Size and Location of Property (waterbody, road name/number, town, etc.): The proiect area (TIP No. B-3836) is
Bridge No. 35 over Panther Creek on NC 111, in Duplin County, North Carolina.
Description of Activity: Replacement of existing 75.4' x 24' bridge with a 2-span, 105' x 36' pile-supported
bridge, per your proiect description dated 9/11/2007 (attached).
Your work as proposed does not require Department of the Army authorization for the following reason(s):
_ There are no jurisdictional waters or wetlands within the boundaries of the project.
X The proposed project does not impact jurisdictional waters or wetlands.
_ The proposed project is exempt from Department of the Army regulation.
• This Department of the Army determination does not relieve the permittee of the responsibility to obtain
any other required Federal, State, or local approvals/permits. The permittee may need to contact appropriate
State and local agencies before beginning work.
For any activity within the twenty coastal counties, before beginning work, you must contact the N.C.
Division of Coastal Management in Wilmington, North Carolina, at 910-796-7215 to discuss any required
State authorization.
Any changes in the above described work must be coordinated with the Corps of Engineers prior to
commencement. If you have any questions regarding the Corps of Engineers regulatory program, please

Attached is a plan sheet for a bridge replacement project, that we have had discussions about recently. The
project is Bridge 35 in Duplin County on NC 111 over Panther Creek. This project was originally a TIP project
(B-3836) which has been turned over to the Division has a Purchase Order Contract (POC) that will be
administered by Bridge Maintenance.
The existing bridge is 75.4 ft long with a 24 ft cleared roadway (cl rdwy) and the proposed structure is 2 span 105
ft long bridge with 36 ft cl rdwy. There are no wetlands within the project limits, Al #200300880 (June 6, 2003).
Dave Timpy issued a Nationwide 23 permit for this project on March 14, 2006, for 12 ft. of stream impacts for the
widening of the structure from 24 to 36 ft. This permit expires on March 18, 2007. Due to funding the construction
LET date for this project was pushed back to January 2008 with a production LET of Nov.
2007, therefore NCDOT can not complete the project by March 18, 2008.
In talking with the two of you, it does not appear that this project requires authorization because it is not in Section
10 waters, driven piles do not require authorization, and we are lengthening the bridge so there will be no fill
placed in "waters of the U.S". In addition the bridge is proposed for top down construction (no temp. impacts for
work bridges) and there is an off site detour proposed. The only impact, which really is not a impact is the shading
of 12 ft of stream.
I have never constructed a bridge without authorization but this may be a valid candidate. Please let me know if
your agency concurs that this project does not require authorization (a
permit) and that NCDOT may proceed accordingly or if your agency does not concur and NCDOT needs to
resubmit a PCN.
Furthermore, for future projects like this one, if you can, please provide guidance on how your agency would like to
handle these types of bridge replacement projects (no permanent or temporary impacts to special aquatic sites, no
Section 10 waters, only shading as a result of widening).
