8. PROJECT SUMMARY: The applicant proposes development within two separate
areas of the Corolla Bay subdivision. On the south end of the subdivision, the
applicant proposes to relocate, lengthen and enlarge a previously permitted
community pier, construct two groins, construct five breakwaters, install a
bulkhead/retaining wall on land, construct a kayak storage area, install concrete
walkways, install picnic tables, a bench swing and parking areas. On the north end of
the subdivision, a bulkhead is proposed along the pond shoreline (connected to
Sound).
Project Setting
The site of the proposed development is located within the ±42.71 -acre Corolla Bay
Subdivision located ±1.5 miles south of the Currituck Lighthouse in Corolla, Currituck County.
The subdivision originally consisted of three sections, Section 1 located on the west side of NC -
12 along Cruz Bay Lane and Cruz Bay Court adjacent to the Currituck Sound, Section 3 is
located on the east side of NC -12 south of Herring Street. Section 2 was located on the south
side of section 1; however, the majority of section 2 was recently acquired by NCDOT as a
possible Mid-Currituck Bridge landing site. A smaller ±9 -acre parcel located south of the
NCDOT property was retained by the applicant as a stormwater pond area for the subdivision.
The current permit request is within Section 1 of the subdivision. Section 1 consists of 72
individual Lots and open space areas, has ±8.2 acres of USACE Section 404 -wetlands and ±
3.8 acres of CAMA Coastal Wetlands consisting of black needlerush (Juncus reomerianus) and
giant cordgrass (Spartina cynosuroides). Eight of the Lots within the subdivision have been sold
and developed with single family dwellings constructed within the highground area. Three of the
developed Lots have private piers with platforms and two Lots are bulkheaded.
The subdivisions shoreline is broken up into two separate sections. Approximately 3,432' of
natural shoreline fronts the Currituck Sound, the majority of which is wetlands. A pond is
located within the northern area of the subdivision that is connected to the Currituck Sound and
has ±500' of shoreline. This shoreline has two bulkheaded Lots totaling ±122' and the
remaining shoreline is unhardened and adjacent to wetlands.
The waters of the Currituck Sound in this area are classified as SC and are closed to shellfish
taking. There are ±4.5 miles of open water to the west of the project site. Existing water depths
within the project area range from 550.5' below Normal Water Level (NWL) adjacent to the
shoreline and gradually slope to ±2' below NWL ±200' waterward of the shoreline. The bottom
substrate is made up of shifting, unstable fine sands. Due to the time of year, Submerged
Aquatic Vegetation (SAV) was not observed growing within the project area; however, it is
known to grow within the shallow waters of this area.
The adjacent property to the north is an undeveloped parcel owned by Currituck County and
the adjacent property to the south is an undeveloped parcel owned by the NCDOT. Prior to
NCDOT acquiring the parcel, Major Permit #129-09 authorized a 150'x6' community
pier/walkway that extended ±84' into the Currituck Sound to a 400 ft2 platform as well as a
bulkhead along the shoreline on the parcel.

