Cherri and I discussed both of these issues during our pre -application site visit on October 17,
2016. I'm hoping that she's able to chime in today before she leaves.
6,he confirmed the impact area (which was previously identified as a linear wetland) was now an
"intermittent stream".
The only reason why the impacts were "avoided" in the previous permit, was that the stream/linear
wetland was previously determined to be further down the drainage and has since moved up the
drainage into the development area.
To avoid the impacts now would require the previously permitted and City approved plans to be
completely reworked and the road would need to be shifted to the north not only at this impact
location but along a significant length of it to allow for proper alignment and curvature. This would
result in the loss of multiple lots (4 to 6) currently designed along the northern side of the road as they
would have insufficient depth, and not allow sufficient room for the stormwater bmp north of the road.

Please let me know if this response is not acceptable, notably as to the stream determination. If not,
I'll go back out there and complete a DWR stream determination form.

I have a couple of items of additional information needed for the subject project application received by the
Division on January 6, 2017.
1. Provide DWR determination indicating the stream associated with Impact Area #1 is intermittent or a
completed stream form.
2. Explain why Impact Area #1 could not be avoided as it was previously permitted or revise the plan to
avoid this impact.
