PROJECT SUMMARY: The applicant proposes to construct a mixed residential / commercial subdivision on 23 acres located east of NC 12 and 72 residential lots on 34 acres located west of NC Highway 12 along Cruz Bay Drive. The water dependent structures that will be constructed along Cruz Bay Drive include: Approximately 768 feet of vinyl bulkhead, A 69-foot long community walkway connecting to a pier 82 feet long and 6 feet wide that terminates in a 400 SF covered gazebo, and A 560-foot long community walkway that crosses over an existing pond and wetlands before connecting to a pier 92 feet long and 6 feet wide that also terminates in a 400 SF covered gazebo. Background On December 29, 2005 Corolla Bay LLC submitted their initial Major Permit application to the Division of Coastal Management (DCM) requesting the installation of two community piers and 750 feet of bulkhead / riprap that would have resulted in the filling of 368 SF of COE Section 404 wetlands. The submitted narrative stated that the applicant had simultaneously applied for a COE Nationwide Permit to obtain authorization for the requested wetland fill. On January 11, 2006, DCM staff sent a letter to the applicant listing a series of deficiencies that had been observed in the original permit application. i. ly Field Investigation Report Corolla Bay, Corolla, Currituck County Page 3 On July 31, 2006 Corolla Bay LLC re-submitted a complete Major Permit application to DCM that addressed the deficiencies listed in the January 2006 correspondence. The revised application requested the installation of 715 feet of bulkhead fronted by 7 feet of riprap and two community piers that were each 80 feet long and 6 feet wide that terminated in 20-foot by 20-foot platforms partially covered with gazebos. The narrative submitted by the applicant stated, "that currently the applicants are in the process of resolving cumulative impacts concerns with the USACE and NC Division of Water Quality." The DCM Field Report describing the complete application package was distributed to resource agencies on August 4, 2006. On August 29, 2006 DCM staff in Morehead City placed the permit application in abeyance after it was determined that additional information would be required to address all of the proposed upland development, including all of the proposed wetland fill. The additional information was requested, "to determine if any portion of the entire development proposal would cause adverse impacts to resources in the immediate area, including resources within the AEC." Because DCM did not receive any response to the request for additional information, DCM staff in Morehead City officially retired the original Corolla Bay permit application on October 17, 2007. DCM staff in Elizabeth City received a new Major Permit application from Corolla Bay LLC on February 12, 2008. In the application the applicant claims that necessary permits are being simultaneously applied for from DCM, COE and the NC Division of Water Quality. The information presented in this Field Report addresses the development proposals contained in the new application. On June 3, 2008 the COE sent out the following e-mail announcement regarding SAW 2008- 00770, "The Wilmington District, Corps of Engineers (Corps) received an application from Corolla Bay LLC, 821 Ocean Trail-Suite 4, Corolla, Currituck County, North Carolina, 27927, requesting Department of the Army (DA) authorization to place earthen material in jurisdictional wetlands in order to construct a residential subdivision and associated infrastructure. Total proposed impacts are as follows: approximately 56,192 square feet (1.29 acres) of non-riparian wetlands, 2613 square feet (0.06 acres) of riparian wetlands, 68,824 square feet (1.58 acres) of isolated wetlands, and 4791 square feet (0.11 acres) of temporary disturbance of non-riparian wetlands for storm water piping. The proposed project will be located at on the east and west sides of Ocean Trail (NC Hwy 12), approximately 1.45 miles south of the Currituck Lighthouse, adjacent to Currituck Sound, in Corolla, Currituck County, North Carolina. Specific plans and location information are described below and shown on the attached plans. This Public Notice and all attached plans are also available on the Wilmington District Web Site at www.saw.usace.army.mil/wetlands" Project Setting The proposed 72 residential lots will be developed on approximately 34 acres located on the west side of NC Highway 12 in Corolla, Currituck County along the recently installed Devil's Bay Drive and Cruz Bay Drive. These subject properties are located north of Ocean Forest Court and south of Hampton Street, approximately 1.5 miles south of the Currituck Lighthouse. These western tracts are bordered by the Currituck Sound to the west, NC Highway 12 to the Field Investigation Report ' Corolla Bay, Corolla, Currituck County Page 4 east, a vacant commercial lot to the north, and residential lots to the south. Approximately 17 acres of the tracts are COE