As you know, this property is adjacent to the Village Point Drive construction and we came across some concerns within that project. The attached pictures show that the culvert in this location has not been installed in accordance with the approvals issued by the USACE and DWR. Both the 404 NWP and the 401 WQC require culverts to be placed below the stream bed by at least 20% of the culvert diameter. At the time the streams were flowing at high volume due to recent rain events and yet the flow going through the culvert was very shallow. This will need to be analyzed and addressed/corrected. Since the project is still under construction we may be able to avoid issuing a Notice of non-compliance if we can resolve the situation quickly. In addition, there is a check dam below this culvert that was not functioning on the day we were there. Water was flowing around both sides of the check dam and the downstream channel was very turbid. I'm copying Matt Gantt on this email so that he may see the photos and follow up with this as he deems necessary. We did not investigate the situation further.
