutrient limits are calculated differently and apply over different time frames.
The Robeson Creek discharge will first be limited according to the 2004 TMDL, which caps the discharge at
322 lb TP for the summer period (April 1 - October 31).
The combined loads of TN and of TP for the combined discharges will also be limited based on the 2007 TMDL
(same as the 2008 Jordan Lake rules). These TN and TP limits will be annual (calendar year) limits and must
be expressed as loads delivered to the lake rather than as loads measured at the discharge points.
The Division's calculations show that the nutrient limits will be stringent at the proposed permitted flows of
0.75 and 2.47 MGD. If the Town treats all wastewater to the same extent prior to discharge (as opposed to
sidestream treatment for a portion of the flow), the TP must be reduced-to approximately 0.24 mg/L.in the
summer in order to meet the Robeson Creek TMDL. At that concentration, the summer load to Jordan Lake
would be about 1,310 pounds for 3.22 MGD. The Town would then have about 2,420 pounds available for the
winter period and would have to reach 0.63 mg/L TP to meet the annual limit.

The facility would also have to reduce TN to 3.0 mg/L on an.annual basis to meet the nitrogen limit at the full
proposed flow.
The Division has already notified the Town that its 2013 permit will include the TP limit for Robeson Creek.
The TP and TN limits from the new Jordan Lake rules are set to become effective in 2010 and 2014,
respectively, if the rules pass the legislative review in early 2009.
The new Jordan Lake rules provide an alternate approach to nutrient reductions that could benefit the Town
and others. Interested dischargers in the Haw River drainage may form a compliance association and work to
meet their nitrogen and phosphorus caps as a group. Members of an association would be subject to their
combined TN and TP limits rather than their individual limits and, as a result, could enjoy some flexibility in
reducing nutrient loads. Note, however, that this option does not apply to the summer TP limit for the
Robeson Creek discharge, which would remain in effect whether or not the Town joined such an association.

Here is most of the information I promised to send you regarding Pittsboro's nutrient allocations. I'll be
out of the office most of the week so will follow up on it when I get back in.
First, here are the proposed allocations figures from the Jordan Reservoir nutrient strategy.
TN: 27,514 lb/yr delivered allocation(at the reservoir)
That translates to 36,202 lb/yr discharge allocation at Robeson Creek outfall (76%transport factor) or
27,7921b/yr at the Haw River near US64 (99% TF)
TP: 3,731 lb/yr delivered allocation
Equivalent to 4,551 lb/yr discharge at Robeson Creek(82% TF), 3,769 lb/yr at the Haw location(99%
TF)
The WLA for the Robeson Creek is given in the TMDL report as a seasonal limit: 146 kg P in the
summer(Apr- Oct, 213 days). That makes it about 1.5 lb/day, or 0.24 mg/L at 0.75 MGD. I'm still
trying to find out if we've decided to implement it as a seasonal limit or a daily. I'll let you know what I
find out.

Could you please give me flow estimates for the Haw river just downstream of the US
64 bridge? The approximate coordinates for a proposed Town of Pittsboro discharge
are 35 deg. 41' 55" Lat. and 79 deg. 04' 60" Long. I am working on another set of
speculative limits for them.

Dear Mr. Vinzani:
We respectfully request updated speculative limits for the proposed Town of
Pittsboro WWTP and its dual discharges into Robeson Creek and the Haw River. .
The proposed project includes the construction of a new tertiary wastewater
treatment plant (WWTP) with a permitted-,Capacity of 3.22 MGD to be located
adjacent to the existing Robeson Creek WWTP with effluent discharges into
Robeson Creek and the Haw River at the US-64 bridge. A map with the location of
the WWTP and discharges is enclosed.
We updated the Draft EIS submitted on April 9th, 2007 to reflect the project as
described above. The EIS pursues the approval of a discharge of 3.22 MGD with
the allocation of the discharge flows as follows: (1) continue discharging 0.75 MGD
into Robeson Creek and (2) discharge the balance of the flow (3.22-0.75= 2.47
MGD) into the Haw River at the US-64 bridge. Ms. Hannah Stallings-requested
the updated speculative limits before reviewing our updated EIS.

The new system will include enhanced biological nutrient removal in a single sludge
staged bioreactor to guarantee that the speculative limits and nutrient allocations
associated with the discharge of 3.22 MGD flow are achieved. We are enclosing a
spreadsheet with the calculation of the total nitrogen and phosphorus delivered to
the reservoir from the two proposed discharge locations.
We, therefore, respectfully request that speculative limits (mg/L and mass/year) are
provided for the 3.22 MGD discharge flow and for the two discharge locations: (1)
at Robeson Creek for a flow of 0.75 MGD, (2) at the Haw River- US 64 Hwy for a
flow of 2.47 MGD.

