Contents • Description of an Individual Permit • Part I: Project Information • Part II: Alternative(s) Analysis • Part III: Project Impacts and Mitigation • Instructions DESCRIPTION OF AN INDIVIDUAL PERMIT Authorities: 33 USC 401, Section 10 of the Rivers and Harbors Act of 1899; Section 404 of the Clean Water Act, and Section 103 of the Marine Protection Research and Sanctuaries Act of 1976 (not applicable in the Wilmington District). Principal Purpose: These laws require permits authorizing activities in, or affecting, navigable waters of the U.S.; the discharge of dredged or fill material into waters of the U.S.; and the transportation of dredged material for the purpose of dumping it into ocean waters. Routine Uses: Information provided on this form will be used in evaluating the application for a permit. Disclosure: Disclosure of requested information is voluntary. If information is not provided, however, the permit application cannot be processed nor can a permit be issued. Activities that do not qualify for authorization under the General Permit program may qualify for authorization by Individual Permit (IP). Authorization under IP may be obtained only through application with the USACE. These permits are issued for activities that have more than minimal adverse impacts to waters of the U.S., and evaluation of each permit application involves more thorough review of the potential environmental and socioeconomic effects of the proposed activity. An application for a Department of the Army IP under Section 404 or Section 10 will be determined to be complete when the USACE receives sufficient information to issue a public notice (see 33 CFR 325.1(d) and 325.3(a) for details and supporting information). The applicant should address all activities that the applicant plans to undertake that are reasonably related to the same project and for which a Department of the Army permit would be required. An alternatives analysis and a mitigation plan are not required for a complete application to prepare a public notice but are very helpful. One set of original drawings or good reproducible copies which show the location and character of the proposed activity must be attached to this application (see sample drawings and instructions) and be submitted to the District Engineer having jurisdiction over the location of the proposed activity. As part of the Individual Permit process, SEGi applied the Section 404(b)(1) guidelines, by utilizing historical aerial photography and available current land use records, to best determine if any off-site alternatives existed History of the site: This tract is part of the U.S. War Departments Camp Davis, which was first established in 1890 as a fuel stop for the Atlantic Coast Line railroad. In 1940, the U.S. War Department announced plans to build a major anti-aircraft artillery (AAA) training center at the site. AAA training began winding down in early 1944 and the AAA School, and by 1947-48 the camp was torn down, moved, or surpluses. Currently the site is devoid of any structures. The Applicant purchased this site in 2004. A. No Impact Alternative 1. Alternative Site Analysis When researching alternative sites, such considerations as the presence, quantity and quality or function of wetlands and/or other waters of the U.S., zoning designation, the presence of any federally -listed threatened or endangered species or their critical habitat, state listed species, or other natural or regionally important eco- system resource factors that may be significantly impacted, and site infrastructure and other components for a single and complete project. On -Site Alternatives During the design of the project, several on-site alternatives were considered. Alternative 1 — Current Proposed Design: This alternative was designed to utilize as much of the uplands within the property as possible, while impacting the least amount of wetlands. Alternative 1 was accepted as it was the least environmentally damaging practicable alternative (LEDPA). 2. Alternative 2 — Bridging the Wetlands. This alternative was explored, but due to the configuration of the ditches and wetlands within the property limits, bridges are not a viable option for avoiding impacts to wetlands. Therefore this alternative was rejected. 3. Alternative 3 — "No Action". Not developing the property would remove the ability for the Applicant to market or utilize the site as an industrial park, which would result in a loss of return on the Applicant's in- vestment. Alternative 3 was rejected, as it would prohibit the Applicant from achieving the desired project goals and create an economic hardship for the Applicant. Based on the results of the off-site and on-site alternative analysis, it is apparent that Alternative 1 is the LEDPA. B. Mitigation for Unavoidable Impacts to Waters of the US In total, 3.53 -acre of relatively permanent waters (RPW) or water conveyances (i.e. ditches) and 0.41 acre of non - riparian wetlands will be permanently filled. Due to the lack of functional value of the RPWs, the Applicant is not proposing mitigation for those impacts.
