Box 759 635 East Street Pittsboro,North Carolina 37312 SUBJECT: NPDES PERMIT MODIFICATION Town of Pittsboro WWTP Chatham County NPDES #NC0020354 Dear Mr.Terry: Division personnel have reviewed the above-referenced permit modification request submitted to our office on December 3, 2008. This permit modification authorizes a 3-month extension to the January 1,2009 deadline for Special Condition A.(6.) Total Phosphorus Compliance Plans requiring the Town to submit a plan by then, allowing time to finalize negotiations and ensure confidence in the developer's commitment to this project. The new deadline shall be April 1, 2009. Please keep in mind that this extension applies only to Special Condition A.(6.). The attached permit page should be placed in the permit and the old page discarded. This permit modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.Environmental Protection Agency dated October 15, 2007(or as subsequently amended). TOTAL PHOSPHOROUS COMPLIANCE PLANS By April 1, 2009, the Town of Pittsboro will submit a plan prepared by a professional engineer documenting how it intends to satisfy the Total Maximum Daily Load(TMDL)that has been established for Roberson Creek and/or Total Phosphorous permit limits imposed upon the Town of Pittsboro WWTP based upon the TMDL or other nutrient management strategies for the Cape,Fear River Basin. The plan should include an analysis of projected growth for the Town and projected future wastewater needs along with detailed discussion of how the Town plans to meet any needs for additional capacity and remain in compliance with water quality regulations. The report should discuss any plans for expansion of the WWTP, potential relocation(s)of the outfall and the effects these decisions may have on both permitting issues and the actual water quality of the receiving stream. (6), it specifies that the Town must submit a plan prepared by a professional engineer documenting how the Town intends to satisfy the Total Maximum Daily Load that has been established for Roberson Creek by January 1, 2009. The purpose of-this letter is to request a time extension to move this deadline to April 1,2009. As you are well aware, the Town is currently pursuing the construction of a new wastewater treatment plant with an expected treatment capacity of 3.22 mgd. This new facility will likely discharge in two locations: the existing location at Roberson Creek and the Haw River at the US64 bridge crossing. The Town and its consultants have prepared an Environmental Impact Statement for this project that is currently under review by Hanna Stallings of the Division of Water Quality. We believe that the proposed new treatment plant is necessary to satisfy the emerging demand for new development in and around Pittsboro that has been expressed by the development community over the past 24 months. Pittsboro currently is negotiating with multiple developers for the financing of the new plant based on satisfying their development needs as well as the Town's expected growth rate over the next twenty years. The Town is requesting a three month time extension beyond the January 1, 2009 deadline in order to finalize these negotiations and to reach a higher level of confidence in the developers' commitment to the project. The report will be prepared by a professional engineer and will cover all of the items outlined in Section A. (6.) of the NPDES permit.
