(DMP) and Davidson County, has prepared the attached Pre -Construction Notification (PCN) for the above referenced project for a Clean Water Act Section 404 Nationwide Permit 12 and a Section 401 Water Quality Certification No. 3884 (404/401 permits). The proposed I-85 Business Park requires sanitary sewer service provided via an on-site pump station and force main to connect with the existing Davidson County collection and treatment system. The Business Park property was evaluated by another consultant for Davidson County. It is our understanding that the Business Park could be developed without requiring 404/401 permits, except for the required pump station and force main impacts. Therefore, this utility infrastructure within the Business Park has been added to this PCN to submit as a single and complete project. This PCN covers the construction of a force main that connects the proposed Business Park pump station to an existing pump station located north of I-85, approximately 5.3 miles away, and the construction of a permanent maintenance access road to the Business Park pump station. The force main will run off-road from the proposed I-85 Business Park pump station to Belmont Road, parallel to Belmont and Old Linwood roads, then follow an existing off-road force main easement to the pump station north of I-85. The attached PCN form provides information for use in your review of the impacts to streams and wetlands associated with this site. Supplemental information is provided in this cover letter. Additional information is contained in the attachments including impact tables, a Vicinity map, USGS map, Impact maps, supporting documentation, and engineering plans. Proposed Impacts and Mitigation The majority of this line was designed to parallel existing utility and transportation rights-of-way to minimize disturbance to new areas. Permanent impacts to accommodate the new Business Park pump station access road are necessary as part of 100 -year floodplain avoidance. •' Ms. Jean Gibby I-85 Business Park PCN January 25, 2016 Page 2 of 3 Four directional bores, totaling 1,140 feet along the proposed alignment, would avoid impacts in three wetlands (WC, and a portions of WL and WP), and four streams (Swearing Creek, North Potts Creek, and two unnamed tributaries (streams S3 and S7 in the PJD)). Project designers have minimized losses to Waters of the US to 43 feet of stream, and 0.02 acre of wetland, both associated with construction of the Business Park pump station maintenance access road. A total of 15 wetland impacts, totaling 1.04 acres are associated with this project. The permanent and temporary impacts total 0.39 and 0.65 acre, respectively. The permanent impacts include forested wetland areas that will be permanently converted to maintained/herbaceous wetland (0.37), and areas permanently filled to accommodate the proposed access road (0.02). Two wetland impacts would exceed 0.1 acre. Wetland WB (Impact W1; Figures 3.1 through 3.3) would require temporary impacts to 0.24 acre of forested wetland. However these areas will be allowed to return to their pre -construction condition once installation is complete. Only 0.09 acre of currently forested wetland would be permanently converted to herbaceous wetland. Wetland WD (Impact W4; Figures 3.5 and 3.6) would require temporary disturbance to 0.16 acre of forested wetland, and the permanent conversion of 0.18 acre to herbaceous wetland. This is due to the existing force main corridor having been allowed to return to forest vegetation. Had it been maintained as allowed, permanent forest conversion at this crossing would be much less. A total of 10 stream impacts totaling 584 feet, occur within the proposed corridor. One of these crossings is dual-purpose and will accommodate both the pump station access road and force main. The 10 sewer line crossings account for 541 feet of temporary impacts and an access road crossing (culvert) accounts for 43 feet of permanent impacts. The alignment will cross all streams at or near perpendicular angles except for S4 and S7. Stream Impact S4 (Figure 3. 9) accounts for 165 linear feet. This feature is routed along an existing maintenance road within the project area. The maintenance road is being utilized for construction to minimize disturbance to natural areas. Due to the stream's location along this road, temporary impacts to it are unavoidable. Stream Impact S7 accounts for 188 linear feet of these impacts (Figure 3.15). This feature begins along Belmont Road and runs through a roadside rip -rap channel before turning south. Of the 188 linear feet to be temporarily impacted, 168 linear feet are riprap roadside channel and will result in minimal adverse impact. Sediment and erosion control measures will be implemented according to NC requirements, and approved by NCDEQ prior to implementation. Jurisdictional areas adjacent to construction impact areas will be clearly marked with protection fencing or other similar method to avoid inadvertent encroachment. Copies of permits and impact areas will be provided to the prime contractor and all subcontractors working in or near jurisdictional areas. Land clearing will take place along with installation of erosion control devices. Construction will be accomplished using typical equipment including excavators, backhoes, and dump trucks. Additional equipment may be used as required. Ms. Jean Gibby I-85 Business Park PCN January 25, 2016 Page 3 of 3 Historic or Prehistoric Cultural Resources The sewer line will run within the right-of-way of Belmont Road, including a portion across a historic property, as identified by the North Carolina Historic Preservation Office (NCHPO), that contains an early 19th C. farmhouse (Site ID: DV0007). A Memorandum of Agreement with the NCHPO has been completed