Here is the email from Tiffani from yesterday regarding stream credits available in Neuse 01 (see below). I
have also attached the NCDMS form that includes the Compliance Statement with regard to the regulations
associated with acquiring credits for mitigation in NC. This is me as a professional, confirming that we have
complied with the NC regulations. Additionally, I have attached a more recent email from Restoration
Systems and one from Resource Environmental Solutions.

Just so you are aware, we do our due diligence for our S&EC clients. What’s amusing is that RS has written
Statement of Availability (SOA) letters for the same Neuse 01 credits for 3 different project managers here at
S&EC. Who knows how many more SOA letters are out there for that same 138.4 stream credits. And then,
when RS sells those credits and the multiple projects are issued 404 verifications and 401 Approvals, we as
consultants and permittees, have to reach back out to both agencies to get new verifications and Approval
letters updating the mitigation plan. Basically adding more of a work load for DWQ and the Corps agents, and
costing the private citizens and developers of NC more money to do this additional work. So although I loathe
the fact that I have to work with RS, because not all private mitigation banks operate that way, I do because of
the regulations that require me to.

Tara is no longer with RS. We currently have 138.4 stream credits available at this time. The Corps is conducting the
annual site visit for our Pancho bank today and we should have another release of 841.9 stream credits within the next
week. Credits are $400/smu.
