The Division has determined that your application is incomplete and cannot be processed. The application is on hold until all of the following items are addressed: Condition 9 of Water Quality Certification 3885, which corresponds to Army Corp of Engineers Nationwide Permit 27, requires that "All work in or adjacent to stream waters shall be conducted so that the flowing stream does not come in contact with the disturbed area.... Exceptions to this condition require application submittal to and written approval by the Division." Note 6 under "Channel Construction Notes" on the Typical Sections sheet submitted with the PCN indicates that pump around shall be used "when practical". Please provide additional detail regarding how you plan to comply with Condition 9 of WQC 3885.[15A NCAC 02H .0507 (c)] 2. The plans depict riprap outlet protection below a culvert on Tinsley Branch. Are there any practical alternatives to the proposed fill associated with the rirap outlet protection that will minimize impacts to surface waters and that will still allow you to achieve your project goals?
