PROJECT DESCRIPTION The project site consists of two vacant lots located at 107 and 109 Saltation Circle, adjacent to the Atlantic Intracoastal Waterway, in Holden Beach, in Brunswick County. Directions from the Holden Beach bridge are as follows: turn right onto Ocean Blvd. West and travel approximately 5.7 miles to Saltation Circle. Turn right onto Saltation Circle and the project site is located on the left. The project site consists of two contiguous vacant lots. Lot 143 measures approximately 20,990 sq. ft. and contains approximately 12,464 sq. ft. of coastal and §404 wetlands, and approximately 8,526 sq. ft. of uplands. Lot 144 measures approximately 43,822 sq. ft. and contains approximately 43,400 sq. ft. of coastal and 404 wetlands, and approximately 422 sq. ft. of uplands. Upland vegetation consists of a few shrubs, Wax Myrtle (Myrica cerfera) and Salt Meadow Grass (Spartina patens). The vegetation then transitions to Spike Grass (Disiticlis spicata), Sea Lavender (Limonium, spp.), Glasswort (Salicornia, spp.) and Smooth Cordgrass (Spartina alterniflora). The highground of the portion project site is located outside of the 75' Estuarine Shoreline Area of Environmental Concern (AEC). However, due to the close proximity of the proposed development to the coastal wetland line, proposed fill in §404 wetlands and the potential for the degradation of adjacent open shellfish waters it is deemed necessary to review the project through the CAMA Major Development Permit process. Existing structures on the lot consist of a wooden retaining wall on Lot 144 located landward of the §404 and coastal wetland line and approximately 166 feet landward of the normal high water (NHW) line on the north eastern side of the lot, and measures approximately 135 linear feet and has not been backfilled. The elevation of the high ground area of the lot averages approximately 4 feet above NHW. The existing retaining wall was permitted and constructed under CAMA Minor Permit No. 2008-005 issued to the previous owner (Andrew B. Hamer) on February 13, 2008 by the Local Permit Officer (LPO) for the Town of Holden Beach. CAMA Minor Permit No. 2008-005 also authorized the construction of a single-family residence with a footprint of approximately 1422 sq. ft. and a driveway with a footprint of approximately 360 sq. ft. all of which, were to be located landward of all coastal and §404 wetland areas. The waters of the Atlantic Intracoastal Waterway are classified "SA" by the North Carolina Division of Water Quality. The area is not designated as a Primary Nursery Area by the North Carolina Marine Fisheries Commission and it is open to the harvesting of shellfish. PROPOSED PROTECT The applicant proposes to install an additional 14 linear feet of retaining wall, place approximately 600 sq. ft. of fill material in §404 wetlands, construct a single-family residence and driveway. As proposed, a wooden retaining wall addition would connect to the eastern end of the existing wooden retaining wall and would extend in a southerly direction approximately 14 feet (see Sheet 2 of 5) and would maintain the existing height of approximately 1-2 feet above grade (see Sheet 4 of 5). The application states that the retaining wall would then be backfilled, an area measuring approximately 94' x 75' or approximately 7,050 sq. ft., which would also include the filling of approximately 600 sq. ft. of §404 wetlands (see Sheet 1, 4 & 5 of 5). The §404 wetland impacts would consist of 3 individual sites; Site 1 = 599 sq. ft., Site 2 = 0.28 sq. ft., and Site 3 = 0.70 sq. ft. As proposed, the §404 wetland fill would then allow for the construction of an "L" shaped single-family residence measuring approximately 17' in width by 50' Mr. Sidney Jones Page 3 in length on the eastern side, and approximately 32' in width by 40' in length on the southern side of the structure with an approximate total footprint of 1586 sq. ft. (see Sheet 3 of 5). The applicant states that the house would be built on pilings with a concrete slab underneath. The proposed elevation of the concrete slab is 6' above mean sea level (MSL). The applicant is also proposing to construct a driveway measuring approximately 10' in width by 155' in length and would be located on the southern side of Lot 143 (see Sheet 1 of 5). 10. ANTICIPATED IMPACTS The backfilling of the retaining wall would result in the incorporation of approximately 600 sq. ft. of §404 Wetlands. The construction of the retaining wall and backfill, the single-family residence and driveway would result in the disturbance of approximately 7,050 sq. ft. of highground. Due to the close proximity of the proposed development to coastal and §404 wetlands and adjacent open shellfish waters there is a concern for potential degradation of these resources. The permit is also requesting to add an additional 14 linear feet to an existing wooden retaining wall. The existing retaining wall was constructed under a Minor CAMA Permit: 2008-005. Construction will result in approximately 5,910 square footage of disturbance and 600 square feet of wetland fill. Normally, this type of construction would not require a Major CAMA permit. Given the fact that the resulting fill will impact wetlands, the applicant has been instructed to apply for a Major CAMA permit. The applicant has provided a PCN as a courtesy notification because written approval for the 401 Certification/Impact is not required with wetlands impacts less than 1/10`h of an acre.