Development Proposal
Development is proposed at two separate areas within the Corolla Bay subdivision.
Within the southern portion of the subdivision, the applicant proposes to develop Lot 37 as a
community water access area. This will involve the relocation and enlargement of the
previously permitted, but yet unbuilt, community pier to this Lot. The applicant proposes to
construct the pier with 6' wide concrete panels that will begin ±30' landward of NWL and extend
180' waterward of NWL to an L -head 20'x20' roofed platform that will have a 22'x22' dripline.
Along the northern side of the pier, a 50'x4' concrete panel step down platform will be
constructed with two sets of stairs for water access. The applicant has requested 4 kayak slips
in association with the proposed pier. Water depths within this area range from 1' to 2' below
NWL and are relatively not suitable for larger motor -powered vessels. The proposed pier will be
constructed along the riparian corridor line within the 15' setback; however, a 15' waiver was
obtained.
Two groins are proposed to protect the existing sandy beach area. The first groin will be
located immediately adjacent to the north side of the pier and will extend ±47' waterward of
NWL and ±13' landward of NWL. The second groin will be located ±22' north of the pier and
will extend 12' waterward of NWL. Landward of NWL, the groin will transition to a
bulkhead/retaining wall that is 80' in length with an alignment that will result in 754 ft2 of USACE
404 -wetland fill that was previously authorized though COE Action ID SAW#2008-00770.
Five 92' long vinyl breakwaters are proposed to protect an eroding USACE 404 -wetland
shoreline on the north side of the proposed pier. The breakwaters will have a 2" gap between
two -foot -wide sheets, will be offset from one another by ±12.5', will overlap by ±5' and have a
maximum distance of ±70' waterward of NWL averaging ±43'. Water depths within this area are
±0.5' below NWL and breakwater height is proposed to be 0.5' above NWL. The applicant has
indicated that, based on a 2005 to 2015 survey, the erosion rate along this shoreline is 3.6' per
year.
Additional proposed development at the community water access area includes:
- A 6' wide concrete walkway extending from Cruz Bay Court to the pier and sandy beach
area.
- A 20'x6' kayak storage area.
- A bench swing and picnic tables.
- Concrete and gravel parking areas adjacent to Cruz Bay Court.
- Landscaping buffer areas.
At'the north end of the subdivision, a ±204' vinyl bulkhead with a ±16' return is proposed along
the shoreline of Lots 11,12 and 13 within the connected pond. The proposed alignment will tie
into an existing bulkhead on Lot 14 and approximate NWL; however, ±1,581 ft2 of USACE 404 -
wetlands will be filled as a result of bulkhead construction. Backfill material has been indicated
as clean sand from an upland source. An existing 18" HDPE emergency yard basin drainage
pipe located between Lots 12 and 13 will be extended beyond the bulkhead to the pond.

Anticipated Impacts
• The construction of the bulkhead along the proposed alignment will result in the additional
filling of ±1,581 ft2 of USACE 404 -wetlands.
• The proposed docking facility will result in four kayak slips in water depths of 1' to 2' below
NWL and the shading of ±1,764 ft2 of PTA and EW AEC's.
• The construction of the breakwater sills along the proposed alignment will result in the
disturbance of ±460 ft2 of shallow bottom located in the PTA and EW AEC's.
• The construction of the groins will result in the disturbance of ±55 ft2 of shallow bottom
located in the PTA and EW AEC's.
• The proposed development will result in the land disturbance of ±12,376 W.
• The proposed development will result in ±9.7% impervious surface within the 75' Estuarine
Shoreline AEC.
• The proposed development will result in ±18.6% impervious surface on the tract.

The recent acquisition of the southern portion of this project site has resulted in the reconsideration of water
access and shoreline erosion control for the remainder of the property. This request is to authorize:
• the relocation of the community access pier to the area Just south of Lot 36;
• the concrete pier which will be 180 feet long x 6 feet wide with a 4 -foot -wide step down for kayak
access along 50 feetof the pier with two sets of steps leading into the water;
■ a 20 x.20 foot (400 square foot) gazebo platform with a 22' x 22' roof (484 square feet) is
proposed at the waterward end of the pier;
• an existing sandy beach which will be protected by a 12 -foot -long groin on the north and a 60 -
foot -long groin on the south which is at the pier;
• a proposed 20 foot x 6 foot kayak storage area that will be two pilings with slanted boards to
support and secure the kayaks;
• proposed picnic tables;
■ an 80400t -tong. bulkhead which will be constructed on the north. side of the community access
area:
■ a 6 -foot wide concrete walkway which will access the pier as well as the sandy beach;
• day parking which is proposed adjacent to Cruz Bay Court;
• landscaping buffer areas which are proposed for the north and south sides of the recreational
access area:
■ five 92 -foot -long breakwaters which are proposed on the south end of the property to protect the
eroding wetlands. The breakwaters will have a 2 -.inch gap which is proposed between vinyl
sheets. The breakwaters are proposed to be offset by;- 12.5 feet and overlap +.l- 5 feet; and
■ a bulkhead (220 feet long) which is proposed at Lots 11,, 12, and 1.3 in the pond and will be
constructed at NWL, 1,581 s.f. of Section 404 wetlands will be filled as a result of the alignment
which is proposed to be mitigated by the purchase of wetlands from The Great Dismal Swamp
Restoration Bank (2:1).
