Duke Energy Carolinas, LLC. (Duke) requests to have the following terms included as a special
condition of the renewed NPDES wastewater permit for Buck:
1) Duke has begun the process of closing the coal ash surface impoundments at Buck, to be
completed by December 31, 2035, through the process of beneficiation as detailed in the
mediated settlement agreement of the United States District Court for the Middle District of
North Carolina, No. 1:14-cv-753-LCB-JEP (September 28, 2016);
2) Completion of the closure activities referenced above will eliminate the seeps from the ash basins
at Buck;
3) Within 180 days of completion of all surface impoundment closure activities at Buck, the facility
shall determine if a jurisdictional seep meets the applicable state water quality standards
established in 15A N.C.A.C. 2B .0200 and submit the results of this determination to the Division
of Water Resources for evaluation.
