Dear Mr. Poupart,
This letter is intended to follow up on the submittal dated November 10, 2016 in which
Duke Energy requested the repurposing of outfall 001 to receive cooling tower
blowdown flows at the subject facility. Subsequent conversations with DEQ staff on
November 18 and November 29, 2016 have led Duke to believe this is not an action
that your office will approve short of reissuance of the renewed Buck NPDES permit.
As discussed on November 29, 2016, Duke needs to begin the process of concurrently
seeking other required approvals to facilitate ongoing closure preparation work at Buck.
Duke hereby requests that the DEQ issue a response to this letter indicating
concurrence of your intent to reissue the Buck NPDES permit with relocated cooling
tower blowdown flow being directed to the Yadkin River through a new outfall as
requested in the renewal application submitted by Duke. Having documentation of the
DEQ's current intent to issue the NPDES permit will allow Duke to approach Alcoa to
begin the process of obtaining other necessary permits concurrently while the Buck
NPDES permit is being finalized.
Duke Energy requests you provide a response with concurrence of your current
intent to issue a renewed permit for the Buck facility which includes a new outfall
to the Yadkin River for combined cycle cooling tower blowdown flows.
