Subject Property: Hubert Water System Distribution Improvements
NO WRITTEN CONCURRENCE NEEDED
Dear Mr. Sanders:
You have our approval, in accordance with the attached conditions, to temporarily impact
0.682 acres wetlands to install a transmission water line from Hubert WTP to the Bear
Creek elevated water tank as you described in your application dated November 7, 2007 and
revised and received by the DWQ Wilmington Regional Office on June 23, 2008. After
reviewing your application, we have decided this fill is below the threshold for written
authorization as long as all conditions of General Water Quality Certification Number 3699
are met, which maybe viewed on our website at http://h2o.enr.state.ne.us/ncwetlands. This
Certification allows you to use Nationwide Permit 12 when issued by the US Army Corps of
Engineers (USACE). In addition, you should obtain or otherwise comply with any other
required federal, state or local permits before you go ahead with your project including (but
not limited to) Erosion and Sediment Control, Non-discharge, and stormwater regulations.
This approval is only valid for the purpose and design that you described in your
application. If you change your project, you must notify us and you may be required to send
us a new application. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and
(7). This approval shall expire when the corresponding Nationwide Permit expires or as
otherwise provided in the General Certification. For this approval to be valid, you must
follow the conditions listed in the attached certification and any additional conditions listed
below.
Conditions of Certification:
Temporary Fills
1. All temporary fill shall be removed and the impacted area returned to the original
grade. If the areas are not completely restored as described in the application,
additional written approval from this Office must be obtained to modify this
condition. o `
