Consistent with the Director's October 1,2009,letter of intent to modify NPDES permits affected by the
Jordan Reservoir Nutrient Management Strategy rules and in consideration of public comments on the.
subsequent draft permit modifications,the Division is forwarding herewith the revised NPDES permit
for the Pittsboro WWTP.This permit modification is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and
the U.S. Environmental Protection Agency, dated October 15, 2007.
The Division received no comments on the draft permit during the public comment period.However,
the final permit includes the following changes:
• Phosphorus Allocations and Limits. The draft permit correctly listed a Total Phosphorus (TP)
allocation of 4,551 lb/yr in Condition A.(3.), Nutrient Allocations-Jordan Lake Strategy;but it
mistakenly showed a TP limit of 5,056 lb/yr in Condition A.(1.), Effluent Limitations and
Monitoring Requirements.Condition A.(1.)has been revised to show the correct TP limit of 4,551
• lb/yr.
• Condition A.(5.),Annual Limits For Total Nitrogen Or Total Phosphorus. Item(a.) has been
revised to clarify that the requirements of this condition apply to nutrient limits under the Jordan
Lake nutrient management strategy and not to the seasonal limits established in the Robeson
Creek TMDL. '
• Standard Conditions. The final permit includes a newly revised version of the standard permit
conditions (Parts II, III, and IV of the permit). We received comments from several permittees
regarding these conditions. In response,Jeff Poupart of the Point Source Branch has worked with
other programs within the Division and with EPA Region 4 staff to evaluate and address those

any inconvenience this delay may have caused.
This final permit does not include changes recently requested by the Town in anticipation of its
treatment plant expansion and addition of a second outfall.The NPDES staff is currently reviewing
that request and will take separate action in the near future.
Implementation of Total Phosphorus (TP) Limits. The Jordan Reservoir Wastewater Discharge
Requirements (T15A NCAC 02B .0270) established annual mass phosphorus limits for fourteen
treatment facilities,to become effective with calendar year 2010.Thus,even though the effective date of
this permit modification is August 1,2010, the new limits became effective January 1,2010,by rule and
apply to calendar year 2010 in its entirety.
If any parts,measurement frequencies,or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes,and filed with the office of
Administrative Hearings,6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a
demand is made,this permit shall be final and binding.
This permit is not transferable except after notice to the Division of Water Quality.The Division may
require modification or revocation and reissuance of the permit.This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality,the
Division of Land Resources, the Coastal Area Management Act,or any other federal or local
governmental permit.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked.As of
this permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the
exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements,
terms, and provisions included herein.
The Town of Pittsboro
is hereby authorized to:
1. Continue to operate an existing 0.75 MGD extended aeration treatment system consisting of the
following components:
• Manual and mechanical bar screen
• Diffused aeration basins
• Clarifiers
• Phosphorous removal _
• High-rate sand filters •
• Sludge thickening
• Aerobic sludge digestion
• Ultraviolet disinfection
•- Effluent flow measurement -
• Cascade post aeration
The facility is located at the Pittsboro WWTP off of the Small Street Extension,southeast of
Pittsboro in Chatham County

2. Discharge from said treatment works at the location specified on the attached map into Roberson
Creek,classified as WS-IV NSW waters in the Cape Fear River Basin.

