Impact Justification and Mitigation Proposed impacts to the wetland at Impact Area D are required in order to provide usable building pads for the two affected lots. Without your approval of this impact, the owner will be unable to utilize a substantial amount of upland in this location. Based on the Town of Apex's Riparian Buffer Rules, a residential lot is not allowable in Zone 3 and therefore, was not proposed as a viable option during the initial site planning. Furthermore, the proposed removal of one/both of the lots in question would only result a reduction of approximately 600 square feet of wetland impacts based on the retaining wall that would be still required. Although the shape and location of the wetland has made it impactable to avoid, the applicant has taken considerable measures to minimize impacts to this feature. Minimization measures taken during the design process include the addition of a proposed yard inletforthe stormwater discharge and the reduction of approximately 51% of the total wetland impact area by shifting the lots further outside of the wetland area and reducing the lots to the minimum lot size. Lastly, the Wetland Impact Area D was observed to be a low quality system compared to the overall wetland complex or type that is present at the Site. The overall wetland type can be described as a Riverine Swamp Forest. This wetland type accounts for approximately 95% of the total wetlands on the Site. Wetland Impact Area D is disconnected from the large contiguous wetland system by approximately 150 feet of upland area and is therefore not substantially contributing to the overall function of this system. The stream crossing proposed in impact area E is required to gain access to the upland area in the southwest corner of the site, and to provide a looping waterline utility connection to Wimberly Road, as required to ensure adequate fire flow throughout the proposed neighborhood. There is no other access to this upland area that is wide enough for the construction of a paved road; hence this impact is unavoidable. Proposed impacts to wetlands in impact areas F and G will be limited to small, narrow wetland fingers that protrude into uplands on the site. These wetland fingers are impractical to avoid due to their locations on the site. Proposed stream impacts in impact location H are required for road widening per the Town of Apex. All of these impacts have been minimized to the maximum extent practicable, by crossing the stream as near to perpendicular as possible, and by impacting wetlands only in areas that extend well into upland areas of the site. On a percentage basis, proposed permanent wetland impacts will result in the loss of only 0.76% of 404/401 wetlands on the site. These proposed wetland losses will be offset through the purchase of mitigation credits from NC DMS, at a minimum 2:1 ratio, resulting in a net gain of wetlands to the watershed as a direct result of this project.