Section 404 wetlands and/or Coastal Wetlands, and 17 acres are upland areas. The waters of the Currituck Sound immediately adjacent to the parcels' shoreline are less than one-foot deep and gently slope to a depth of approximately one-foot a distance of 100 feet off shore. The sound is approximately 4.5 miles wide at this location, is classified as SC (Fish Propagation) by DEM, and is closed to shellfish harvesting. The 10-foot area immediately adjacent to the parcels' shoreline does not contain submerged aquatic vegetation (SAV). Waters further offshore contain moderate to heavy SAV growth containing primarily Widgeon Grass (Ruppia maritima) with patches of Redhead Grass (Potamogeton perfoliatus), Wild Celery (Vallisneria americana) and Eurasion Watermilfoil (Myriophylluna spicatum). The approximately 4,000 feet of shoreline on the subject property and the shoreline north of the project site have not been hardened. The shorelines of the residential properties south of the parcels have been bulkheaded. The shoreline along the southwestern portion of the properties contains a stable escarpment two to three feet tall. No Coastal Wetlands are located along this portion of the shoreline but there is a 367 SF area of COE Section 404 wetlands in the far southwest corner of the parcel. A 13-acre area of COE Section 404 wetlands and Coastal Wetlands is located in the northwest portion of the parcels. This wetland area is comprised of Coastal Wetlands located along the shore of the Currituck Sound that transition to Section 404 wetlands further upland. This transition occurs west of the lots depicted on the applicant's drawings. Coastal Wetlands located in this area are comprised of Salt Reed Grass (Spartina cynosoriodes) with Black Needlerush fringes (Juncus romerianus) and pockets of Common Reed (Phragmites australis). The 13-acre area of wetlands also contains a pond that is located in the far northwest corner of the parcels. Aerial observations of this area revealed that the pond is not hydraulically connected to the adjacent Currituck Sound. An additional 4.03 acres (175,738 SF) of Section 404 wetlands are scattered across the parcels located west of NC Highway 12. This includes a 2.03-acre (88,584 SF) wetland located in the far southeast corner of the subject properties that surrounds another pond. Aerial observations of this area revealed that this pond is not hydraulically connected to the Currituck Sound either. The vegetation on the tracts west of NC 12 was mowed to a height of less than six inches 4 - 5 years ago, except for trees with trunk diameters greater than four inches. The remaining trees include Red Maples (Acer rubrum), Live Oak (Quercus Virginiana), pine trees (Pines species), and scattered Sweet Gum (Liquidambar species). An under story of assorted weeds, shrubs, and bushes that are 5-10 feet tall has re-established itself in the southern one-third of the property, but the northern two-thirds (including the Coastal Wetlands and COE Section 404 Wetlands) has been regularly mowed to keep the indigenous vegetation to heights of less than three feet. Elevations across these parcels range from 1-foot along the shores of the Currituck Sound to 10 feet along NC Highway 12. Field Investigation Rep"brt Corolla Bay, Corolla, Currituck County Page 5 The infrastructure for the residential development proposed for the west side of NC 12 has already been installed. Devil's Bay Drive and most of Cruz Bay Drive have been installed along with the underground utility lines and lift stations. Large single-family houses have been constructed on the northeast corner of Cruz Bay Drive and Devil's Bay Drive, at the north end of Cruz Bay Drive adjacent to the existing pond, and on the west side of Cruz Bay south of the intersection of Cruz Bay and Devil's Bay Drives. The mixed residential / commercial subdivision will be situated on 23 undeveloped acres located on the east side of NC 12, across from the recently installed Devil's Bay Drive. These parcels are relatively flat and are vegetated with mature Live Oak (Quercus Virginiana), pine trees (Pinus species), Wax Myrtles (Myrica species), Yaupon Hollies (Ilex vomitoria), and indigenous weeds and grasses. Approximately 89,911 SF (2.06 acres) of COE Section 404 Wetlands are scattered across the northern portion of these parcels. Proiect Description The applicant proposes to create 72 residential lots situated on the 34 acres located west of NC Highway 12 along Cruz Bay Drive. The water dependent structures the applicant proposes to install includes approximately 768 feet of bulkhead along the shore of the Currituck Sound in front of lots 37 - 46 situated in the far southwestern corner of the subject parcels. The bulkhead will connect to the existing bulkhead that has been installed on the adjacent residential properties. The bulkhead will be placed in front of a 367 SF area of COE Section 404 wetlands located on lot 46 in the far southwest corner of the property. The applicant proposes to install the