and is attached to this application. This Memorandum was prepared to cover impacts on and associated with development of the Business Park, including this proposed sewer line. Northern Long -Eared Bat Davidson County occurs within an area known to be suitable for Northern Long -Eared Bat (NLEB). Based on information obtained from the US Fish and Wildlife Service website, https://www.fws.gov/asheville/htmis/project review/NLEB in WNC.html, the closest confirmed hibernation or maternity site is over 57 miles away from this project area. Based on the information obtained from the website listed above, this project is compliant with the Endangered Species Act. No adverse impacts to this species are anticipated. The sewer alignment parallels roads and railroads and overlaps an existing off-road force main easement for the majority of its route, minimizing forested wetland clearing. All stream impacts are temporary except for the impact associated with the access road culvert. The access road will be located outside of a 100 -year floodplain. Four directional bores are avoiding four streams (including 2 named ones) and all or part of three wetlands. 1 b. Permanent Stream Impact • Temporary Wetland Impact = Sheet Limits Temporary Stream Impact _ Delineated Wetland December 2016 N Feet 0 25 50 Figure 3.19: Stream and Wetland Impacts 1-85 Business Park Sewer Davidson County MEMORANDUM OF AGREEMENT BETWEEN DAVIDSON COUNTY AND THE NORTH CAROLINA STATE HISTORIC PRESERVATION OFFICER REGARDING THE DEVELOPMENT OF THE I-85 CORRIDOR BUSINESS PARK, LINWOOD, NORTH CAROLINA WHEREAS, Davidson County (County) has been awarded a Community Development Block Grant Revolving Loan for Site Development, from the US Department of Housing and Urban Development (HUD), through the North Carolina Department of Commerce and in accord with the Housing and Community Development Act of 1974, to develop the first phase of the I-85 Corridor Business Park on 431 acres south of Belmont Road, in Linwood, North Carolina (the Undertaking); and WHEREAS, in accordance with 24 CFR Part 58, the County, as the Responsible Entity, has assumed the environmental review responsibilities of HUD; and WHEREAS, the County has determined that the Undertaking will have an adverse effect on Beallmont (DV0007), a property listed in the National Register of Historic Places, and has consulted with the North Carolina State Historic Preservation Officer (SHPO) pursuant to 36 CFR § 800, the regulations implementing Section 106 of the National Historic Preservation Act (16 U.S.C. § 470f); and WHEREAS, the County has consulted with the Historic Preservation Foundation of North Carolina, Inc. (PNC) regarding the effects of the Undertaking on the historic property and has invited them to sign this Memorandum of Agreement (MOA) as a concurring party; and WHEREAS, in accordance with 36 CFR § 800.6(a)(1),the County has notified the Advisory Council on Historic Preservation (ACHP) of its adverse effect determination with specified documentation, and the ACHP has chosen not to participate in the consultation pursuant to 36 CFR § 800.6(a)(1)(iii); NOW, THEREFORE, the County and SHPO agree that the Undertaking shall be implemented in accordance with the following stipulations in order to take into account the effect of the Undertaking on historic properties. Beallmont MOA STIPULATIONS Davidson County shall ensure that the following measures are carried out: I. DOCUMENTATION OF BEALLMONT A. The County shall engage the services of an architectural historian (consultant), who meets the Secretary of the Interior's Professional Qualification Standards, to thoroughly document the entire National Register -listed property, including the landscape, house, and any extant outbuildings, prior to any work taking place on the property or any changes being made to the house and outbuildings, including the relocation of the house and demolition of the outbuildings. B. The documentation shall be in accord with the Recordation Plan, attached to this MOA as Appendix A. C. The documentation shall be submitted to the SHPO within thirty (30) days of the execution of this MOA by the County and SHPO. a. The SHPO will have fifteen (15) days to review the documentation and offer written comments as to whether or not it meets the requirements of the Recordation Plan and is acceptable. b. If the documentation does not meet the requirements, the County's consultant shall make the necessary corrections and submit them to the SHPO for an additional fifteen (15) day review. D. If within fifteen (15) days of receipt of the documentation, the SHPO fails to comment on the submittal, the County may consider the documentation acceptable. II. RELOCATION OF THE BEALLMONT HOUSE The County and PNC shall enter into the "Agreement for Moving of Beallmont House," attached to this MOA as Appendix B, so that PNC may sell the property with covenants to ensure the house's rehabilitation, reuse and preservation. The Agreement, shall, at a minimum, include: A. The County's obtaining clear title to the 2.584 -acre lot shown on the plat attached to this MOA as Appendix C; B. The County's transferring to PNC ownership of the Beallmont House and 2.584 -acre lot, C. The County's providing PNC with fifty thousand dollars ($50,000) for the cost of moving those parts of the Beallmont House identified by the SHPO to be preserved and relocated to the 2.584 -acre lot, and for such other expenses as may be incurred by PNC in regard to the property. D. PNC will develop and construct an appropriate foundation for the Beallmont House at the new site. 2 Beallmont MOA E. PNC will place preservation covenants on the property to ensure the house's rehabilitation and reuse. The covenants shall include provisions for the rehabilitation to meet the Secretary of the