Dear Mr. Elnitsky:
A review has been made on the Preliminary Report entitled"Notice of Deficiency(NOD)
—Responses for Recommendations 1, 2, and 3", dated July 25, 2014 and received by this office
on July 30, 2014 for the referenced dam. We concur with the conclusions outlined in this report.
This preliminary report contains a slope stability analyses report, a spillway capacity
analysis report, and a geophysical investigation report. The slope stability analyses indicate
factors of safety greater than the minimum criteria. The spillway capacity analysis indicated that
the spillway was undersized and therefore has since then been redesigned and was approved as
Scopes 1 and 3. The geophysical investigation concluded that there was no evidence that would
support the presence of pipes being buried in the embankment and were assumed to have been
removed during construction.
Before beginning repair work on the referenced dam, two (2) sets of plans and
specifications for repair work must be filed with the Division of Energy, Mineral, and Land
Resources for approval pursuant to Title 15A, Subchapter 2K of the North Carolina
Administrative Code.