bulkhead an average of two feet beyond normal water level and a maximum of five feet beyond normal water level. The required backfill will be obtained from upland sources. The applicant also proposes to install two community walkways / piers associated with the lots located west of NC Highway 12. The first structure will be installed between lots 44 and 45 located in the southwestern corner of the parcels off of the proposed Antigua Court. It will consist of a 69-foot long walkway connecting to a pier 82 feet long and 6 feet wide that terminates in a 400 SF covered gazebo. The walkway will connect to Antigua Court via a wood mulch path. The Currituck Sound is approximately one-foot deep at the end of the proposed pier. A second structure, located at the far northwestern corner of the properties, will connect to the north end of Cruz Bay Drive via a 400-foot long elevated walkway that crosses over the existing pond and wetlands before connecting to a pier 92 feet long and 6 feet wide that also terminates in a 400 SF covered gazebo. The walkway will connect to Cruz Bay Drive via a wood mulch path also. The Currituck Sound is approximately one-foot deep at the end of the proposed pier. The applicant also proposes to construct a mixed residential / commercial subdivision on the 23 acres located east of NC Highway 12. The proposed development will be constructed along a new road that will be named Herring Street and will include 57 detached condominium units, four 3-story condominium buildings, restaurants, retail space, and recreational amenities. ANTICIPATED IMPACTS It is anticipated that the proposed project will cause the following impacts: • The bulkhead will result in the filling of 1,536 SF of Estuarine Water /Public Trust Area AEC and require 28 cubic yards of upland soil be placed below normal water level. • Backfilling behind the proposed bulkhead alignment will result in the disturbance of 6,144 SF of the Estuarine Shoreline AEC, while construction of residences on the proposed sound front lots will eventually result in the disturbance of an additional 50,106 SF (1.15acres) of the same AEC. • The two piers and platforms will temporarily disturb a total of 1,844 SF of Estuarine Water / Public Trust Area AECs during their construction and will shade the same area upon their completion. • Construction of the two piers and platforms will temporarily increase the turbidity of the shallow waters of the Currituck Sound. • The northern elevated walkway will shade 660 SF of the 75-foot Estuarine Shoreline / Coastal Wetland AEC. This walkway will also disturb 1,260 SF of the pond it crosses, and shade the same area upon its completion. • The proposed development will fill approximately 126,508 SF of COE Section 404 Wetlands located on the parcels both east and west of NC 12 and temporarily disturb 4,791 SF of COE Section 404 Wetlands located on the west side of NC Highway 12. Approximately 1,121 SF of these wetlands are located in the Estuarine Shoreline AEC. • The future owners of the 12 direct sound front lots (lots 35 - 46) and the owners of the 24 sound side lots could request a total of 36 additional piers to be installed in the very shallow waters of the adjacent Currituck Sound that are currently heavily vegetated with SAV. • Preliminary review indicates that no archaeological resources are known to be located in the vicinity of this proposal. This will allow for all proposed wetland fill activities to be covered by one permit, one plan and resulting mitigation requirements. The applicant, Corolla Bay LLC purchased the property from the former owner and proceeded to conform the proposed development scenario to current zoning and development standards as required by Currituck County. In attempt in applying for US Army Corps, CAMA, NCDWQ and other permits to develop the property, confusion resulted from multiple owner designations and development drawings. The applicant and engineer have displayed on this plat the extents of the conceivable potential build out of the property. The current proposal is for 72 single family lots in sections 1 and 2. Section 3 is proposed for mixed use (commercial parcels, 57 patio homes, 4 condominium buildings, recreational sites and commercial properties) with roadways, driveways and parking. In 2006 a US army Corps Nationwide #14 application was applied for and received for a road crossing that impacted 404 wetlands in Section 1 of the project. Section 1 lots 1, 8-36 of the development were recorded in the Register of Deeds office in Currituck County (Section 1, Lots 2-7 have not been recorded as of this date). As further application requests were submitted for completing sectionl wetland impacts and additional impacts associated with Section 2, complexity of the fill requests prompted the US Army Corps request for an Individual Permit application for the impacts. The applicant requests wetland fill in 1.322 acres of Section 404 wetlands and 1.227 acres of Isolated wetlands, excavate 0.354 acres of Isolated