Thomas and Julie Gardner. In order to reduce habitat impacts, the Gardners have revised their
request, and a resubmittal was received in the Elizabeth City office on January 17, 2017. Please
review the revised proposal enclosed, indicate below your agency's position or viewpoint on the

The applicant owns Lots 30 and 31 of Albemarle Shores 11 in Chowan County. The site is situated between
the improved Osprey Drive and Albemarle Sound. Highground along Osprey Drive is available for
wastewater disposal, and a highground area on the Albemarle Sound is desirable for residential
construction.
The project anticipates the need to fill wetlands which are subject to Section 404 of the Clean Water Act for
access and to support the residential construction. Also proposed is the construction of a bulkhead along
the eroding shoreline an average of 2 feet waterward of Normal Water yet not exceeding 5 feet. The
shoreline was surveyed on October 12, 2016, and this reflects the erosion that occurred during Hurricane
Matthew (October 9, 2016). An 85 -foot long pier with a 20 x 20 foot tee is proposed to provide access to
water for a shallow draft boat. Water depths at the end of the pier are approximately 3.5 feet.
Of the 1.968 acres of wetlands at the site, 0.14 acres are proposed to be filled for access and 0.27 acres for
house construction. All fill will be retained by a retaining wall with 15 -foot tiebacks. Mitigation is
proposed for unavailable wetland impacts from The Great Dismal Swamp Restoration Bank.