Footnotes from Effluent Limitations and Monitoring Requirements:
1. Sample locations: Upstream=at least 100 yards above the outfall; Downstream=at least 100 yards downstream from
the outfall. Instream monitoring shall be conducted 3/Week during June,July,August,and September,and once per
week during the remainder of the year.Instream monitoring is provisionally waived in light of the Permittee's
participation in the Upper Cape Fear River Basin Association.Instream monitoring shall be conducted as stated in this
permit should the Permittee end its participation in the Association.
2. The monthly average BOD5 and Total Suspended Residue concentrations shall not exceed 15%of the respective influent
value(85%removal).
3. The daily dissolved oxygen effluent concentration shall not be less than 6.0 mg/1.
4. Total residual chlorine shall be monitored if chlorine is added as a disinfectant or used elsewhere in the process.
5. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be monitored three times •
per week at the effluent by grab sample.
6. TN=TKN+NO3-N+NO2-N,where TN is Total Nitrogen,TKN is Total Kjeldahl Nitrogen,and NO3-N and NO2-N are
Nitrate and Nitrite Nitrogen,respectively.
7. TN or TP Load is the mass quantity of Total Nitrogen or Phosphorus discharged in a given period of time.See Special
Condition A.(6.),Calculation of Total Nitrogen or Total Phosphorus Loads.
8. Compliance with mass limits shall be determined in accordance with Special Conditions A.(4.),Total Phosphorus Limits,
and A.(5.),Annual Limits for Total Nitrogen or Total Phosphorus.
9. The quarterly average for total phosphorus shall be the average of composite samples collected weekly during each
calendar quarter(January-March,April-June,July-September,October-December).
10. Chronic Toxicity(Ceriodaphnia)P/F at 90%;March,June,September&December.See Special Condition A.(2.).
There shall be no discharge of floating solids or visible foam in other than trace amounts.

A.(2.) CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant
mortality to Ceriodaphnia dubia at an effluent concentration of 90%.
The permit holder shall perform at a minimum,quarterly monitoring using test procedures outlined in
the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998,or
subsequent versions or"North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"
(Revised-February 1998) or subsequent versions.The tests will be performed during the months of
March,June, September,and December. Effluent sampling for this testing shall be performed at the
NPDES permitted final effluent discharge below all treatment processes.
If the test procedure,performed as the first test of any single quarter,results in a failure or ChV
below the permit limit,then multiple-concentration testing shall be performed at a minimum, in
each of the two following months,as described in "North Carolina Phase II Chronic Whole Effluent
Toxicity Test Procedure" (Revised-February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the
highest concentration having no detectable impairment of reproduction or survival and the lowest
concentration that does have a detectable impairment of reproduction or survival. The definition of
"detectable impairment," collection methods,exposure regimes,and further statistical methods are
specified in the"North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised-
February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form(MR-1)for the months in which tests were performed,using the
parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally,

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.Test data shall be
complete, accurate,include all supporting chemical/physical measurements and all
concentration/response data,and be certified by laboratory supervisor and ORC or approved
designate signature. Total residual chlorine of the effluent toxicity sample must be measured and
reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required,the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number,pipe number,county,and the month/year of the
report with the notation of"No Flow" in the comment area of the form. The report shall be submitted
to the Environmental Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required,
monitoring will be required during the following month. Should any test data from this monitoring
requirement or tests performed by the North Carolina Division of Water Quality indicate potential
impacts to the receiving stream,this permit may be re-opened and modified to include alternate
monitoring requirements or limits. ;
NOTE: Failure to achieve test conditions as specified in the cited document(such as minimum control
organism survival,minimum control organism reproduction,and/or appropriate environmental
controls) shall constitute an invalid test and will require immediate follow-up testing,to be completed
no later than the last day of the month following the month of initial monitoring.

A.(4.) TOTAL PHOSPHOROUS LIMITS
(a.) Special Condition A.(1.), Effluent Limitations and Monitoring'Requirements,specifies three
discharge limits for Total Phosphorus: a year-round 2.0 mg/L concentration limit(already in
effect),a summer-season mass limit consistent with the requirements of the Roberson Creek
Phosphorus TMDL (effective summer of 2011),.and4a year-round mass limit consistent with the ,
requirements of the Haw River Nutrient TMDL and the Jordan Lake Nutrient Management
Strategy (effective January 1,2010).
(b.) Prior to submitting application for an Authorization to Construct a new wastewater treatment
facility and outfall to the Haw River,the Permittee must first obtain a modification of this NPDES
permit authorizing such discharge.