Interior's Standards for Rehabilitation and annual monitoring of the house's condition to enforce the terms of the covenants. III. ARCHAEOLOGICAL SURVEY AND TESTING A. The County engaged the services of an archaeologist, who meets the Secretary of the Interior's Professional Qualification Standards, and carried out an archaeological survey of the areas that constitute Phase 1 of the I-85 Corridor Business Park, the eight (8) acres listed in the National Register as part of the historic property, and the 2.584 -acre lot onto which the Beallmont House will be moved. No archaeological sites meeting the criteria of listing in the National Register were identified. These areas are considered cleared for development with the exception of the area comprising the footprint of the Beallmont House. B. Given the potential for archaeological resources that may contribute to an understanding of the historic property and be eligible for listing in the National Register of Historic Places, the County shall engage a qualified archaeologist to conduct a program of intensive survey and testing within the footprint of the Beallmont House following its removal and relocation. a. The plans for the intensive survey and testing shall be reviewed and approved by the SHPO. b. The results of the intensive survey and testing shall be submitted to the SHPO within one hundred and twenty (120) days of the execution of this MOA by the County and SHPO. i. The SHPO will have thirty (30) days to review the results of the intensive survey and testing and offer written comments on the adequacy of the survey and its findings. ii. Based on the results of the intensive survey and testing, the SHPO may clear the Beallmont House footprint for development or recommend data recovery of any significant sites that would be damaged or destroyed by development. c. If within thirty (30) days of receipt of the results of the intensive survey and testing, the SHPO fails to comment on the submittal, the County may consider the survey implementation acceptable. IV. POST -REVIEW DISCOVERIES AND HUMAN REMAINS If properties are discovered that may be historically significant or unanticipated effects on historic properties found, the County shall implement the discovery plan included as Appendix B of this MOA. Beallmont MOA If any marked or unmarked human remains are discovered as a result of any of the survey work outlined in Stipulation III, above, or doing construction of the I-85 Corporate Park, they shall be treated in accordance with the Unmarked Human Burial and Human Skeletal Remains Protection Act, North Carolina General Statue, Chapter 70 Article 3. V. DURATION This MOA will expire if its terms are not carried out within five (5) years from the date of its execution. Prior to such time, the County may consult with the other signatories to reconsider the terms of the MOA and amend it in accordance with Stipulation VIII below. VI. MONITORING AND REPORTING Every six (6) months following the execution of this MOA until it expires or is terminated, the County shall provide all parties to this MOA a summary report detailing work undertaken pursuant to its terms. Such report shall include any scheduling changes proposed, any problems encountered, and any disputes and objections received in the County's efforts to carry out the terms of this MOA. VII. DISPUTE RESOLUTION Should any signatory or concurring party to this MOA object at any time to any actions proposed or the manner in which the terms of this MOA are implemented, the County shall consult with such party to resolve the objection. If the County determines that such objection cannot be resolved, the County will: A. Forward all documentation relevant to the dispute, including the County's proposed resolution, to the ACHP. The ACHP shall provide the County with its advice on the resolution of the objection within thirty (30) days of receiving adequate documentation. Prior to reaching a final decision on the dispute, the County shall prepare a written response that takes into account any timely advice or comments regarding the dispute from the ACHP, signatories and concurring parties, and provide them with a copy of this written response. The County will then proceed according to its final decision. B. If the ACHP does not provide its advice regarding the dispute within the thirty (30) day time period, the County may make a final decision on the dispute and proceed accordingly. Prior to reaching such a final decision, the County shall prepare a written response that takes into account any timely comments regarding the dispute from the signatories and concurring parties to the MOA, and provide them and the ACHP with a copy of such written response. 4 Beallmont MOA C. The County's responsibility to carry out all other actions subject to the terms of this MOA that are not the subject of the dispute remain unchanged. VIII. AMENDMENTS This MOA may be amended when such an amendment is agreed to in writing by all signatories. The amendment will be effective on the date a copy signed by all of the signatories is filed with the ACNP. IX. TERMINATION If any signatory to this MOA determines that its terms will not or cannot be carried out, that party shall immediately consult with the other signatories to attempt to develop an amendment per Stipulation VIII, above. If within thirty (30) days an amendment cannot be reached, any signatory may terminate the MOA upon written notification to the other signatories. Once the MOA is terminated, and prior to work continuing on the Undertaking, the County must either: A. Execute an MOA pursuant to 36 CFR § 800.6, or B. Request, take into account, and respond to the comments of the ACHP under 36 CFR § 800.7. The County shall notify the signatories as to the course of action it will pursue.