wetlands for the proposed stormwater management basins. An individual wetland fill permit has been filed with the US Army Corps of Engineers for the 404 wetland impacts, and the NC Division of Water Quality 401 wetlands unit has also been supplied with an application and application fee for the proposed 404 jurisdictional wetland impacts and also the isolated wetland fill impacts. These applications will run concurrently with the CAMA Major application. As a part of the shoreline stabilization in the southwest corner of the property, 0.042 acres of section 10 waters will be filled for bulkhead backfill along an erosion escarpment. The bulkhead alignment will average of 2 feet waterward of the NWL and will extend a maximum of 5 feet waterward of the NWL. Temporary disturbance of 5046 SF of wetlands will occur for placement of a stormwater pipe to control stormwater. Section 1 Section 1 is comprised of single family residential lots and right of way. Section 1, Lots 1, and Lots 8-36 have been platted and recorded and no wetland fill is proposed on these lots in this application. Section 1 lots 2-7 were not platted and recorded due to potential wetland impacts and the fill is being requested on those lots in this application for residential development purpose of fill in this section is for residential development and right of way construction. A Nationwide #14 permit (Action ID 20061338) ha previously been issued for roadway impacts in Section 1. Section 2 The proposed fill in Sections 2 (west of Hwy 12) will be for residential lot improvements and right of way/ utility improvements. 2730 SF, 2033 SF and 283 SF of temporary disturbance will occur in wetlands in order to install a stormwater pipe below the wetland substrate. Disturbed areas will be graded back to original grade and re-vegetated. The stormwater design in Phases 1 and 2 is limited by the existing topography and the need to utilize the existing pond for as a treatment basin. The development will be low density and will utilize a combination of lot line swales typically associated with low density subdivisions as well as the piping of stormwater to the existing pond area which will also have an overflow route for extreme rain events. The stormwater will be treated as much as possible by the lot line swales and existing pond. Section 3 Isolated wetlands fill for development of a mixed use site. Residential and commercial properties will be available within the site and the proposed fill will allow for development of these properties. Stormwater management ponds are also proposed by the engineer and will require excavation of 0.354 acres of the wetlands that are located within the limits of the proposed infiltration basins to attain the calculated volumes. All stormwater on the site will be diverted to, stored and treated by infiltration in these ponds. The east side development stormwater management is via wet ponds. A bmp wet pond is proposed for NCDENR quality management and multiple aesthetic ponds are proposed for quantity management. The pre-post development stormwater controlled release for the 10 year storm event is the minimum stormwater requirements for quantity management by Currituck County. The proposed stormwater management intent is to store the maximum stormwater possible on-site, releasing stormwater off-site via control outlet structure situated in the bmp pond. Stormwater is control released into the existing storm drain and conveyed easterly to the existing pond and eventually out to the Currituck Sound. Quality management has met NCDENR design standards with stormwater residency time drawing down in 3.3 days and quantity management exceeds Currituck Count regulations, as the 100 year storm event is managed. The impervious acreage for the east side development of Corolla Bay including the patio homes and commercial development is 686,181 sf or 15.75 acres, 68.12% of the 1,007,334.35 sf site. The impervious coverage calculations on the attached plans and is itemized !in two areas of development, the patio home development and the commercial development. The watershed area is the total site, 1,007,334.35 s.f. The bmp ponds surface area is 15,270 s.f. Lager aesthetic pond surface area is approx. 21,160 s.f. Smaller aesthetic pond surface area is approx. 1,465 s.f. Parcel Ownership A group of LLC's hold title to the Corolla Bay property on both the east and west sides of NC 12, creating 4 separate parcels totaling approximately 57.4 acres. Please see title information below. All of the LLC's have the same address and same principal contact, Eric Avery. The original development proposal was known as Monteray Shores. Over the 1990's, portions were sold to different developers. The Monteray Shores Planned Unit Development (PUD) was approved in 1987 at a density of 3 units/acre or 608 lots for the parent tract of the development and the development configuration has been adjusted over time for donation of land to Currituck County, sale of land and avoidance and minimization.
