The following restates your questions/comments and is then followed by our response. Additional Information Requested on June 6, 2008 The driveway crossing labeled as Driveway Crossing No. 3 on the plans does not appear to be necessary. Please eliminate the crossing or provide additional information as to why it is necessaryfor this project. The inclusion of Driveway Crossing #3 was an oversight as access was already provided to the lots in question via Driveway Crossings 92 and 4. Please note however, there has been additional discussion and correspondence with Mr. Monte Matthews of the USACE. The engineer (Mr. Joe Faulkner of the CE Group) has redesigned the driveway crossings so that they use bridges as opposed to the previously proposed culverts. This effort is more costly with regards to construction but will allow for a greater minimization of impacts for the overall project. This will also result in the overall permanent project impacts to perennial streams totaling less than 150 LF and will therefore be below the mitigation thresholds for DWQ. Please note that the overall permanent important/perennial stream impacts have been reduced to 98 linear feet. 2. You have proposed (through NC EEP) mitigation in an adjacent cataloging unit (Cape Fear10303004). The DWQ's new policy with respect to mitigation in adjacent cataloging units (see Item No. IX in our February, 2008 Public Notice) states that the "Guidance On The Use Of Compensatory Mitigation In Adjacent Cataloging Units" will be effective April 25, 2008. Please review that policy and after discussions with NC EEP and DWQ staff, we will need a new written agreement from NC EEP to conduct this mitigation using the multipliers in that policy. We have redesigned the driveway crossings to employ the use of bridges rather than the previously proposed culvert crossings in an effort to further reduce permanent impacts. Driveway crossing numbers 1 through 7 propose bridged crossings, which will reduce the permanent impacts by 157 linear feet. The new proposed permanent stream impacts total 98 linear feet, which is below the DWQ's 150 linear foot mitigation threshold. The USACE has determined that no stream mitigation will be required on this property given the additional efforts to minimize and avoid impacts. Please provide additional information on minimization by reducing the shared driveway widths and co-locating utilities in the same trench. The engineer (Mr. Joe Faulkner of the CE Group) has redesigned the driveway crossings so that they use bridges as opposed to the previously proposed culverts. This effort is more costly with regards to construction but will allow for a greater minimization of impacts for the overall project. This will also result in the overall permanent project impacts to perennial streams totaling less than 150 LF and will therefore be below the mitigation thresholds for DWQ. Recent conversations with Mr. Joe Faulkner of the CE Group also addressed the suggestion of co-locating the utilities in the same trench. The following is an excerpt from that conversation: "The issue relative to the USACE requesting both the water and sanitary sewer to be placed on the same side and in the same trench is not allowed by Public Water Supply. Henry Ou with Public Water Supply has denied our plan approvals when the 10 foot minimum separation is not met; since they are 10 feet apart they also can not to be laid in the same trench. Laying public water and sanitary sewer lines in the same trench is also not allowed. Heater Utilities has requested the mains to be located on either side of the road to prevent the tapping of the wrong main for water and/or sewer service. " 3. Please provide further information on potential impacts beyond the property line for roadways that stub out, but will be continued under another project (i.e. is there an impact that could be avoided by altering the alignment of the roadway covered under this permit). The only road on the property that proposes a stub is along the eastern property line at a point southeast of proposed Bridge Crossing #2 (see attached overall map). All remaining boundaries of the property are adjacent to individual lots which are accessed by private driveways. The stub road southeast of Bridge Crossing #2 is parallel to an intermittent stream (at its closest point located approximately 120 feet northeast of the road alignment). The origin of this intermittent stream occurs a short distance beyond the eastern property line; therefore, the potential for the offsite future extension of this road stub is highly unlikely to result in any stream impact. To avoid impacts to this stream, the road alignment in this area was redesigned several times prior to the draft sent for approval. 4. Additional time is required for completing the jurisdictional determination and may include additional Repanos Forms for impact sites. As per the 06-24-08 phone conversation, please find attached a form for the RPW's onsite. In the past, it has been the USACE's policy that a jurisdictional determination was not required in order to process the permit application and as such we are not expecting the potential delay in processing the JD to cause a delay in issuing the requested permit. That being said, we would like to have the JD processed as quickly as possible.