DWQ, and members of HUA, the possibility of discharges into Robeson Creek and
the Haw River from the new Town of Pittsboro WWTP was to be determined. On
behalf of the Town of Pittsboro,we respectfully request a written response as your
decision concerning the dual effluent discharge locations as well as their speculative

• Phase 2: the plant would be expanded after 2013 for the wastewater capacity
required within the 20-year horizon, which we estimate as 6 MGD.

We will update the Draft EIS submitted on April 9th, 2007 to reflect the changes
indicated above. The EIS pursues the approval of a discharge of 3.22 MGD. for
Phase I of the project with the allocation of the discharge flows as follows: (1)
continue discharging 0.75 MGD into Robeson Creek and (2) discharge the balance
of the flow (3.22-0.75= 2.47 MGD) into the Haw River at the US-64 bridge.
The new system will include enhanced biological nutrient removal in a single sludge
staged bioreactor to guarantee that the speculative limits and nutrient allocations
associated with the discharge of 3.22 MGD flow are achieved. We are enclosing a
spreadsheet with the calculation of the total nitrogen and phosphorus delivered to
the reservoir from the two proposed discharge locations.
For the preparation,of the EIS,we analyzed the alternative of discharging into
Jordan Lake; this alternative was discarded for considering that discharging into the
Haw River causes less impact, both from the environment and from an economy
stand point.
Nevertheless,we respectfully request that speculative limits (mg/L and mass/year)
are provided for the 3.22 MGD discharge flow and for the three discharge
locations: (1) the existing, at Robeson Creek for a flow of 0.75 MGD, (2) the
preferred alternative, at the Haw River- US 64 Hwy for a flow of 2.47 MGD and (3)
at Jordan Lake for a flow of 2.47 MGD.

Here is most of the information I promised to send you regarding Pittsboro's nutrient allocations. I'll be
out of the office most of the week so will follow up on it when I get back in.
First,here are the proposed allocations figures from the Jordan Reservoir nutrient strategy.
TN: 27,514 lb/yr delivered allocation(at the reservoir)
That translates to 36,202 lb/yr discharge allocation at Robeson Creek outfall (76%transport factor) or
27,7921b/yr at the Haw River near US64 (99%TF)
TP: 3,731 lb/yr delivered allocation
Equivalent to 4,551 lb/yr discharge at Robeson Creek(82%TF), 3,769 lb/yr at the Haw location(99%
TF)
The WLA for the Robeson Creek is given in the TMDL report as a seasonal limit: 146 kg P in the
summer(Apr- Oct,213 days). That makes it about 1.5 lb/day,or 0.24 mg/L at 0.75 MGD. I'm still
trying to find out if we've decided to implement it as a seasonal limit or a daily. I'll let you know what I
find out.

To repeat the message most of you got from Calendar: I'm proposing a 1-hour meeting
this Thursday, the 15th, 3-4pm, in the NPDES file room. And you're invited.
The purpose of the meeting is to discuss the spec limits requests from Chatham County
(19 MGD to the Cape Fear below Buckhorn Dam; assigned to me) and from Pittsboro (2-3
MGD(?) and 4 MGD to Robeson Creek and the Haw River; went to Jim) . There is also the
related issue of a proposed 6,000-acre development between Pittsboro and the Haw
River, and we'll discuss that, too. The aim is to review the available information
and consider how to respond to these requests while keeping the larger issues of the
Upper Cape Fear and Jordan watersheds in mind. we need to respond fairly quickly,
say, by the end of the month.
I hope each of you can make it so we can sort through the issues and outline what Jim
and I will write up. Here are some of the info items we need to cover:
- previous spec limits for Pittsboro (Jim, there are at least two - 2000 & 2004 -
and they should be in the permit file)
- the status of Pittsboro's expansion/ relocation plans and their draft EIS (me +
others)
- the proposed 6,000-acre development and its implications (mine again)
- the requirements from the Robeson Creek TMDL - what we've told Pittsboro to
expect, what limits they'll have in 2011 (Bob?)
- Western Wake - the overall plans and timeline, spec limits we've given them (in
particular, for nutrients) , how they might affect or be affected by another discharge
below the dam (Teresa? Pete?)
- nutrient issues below Buckhorn Dam, and DWQ's position about future nutrient
limits in the Middle Cape Fear or beyond (Pete, I know we've talked about this, but I
need a refresher course)
- a good map or maps (Jim, Pete, anybody?) - I have some small ones but am
thinking of a good-sized basin map to work with.
If any of you can't be there, I need to talk to you 1st thing Thursday morning or get
this info from you somehow (I'll be in Asheville Tue & Wed and in meetings Thu from
10 til 3) .
Jackie - I'm inviting you because we're meeting beforehand about the Stantonsburg
spec limits and because of your wisdom and experience with such things. Join in if
you have time, bolt if you need to.

