PO Box 1220 Lincolnton, NC 28093 Subject: Retraction of NOD -2017 -LR -0001 Discharge Monitoring Reports (DMRs) for September 2016 South Fork Industries — Maiden Plant NPDES Permit NC0006190 Catawba County Dear Mr. Owens: ROY COOPER Governor MICHAEL S. REGAN Secretary S. JAY ZIMMERMAN Director On January 7, 2017, the Division issued a Notice of Violation (NOV) against South Fork Industries, Inc. The NOV was based upon a violation of the reporting requirement by failing to file the September 2016 Discharge Monitoring Report (DMR) with the Division. within the thirty (30) day reporting period. The report that was due on November 1, 2016, but was received late on December 10, 2016. Subsequent to your receipt of 'the NOV,,a representative with South Fork Industries, contacted the Division indicating that the reason for the report being late was because there was a change in ownership for this facility and permit. The change in ownership resulted in a delay in being set up for reporting electronically. Therefore, the new owner did not have timely access to eDMR for the September 2016 report. Our records indicate that an ownership name change was processed on November -15, 2016 for this permit. Base on this information, I have withdrawn the NOV against South Fork Industries, Inc. for -the cited violation and directed that the record of this violation be removed from our files.