A.(5.) ANNUAL LIMITS FOR TOTAL NITROGEN OR TOTAL PHOSPHORUS
(a.) Total Nitrogen(TN) and Total Phosphorus (TP) allocations and load limits established under the
Jordan Lake Nutrient Management Strategy for NPDES wastewater dischargers are annual
values and apply on a calendar year basis. (The provisions of this special condition are limited to
these annual limits and do not apply to seasonal limits established in the Robeson Creek TMDL.)
(b.) For any given calendar year, the Permittee shall be in compliance with the annual TN (or TP)
Load limit in this Permit if:
(i.) the Permittee's annual TN (or TP) Load is less than or equal to the effective limit,or
(ii.) the Permittee is a Co-Permittee Member of a compliance association.
(c.) The TN (or TP) Load limit in this Permit may be modified as the result of allowable changes in
the Permittee's allocations.
(i.) Allowable changes include those resulting from purchase of TN (or TP) allocation from an
authorized mitigation banker,the Ecosystem Enhancement Program,or other source
allowed under applicable regulations; purchase,sale, trade,or lease of allocation between
the Permittee and other dischargers;regionalization;and other transactions approved by
the Division.
_ (ii.) The Permittee may request a modification of the TN(or TP) Load limit in this Permit to
reflect allowable changes in its aliocation(s).
(A) Upon receipt of timely and proper application,the Division will modify the permit as
appropriate and in accordance with state and federal program requirements.
(B) Changes in TN (or TP) limits become effective on January 1 of the year following
permit modification.The Division must receive application no later than August 31
for changes proposed for the following calendar year:
(iii.) Any'requests for modification should be sent to:

(d.) If the Permittee is a member and co-permittee of an approved compliance association on January
1 of a given year,its TN and TP discharges during that year are governed by that association's
group NPDES permit and the limits therein.
(i.) The Permittee shall be considered a Co-Permittee Member for any given calendar year in
which it is identified as such in Appendix A of the association's group NPDES permit.
(ii.) Association roster(s) and members' TN and TP allocations will be updated annually and in
accordance with state and federal program requirements.
(iii.) If the Permittee intends to join or leave a compliance association,the Division must be
notified of the proposed action in accordance with the procedures defined in the
association's NPDES permit. •
(A) Upon receipt of timely and proper notification,the Division will modify the permit as
appropriate and in accordance with state and federal program requirements.
(B) Membership changes in a compliance association become effective on January 1 of the
year following modification of the association's permit.

(e.) The TN and TP monitoring and reporting requirements in this Permit remain in effect
throughout the term of the Permit and are not affected by the Permittee's membership in a
compliance association.
A.(6.) CALCULATION OF TOTAL NITROGEN OR TOTAL PHOSPHORUS LOADS
(a.) The Permittee shall calculate monthly and annual TN Loads as follows:
(i.) Monthly TN (or TP) Load (lb/mo) =TN (or TP) x TMF x 8.34
where: -
TN or TP = the average Total Nitrogen or Total Phosphorus concentration
(mg/L) of the composite samples collected during the month
TMF = the Total Monthly Flow of wastewater discharged during the
month (MG/mo)
8.34 = conversion factor,from(mg/L x MG) to pounds
(ii.) Annual TN (or TP) Load (lb/yr) =Sum of the 12 Monthly TN (or TP) Loads for the calendar
year
(b.) The Permittee shall report monthly Total Nitrogen and Total Phosphorus results (mg/Land
lb/mo) in the appropriate discharge monitoring report for each month and shall report each
calendar year's results (Ib/yr) with the December report for that year.
A.(7.) NITROGEN OPTIMIZATION
(a.) Not later than February 11,2010,the Permittee shall:
(i.) evaluate its treatment facilities and operations,
(ii.) identify further opportunities to improve and optimize nitrogen reduction in the existing
facilities beyond those previously implemented pursuant to G.S. 143-215.1B(d),and
(iii.) submit a report to the Division documenting its findings,proposing optimization measures,
and describing expected results.
(b.) No later than six months following the Division's written acceptance of the report, or as provided
in the acceptance,the Permittee shall implement the proposed measures.
(c.) Beginning one year following the Division's acceptance of the report and continuing through
2016, the Permittee shall submit a progress report to the Division documenting the status of the
proposed measures and the nitrogen reductions achieved at the facility during the previous
calendar year.
(d.) Reports shall be submitted to:

A.(8.) PERMIT RE-OPENER: SUPPLEMENTARY NUTRIENT MONITORING
Pursuant to N.C. General Statutes Section 143-215.1 and the implementing rules found in Title 15A of
the North Carolina Administrative Code,Subchapter 02H, specifically, 15A NCAC 02H.0112(b)(1) and
02H.0114(a),and Part II,Sections B.12. and B.13. of this Permit, the Director of DWQ may reopen this
permit to require supplemental nutrient monitoring of the discharge. The additional monitoring will
be to support water quality modeling efforts within the Cape Fear River Basin, and shall be consistent
with a monitoring plan developed jointly by the Division and affected stakeholders.

Governor Bev Perdue recently signed legislation to complete passage of rules for the Jordan Lake
Nutrient Management Strategy. The Strategy includes a Wastewater Discharge rule (T15A NCAC 02B
.0270) that applies to your wastewater treatment facility. Pursuant to Sub-Item(6)(d) of that rule, I am
writing to notify you of(1) the nutrient allocations assigned to your facility and (2) the Division of
Water Quality's intent to modify the facility's NPDES permit to include nutrient limits as provided in
the rule. I also wish to remind you of other provisions of the rule that require your prompt attention.
This letter addresses only certain provisions of the Jordan Lake Wastewater Discharge rule. I encourage
you to familiarize yourself with the remainder of this rule.
Nutrient Allocations. The Wastewater Discharge rule establishes the maximum loads of nitrogen and
phosphorus that can be released from wastewater treatment facilities into the Jordan Lake watershed.
The rule specifies that these wasteload allocations are to be divided among the existing facilities in
proportion to their 2001 permitted flows (with certain exceptions).
Your facility has been assigned nitrogen and phosphorus allocations.The allocations are expressed as
annual mass loadings delivered to the lake. Due to foreseeable losses between the discharge point and
the lake, they are also expressed as the equivalent discharge loads at the point of discharge.The
delivered and the corresponding discharge allocations assigned to your facility are as follows:

Notification of Intent to Modify NPDES Permit

Intent to Modify Permit.The new rule specifies that facilities with permitted flows at or above 0.1
MGD,including yours,will be subject to effluent limits for nitrogen and phosphorus. The effluent
limits will equal the facility's discharge allocations. The new phosphorus limits become effective
beginning with calendar year 2010. Nitrogen limits become effective beginning with calendar year
2016.
It is the Division's intent to modify the affected permits by the end of 2009 to include the new
phosphorus limits. We will draft permit modifications for the affected facilities in the coming weeks.
As with any such permit action, the proposed modifications will be subject to public review,and we
will provide you with a copy of the draft permit at that time.
The Division will add nitrogen limits during the 2011 permit renewals,with a compliance date of 2016.
Process Optimization. The rule specifies that no later than six months after its effective date,each
discharger with a permitted flow greater than or equal to 0.5 MGD must"evaluate its treatment
facilities and operations and identify further opportunities to improve and minimize nitrogen
reduction in the existing facilities...;and submit a report to the Division documenting its findings,
proposing optimization measures,and describing expected results."
Please provide three copies of your report to the Division at the following address no later than
February 11,2010:

Each discharger must implement the proposed measures no later than six months after the Division
accepts the report and continue until such time as the facility is upgraded for nitrogen removal. The
affected dischargers must also submit annual progress report to the Division for a period of five years.