Thank you Curtis. You are right, I took the coordinates supplied by a consultant and did not check
them. When I entered the coordinates on Terrain Navigator Pro, they do pop up in the lake. The actual
proposed discharge site is right at the US 64 bridge. I read 35-43-49 N& 79-06-27 W .

October 2007 through March 2008)that is considered provisional and subject to revision pending
further review and finalization of discharge records.
A final comment...you identified coordinates in your email as the location for proposed Town of
Pittsboro discharge point. My examination of this location on the topo map indicates it is within the
impounded reach of Haw River(Jordan Lake). Please be aware the above estimates at U.S. 64
cannot be pro-rated further downstream because of the transition from riverine to impounded flow
conditions. While there is flow through the impounded reach, the USGS does not estimate the 7Q10
in these types of reaches because the effects of storage and circulation are not accounted for using
the techniques used to estimate low-flow characteristics.

Could you please give me flow estimates for the Haw river just
downstream of the US 64 bridge? The approximate coordinates for a

Here is the follow-up I promised you in our phone call this afternoon. Let me know if you have any questions about
this or anything else we discussed.
As I mentioned on the phone,the 4 MGD flow figure we've been using for the Town of Pittsboro is probably too
high.We got the figure from some quick calculations we did in a meeting a year or so ago.As you recalled, it
represents the highest flow Pittsoboro could discharge and still meet its proposed nitrogen limit;that is, the mass
limit is equivalent to 3.0 mg/L(BAT)at about 4 MGD.What we didn't consider then was the fact that relocating the
outfall from Robeson Creek to the Haw River changes the nutrient transport factors,and that in tum will lower the
Town's nutrient discharge limits.
First,these are the figures 1 emailed you on 2/22/07,showing the allocations for the present outfall location on
Robeson Creek:
TN: 36,202 lb/yr discharge allocation(equivalent to 5.29 mg/L)
27,514 lb/yr delivered to the reservoir(76%of discharge load)
TP: 4,551 Ib/yr discharge(equivalent to 0.66 mg/L)
3,731 lb/yr delivered(82%of discharge)
To calculate the discharge allocations/limits,we start with the delivered allocations for N& P,which are based on
the TMDL.We use the transport factors to calculate the corresponding discharge allocations(and limits).
Discharge TN = Delivered TN / TF
The delivered allocations are fixed and do not change when the outfall is moved. But the TFs for the new location
are higher-99%for both N&P-than at the current location, because the discharge is much closer to the lake.The
result is that the discharge limits decrease to about 27,800 and 3,770 Ib/yr for N&P.
If we still assume 3.0 mg/L is BAT for nitrogen removal,the allowable flow is now about 3 MGD.

Dear Mr. Matthews:
On behalf of the Town of Pittsboro, we are requesting an update' of the Speculative
Limits for the discharge of the proposed (new) Pittsboro WWTP.
The project includes: the construction of a new tertiary wastewater treatment plant
(WWTP), to be located on Robeson Creek between the existing WWTP and Hanks
Chapel road, with a new effluent discharge force main to the Haw River at the US-
64 bridge. A gravity sewer outfall shall be constructed along Robeson Creek
between the existing plant and the new plant to transport the sewer to the proposed
new facility.
The Pittsboro proposed wastewater treatment plant will be built in two phases:
• Phase 1: to be constructed for an initial demand of 3.0 MGD. An updated
demand analysis indicates that by the year 2013, the Town of Pittsboro will
require a WWTP larger that 3.0 MGD.
• Phase 2: the plant would be expanded after 2013 for a capacity of 4.0 MGD.
In September 2004,we received a letter from DWQ signed by Mr.David A.Goodrich indicating the
speculative limits for a 4-MGD flow at three potential discharge sites:Haw River below US 15-501,
Mainstream of Jordan Lake above Stinking Creek,and Haw River near Highway 64.

We are updating the Draft EIS submitted on April 91h, 2007 to reflect the changes
indicated above. The EIS pursues the approval of a discharge of 4.0 MGD.
The new system will include enhanced biological nutrient removal in a single sludge
staged bioreactor to guarantee that the speculative limits and nutrient allocations
associated with the 3.0 and 4.0 MGD flows are achieved.
The existing WWTP discharges into Robeson Creek,which is listed in the 303 (d)
impaired water list. The new project proposes to stop discharging into Robeson
Creek and investigates the feasibility of two other potential discharge sites: in the
Haw River at the US-64 bridge and in Jordan Lake. Discharging in the Haw River at
US 64 is the preferred alternative. A map with the location of the proposed facility
and discharge routes is enclosed.
We request that speculative limits (mg/L and mass/year) are provided for the 3.0
and 4.0 MGD discharge flows and -for comparison purposes- for the three
discharge locations: (1) the existing, at Robeson Creek, (2) the preferred alternative,
at the Haw River- US 64 Hwy and (3) at Jordan Lake.
