UTM 18 308989 E; 3849080 N; Carteret Co Tax ID # 537701369241000 TO: Mr. Ed Beck Mr. Tony McNeill NCDWQ 401 Water Quality Section 523 Old Church Road 127 Cardinal Drive Extension Swansboro, NC 28584 Wilmington, NC 28405 (252) 725-4965 [m] Cc: Mr. Micky Sugg, USACOE Mr. Ian McMillan, NCDWQ Raleigh We respectfully request for NCDWQ to not withdraw the vending McNeil Pond 401 Water Quality Certification application request (DWQ #06 1841 and USACOE ID #200600207; 2005207016). This permit request has been an active and on-going process since 2006. We recognize the extended time period this permit process has taken, but the applicant nor his agent has any control over the speed at which the State and Federal agencies respond. Mr. McNeill has fully complied with all regulatory requests during this entire time period. After much discussion with NCDWQ and USACOE representatives during 2006, Federal 404 & State 401 permit applications were made in June - 2006. These permit applications were processed by these agencies until January - 2007. On March 22, 2007 the USACOE met with Land Management Group Inc (LMG, Larry Baldwin) to fully review the project's position at that time and to answer further Federal & State permit concerns. After further clarifications LMG issued its' report of findings and recommendations to the USACOE on July 25, 2007. The USACOE responded back on January 24, 2008. Mr. McNeill and LMG requested an extension of time to review the extensive USACOE's document on February 6, 2008. LMG submitted a 2"d response to the USACOE on March 20, 2008. To date (June - 2008), the applicant nor his agent have received a response back from the USACOE. Thus, the permit applications have not been idle, but in active process since 2006. Again, we have no control over the various agencies' response time. Please continue NCDWQ application DWQ #06 1841 until we can derive some type of final resolution from the various Federal & State agencies regarding this project.
