Dear Mr. Elnitsky:
This is in response to your submission dated April 17, 2015, received on April 17, 2015 and
resubmission dated May 20, 2015, received on May 27, 2015 of drawings and design data
describing the Ash Basin Dredging at the subject dam. This dam is of high hazard classification.
The drawings and design data submitted were prepared under the supervision of Mr. Brian F.
Chrisman, PE of AMEC Foster Wheeler.
This letter shall serve as notification that the proposed work will be regarded as a maintenance
activity for the subject dam and therefore will not require prior approval from this Division under
the provisions of the Dam Safety Law of 1967.
The Army Corps of Engineers and the Division of Water Resources of this Department should be
contacted to determine if permits are required. Also, the erosion and sediment control program
having jurisdiction should be contacted to determine permit requirements. In any case, sediment
must be prevented from entering the waters of the state or flowing onto neighboring property.
