Notice of Modification Pursuant to 15A NCAC 2H .0114
Mr. Stowe,
The Division of Water Resources is hereby giving Duke Energy Carolinas 60 days notice as
required by North Carolina Administrative Code (NCAC) 15A 2H .0112 (b)(3) that the Division
will reopen the existing permit for the above referenced facility. The Division is taking this action
consistent with provisions of 15A NCAC 2H .0114 in response to violations of Dan River Steam
Station Permit NC0003468yas well as changed conditions at the site related to the coal combustion
residuals (CCR) spill to the Dan River that occurred on February 2, 2014.
The Division's focus during this reopening is to address Outfall 002, currently described as an ash
basin discharge, and determine what changes are necessary in light of information gathered during
our investigation of the Dan River spill. The Division anticipates that a modified permit will either
eliminate the discharge at Outfall 002 or include additional terms and conditions sufficient to ensure
the elimination of any further unauthorized discharges. The Division recognizes that eliminating
the outfall in a safe manner that would prevent unauthorized discharges would represent a
significant engineering function and it may be necessary to include a reasonable compliance
schedule into the revised permit.
