V. Sutton Energy Complex NPDES Permit NC0001422 Effluent Channel Fish Screen Proposal Dear Mr. Fleek: Perm In accordance with the requirements of the NPDES permit for the L.V. Sutton Energy Complex (Sutton), Duke Energy Progress, LLC (Duke Energy) hereby submits the attached proposed design for a fish screen in our effluent channel. This submittal is required by section A(9), Note 5, of our NPDES permit which became effective on December 7, 2015. Note 5 of Section A(9) requires that "The facility shall install a screen or barrier at the end of the Effluent Channel to minimize fish migration into the Channel. The design of the screen/barrier shall be submitted to the Division for approval no later than 6 months from the effective date of the permit. The screen/barrier shall be installed no later than 6 months after Division approval." As you are aware, Duke Energy is required by the Coal Ash Management Act to close the two Sutton ash ponds by August 2019. Closure of these ponds will be accomplished by excavating and removing the ash to offsite locations and/or a proposed onsite landfill. The effluent channel, which conveys wastewater from the Sutton Plant to the cooling pond (Sutton Lake) is flanked on either side by legacy ash disposal areas. Full excavation of the ash will require that the portions of the berms on either side of the effluent channel be removed and rebuilt. Significant work will be performed within the effluent channel itself, including barge and equipment access. Current proposals include the construction of sheet piling walls within the channel to facilitate full ash removal. Due to the extent and complexity of these activities, and the urgency and priority with which Duke Energy must perform the excavation activities, Duke Energy requests that the Division allow the installation of a fish barrier after pond closure is complete and the effluent channel has been re-established. Once you have had an opportunity to review this submittal, we would request the opportunity to meet with you to discuss the proposal, the ash excavation activities, and any other questions you may have. Duke Energy remains committed to safely closing ash basins at all of our North Carolina sites.
