Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This final permit includes no major changes from the draft permit sent to you on April 25, 2012. The Dan River is listed as an impaired stream on North Carolina's 303 (d)list. Currently, the stream does not meet all water quality standards. If the limitations in the current permits for facilities discharging to the Dan River do not result in improved water quality, removal of discharges to the Dan River may be necessary for the health of the stream. The Division will continue to monitor compliance at your facility. If noncompliance with your permit's effluent limits is shown to be a direct cause of stream degradation, the Division will recommend removal of your facility's discharge. Part III of your permit requires you to"continually evaluate all wastewater disposal alternatives and pursue the most environmentally sound alternative of the reasonably cost effective alternatives" to surface water discharge. Such an evaluation may help you find an alternative to surface water discharge that is more appropriate for your facility. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). If manufacturing or other activities are resumed at the site, a description of the manufacturing processes or activities, products, and expected annual production. 2. Flow diagram indicating process and wastewater flow volumes. 3. Proposed treatment and characteristics of the wastewater to be discharged. 4. Description of any planned expansions or upgrades to the treatment facilities. 5. Engineering Alternatives Analysis of wastewater disposal alternatives including a flow justification, the connection to an existing municipal waste treatment facility and non-discharge alternatives. 6. This was a Fieldcrest Mills plant a few years ago,but now it is a trucking terminal for MGM. Less than 30 employees(office staff and drivers)use the facility. The WWTP is a class II plant which by regs requires the plant to be visited by the operator daily. No effluent discharge has been observed since Eden Real Estate took ownership in 2004. I have been there on several occasions and have not seen a discharge. Apparently due to low flows, dry weather, evaporation from the large aeration basin and ground absorption there as been no effluent flow. WSRO has received a letter requesting that the WWTP be visited weekly instead of daily until such time as there is an effluent flow. I have discussed this with Tedder and we have no problem with this request. If and when the WWTP starts discharging the plant must be visited daily. If you do not any problem with this request,I will draft a letter to MGM granting approval. I will Fax you a copy of the request letter. This facility is used as a trucking terminal and has very few employees onsite, Combined with the very low flow and large aeration basin 0 5 MGD per day and the dry weather, this facility has not discharged since Eden Real Estate Associates, LLC took ownership in 2004. This letter is to request a change from the daily visits required for a grade 2 facility to once per week visits while the sewer plant is not discharging.
