In response to our previous discussions and your letter of December 7, I am writing to confirm
that the Division fully intends to include provisions in the draft Buck permit that authorize the
discharge of cooling tower blowdown and other wastes to the Yadkin River at the existing
Outfall 001 and a new Outfall 006 to be installed adjacent to Duke Energy's boat dock. Permit
conditions for the outfalls will set forth necessary limitations and other requirements to ensure
the protection of water quality and conformance with applicable regulations. The draft permit
will, of course, be subject to public review and could be revised in response to comments
received. However, we believe that the discharge will have less environmental impact at the
new outfall locations than at the existing Outfall 002 due to the increased dilution available in
the mainstem of the river.
